I was charged $28.97 on my debit card by a company that was listed as ecurves. I never joined this program or authorized any payment. When I tried to call the number that was listed with the charge (1-888-254-0054) it just sent me to a fax machine. I got online saw this website and other such sites and got a phone number (listed above). WhenI called the number I got through to a customer service representative (called Jonda) after waiting for about 15 minutes. When I told her what my complaint was, she said I had signed up for this program, and payment was for that. When I said I had never signed up for this program, she said that it was automatically sigend up when I signed up for another offer and it was mentioned in the terms and conditions, When I asked her where it was mentioned she started reading out the terms and conditions which mentioed a program called e-fitness. When I pointed out that nowhere she had mentioned "Ecurves" she said e-fitness and ecurves are the same thing and the name was only recently changed. She also said that I had to go online and cancel the account and I should have received an email with my username and password, which even though I had never in the past received any such email.

I said since I had not authorzied the payement, she should refund the charge. She just said "I cannot do that". When I asked to speak with her supervisor, she just said she was the supervisor/manager. After insisting a few times, she just asked "is there anything more I can do for you today" and kept repeating it like a broken record. The she just hung up. I also said that I would report them to theh Better Business Bureau and she said "Sure" Also said thtat I can get an attorney if I want.

I have filed a complaint at econsumer.gov and will dispute the charge with my bank, but I have no idea how such places can stay in business even after so many complaints. Isn't ther anythig we all can do..maybe file a class action suit or something.

Jerks have changed thier terms and conditions

These jerks have new terms of service up on thier website. Check these out here:http://www.efitnessclubhouse.com/upload/l.asp?ctf=termsofservice They have put in all the points that were mentioned to them in phone calls to cover their sorry behinds. They say: 1. They can change their terms of service anytime 2. They are not reponsible for sending out any informaiton emails 3. They may be linked with other companies and may share info witht them 4. After the so-called "free trial" period, they will charge $28.97 for three months before cancellation 5. To cancel we have to call the customer suervice phone number Wonder why they don't mention how exactly we are supposed to know that we are members in the FIRST place. They have only put up these new tersm and conditions right now...look like they are running scared now!!!! Join the yahoogroup to get together with other people and fight these losers. I'm hoping if we can get a few people together we should be able to alert the authorities as a group rather than just individually. The company is so cocky that the rep actually said it was OK if I get an attorney or filed a report with the Better Business Bureau. This is in spite of many discrepenices in their business ehtics (besides charging people fraudulaently): 1. They do not mention "e-curves" anywhere in their so called terms and conditions 2. They have history of changing webpages, 1-800 phone numbers, and company names 3. They are not open about contact infomartion to make it diffcult for consumers to reach them 4.The username and password they mention for their compay websites is not the same as the ones they give on the phone when you call for an explanation of the unauthorized charges 5. They never mention the ecurves website anywhere in the terms and conditions 6. Its not one or two but a large number of people who are complaining about them and they seem used to taking such calls from consumers and intimidating callers These people are actually making money by just scamming people and not selling them any products. The way I think, it wil be more effective if we stand up to them collectively instead of tryingot fight lone battles. I'm hoping if we can draft a letter explaining the whole acam, then maybe each of us can send it to our local newspaper/media/TV/radio station to put some heat on thesse scamsters. Also, if we can get the local authorities at South Jordan UT to go pay them a visit, it may drive in the fact to this bogus company that they can't do something so wrong and get away with it. They are only relying on the fact that people will not take action because: 1. They are lazy and do not want to move out of the comfort of their home 2. Most of the people who have fallen for this are not very well off or rich ot be able ot afford any serious legal action (and were tryingt to get some free stuff by completeing offers on the internet) 3. The victims may be embarrassed to admit they were scammed and may not want to talk openly about it 4. They are just hoping that since the unauthorized charge is not very large like hundreds of dollars, people will just blow some steam and give up and forget about it in course of time (or at least forget about taking serious action). But, it does not take away the fact that they have swindled so many people. If we add up all the monies that all of us were swindled out of I'm sure it will be a big enough amount for the authorities to take note. I have created a yahoo group for this purpose so we can all communicate and take action on this Thanks for your support.

I called again yesterday to talk to a customer service representative about my issue and she said the systems were down and I should call back after half an hour. After half an hour the systems were still down . So I called again this morning. Here's what happened. I told the rep that I had never ordered anything, and she said that I was showing up on my computer and she verified my address and phone number. Then she said that since I had cancelled my account I will not be billed any more (as if thats what I was asking!!). She also said that they had sen me emails and regular mail(thats a new excuse) to me, which is a lie cos I check my mail everyday (even junk mail) and my email several times a day. I never got any information on the so called membership/products. Whenever I ask for more info on the company I am given such vague answers. For instance when I ask for their adress I always get a PO box numbver. I asked repeatedly that a PO box number is not an actual address. Doesn't the company have an actual physical address? What are they trying to hide? The the rep said its on the website. When I ask them for a phone number they just say "Its thte 1-800 # you have called" no more information is given. When I ask them for their website they actually say "www.trugenix.com" they don't even give out their website. I then said "Well, I was given another website to go to yesterday ..what am I being given a wrong website address now?" The girl said go to the "efitness website". Again I asked her what the actual website address was..and she quickly rambled it off. I also asked for her name (Lisa) but she just wouldn't give her full name I then askdd for her employee number and she just rabled off some number (28000). They are sooooooooooo shady.They're just a ticking time bomb...the police or soem lawyers going to get them soon I guess cos they have so many holes in the story. They are just trying to intimidate customers by that sentence on their terms and conditions which says "If they are taken to court the customer will have to pay the fees blah blah" and by tryingot balme us all by saying" you subscribed..its here in the record etc" Has anyone noticed how phoney their excuses are..any other customer service would never do this...take unauthorized funds out of someones credit card without authorization and then be lying and shady about it. I am going to take some action against these people. If any of you out there have been similarly scammed and are interested please email at [email protected]. I believe that we are more in number than them - even by writing to our local newspapaer or police or local media or local govt official we can emabrrass them and force them to do what is right-return our money....we shoudl definitely do something people..Are you with me?
