Two weeks ago I called not once but twice, eBay Customer Service to make eBay aware that a customer left grossly untrue and defamatory feedback and utter lies. Publication of malicious and defamatory remarks are against tort law as well as commonsense. Thhis principle has been upheld by courts all over the US, that no one can say untrue and defamatory things on the Internet without penalty. eBay is apparently deaf to these legal decisions.
eBay aids and abets this sad situation and only offers a mild warning to the poster that they are responsible for the feedback left. It absolves itself of responsibility but will not do anything to correct this breach of tort law.
We are suing the poster for defamation and uttering barefaced lies, which she later admitted. eBay has however downgraded us from compliant to low compliance for this instance, costing us financial harm and we will therefore be issuing a legal complaint for the Courts to rule on.
We feel that under tort law eBay cannot legally tell the customer to leave their opinion without a qualification that it MUST be factual and not tortious. Further eBay cannot legally continue to say that untrue and malicious feedback is immutable and cannot be withdrawn and is purely the responsibility of the poster..
I was promised twice by eBay Customer Service reps that this matter would be passed on up to eBay management with resolution in 7 days. Nothing has been done of course and we have suffered direct financial loss because eBay has demoted us to "non compliant" which increases our fees by 20%, for daring to take issue with a customer that deceives and lies repeatedly.
We have been model citizens of eBay for 8 years with 99.8% feedback scores and because of the numerous silly eBay rules and regulations, we have seen our sales drop by 65%. This is intolerable and we have to leave eBay as it is not the marketplace that it used to be and eBay gets greedier and greedier with fees and charges.
To add insult to injury the weird eBay algorithm they use has now cancelled a listing due to the following "rationale keyword spamming" There is no keyword spamming. See our listing heading below

eBay has cut off all email communications with anyone and only offers this "going through the motions" customer service which is a waste of time. I cannot reach anyone with executive powers and I am hoping that you can.
