The information provided in this report below is based on comments made by the CEO, John Bauer during an onsite inspection held by a third party verification company with no biases toward eGumball, Inc.

eGumball is a Local Search Marketing provider based out of Southern California. John Bauer, CEO, stated the following in regards to his company, "we are an outsource destination for small businesses who provide local online advertising for their business." With the growing market of online promotion eGumball exceeds the competition by offering multiple services to their clients including: Google and search engine optimization, website development, and promotional products.

Leads for eGumball are primarily acquired through cold calling methods. Once initial interest has been placed Mr. Bauer explained the sales process, "once a contract is provided, signed, and returned there is a three day right of recession period provided at the time of the contact which has to expire before moving forward. The active contract is emailed to them along with their own online portal which they have to agree to our terms and conditions when they get in to the portal." Communication is a valued process for eGumball while developing relationships with their clients, "we strive to get the business the right way. Therefore, we strive to ensure our customers are clear as to what to expect going forward."



CUSTOMER CARE & COMPLAINT RESOLUTION FROM eGUMBALL, Inc.

During the onsite interview, Mr. Bauer was asked to describe some of the common complaints that they receive. Mr. Bauer explained that their most common complaint is the turnaround results are not fast enough. In order to combat this, "we educate the client as to what we do as a company. We lay out how long it typically takes Google to show those results, we provide updates, walk them through the steps and try to put the puzzle pieces back together so that they can get a full picture of what's going on."

When asked to comment on complaints posted on Ripoff Report's website Mr. Bauer explained that most complaints were in reference to miscommunications about their service. Mr. Bauer went on to state, "if a salesperson misrepresented our services to a potential customer, we have recordings of the phone call to go back and verify all escalated customer complaints. We will listen to it, and if the complaint is valid we will rectify it immediately through the appropriate channels. If we find that the customer is not understanding, then we will go through the process of educating the client so that a full understanding and resolution is achieved." In addition, their accreditations include being partners with Google Adwords, and being accredited through the BBB.

I've had the same or similar problems with E gumball as described by others in this report area.  I originally responded to their online advertising at a time when I thought I needed to change my online representation.  As with other people I was promised a great many things including being high on the 1st page listings for my listing.  I had constant trouble with these people at one point I called and told them I was canceling and they were to nothing further with my account and was told that that was not possible that I could not cancel my account.  I'm an attorney, and there is no such thing as a contract that cannot be canceled.

As a result after protracted attempts to stop their taking of money out of my checking account I was forced to cancel the account at great inconvenience after which they promptly reported me to a collection company for 3 months of work on my after I told him not to and it had been canceled.  As I did not wish to have my credit reports carry the falsehood I sued them here New Mexico we had a trial short one where they testified by telephone.  There were never able to produce a correct copy of the online contract conditions that they were claiming were in effect and in fact at one point produce to the court such a document that contradicted their original answer. 

I obtained a judgment for 1300+ costs and interest.  They have so far refused to pay the judgment and i have been told to chase them.  Nice people

My advise avoid them like the plague they do not even pay their judgments!

Mr. Ribble.  Not familiar with New Mexico Small Claims procedures we failed to provide a piece of evidence alongside our initial answer to your complaint.  This information was not allowed to be entered as evidence during trial which resulted in a nuisance award amount which was far less than orginally prayed for.  The costs associated with an appeal, which we would have won, was far greater than your nuisance award. 

Question for you Mr. Ribble.  Do you know a gentleman by the name of David Edwin Hyatt of Illinois? 

Being a New Mexico Attorney are you familiar with New Mexico criminal cases:

As the owner and voice of the ripoff web site known as egumball you seem to have a very poor memory.  You were present by telephone in the courtroom (your choice) along with a bookkeeper and your attorney who also had cocounsel at his desk with him. To suggest that you were somehow underrepresented is belied by the obvious facts.  Your comment about the nature of the court displays your ignorance and insults the court.  In this state Metropolitan court has jurisdiction of all claims up to $10,000 with a few other restrictions.  As a result it was the only court where this case could be brought and it is not small claims.

Further your veracity was destroyed when youre tempted to lie to the court by filing a false affidavit and false documents that you knew to be false in support of a motion to dismiss the case.  You are represented by an attorney at that hearing who was surprised by the fact that he was presenting false documents of the court and withdrew the motion.  That my friend is truly slime but does seem to represent the nature of your attitude toward your clients and courts in general.  The ambiguity that you refer to is one that was created by your inability to present to the court the correct set of conditions contained in your website at the time that I agreed to let you do work for me.  It was your inability to produce documentation that created the ambiguity.

As you will also recall you filed a counterclaim against me personally in the lawsuit which was dismissed by the judge summarily in her order.  While the court did not find you in violation of the UPA of the state of New Mexico it should have.  The court granted you a great favor by only awarding damages for your breach of contract.  Nonetheless since you lost your counterclaim and I received a judgment in my favor I cannot imagine how you think I didnt win. Having practiced law for over 30 years I assure you that this was indeed a victory over a very bad actor on the Internet.

If you wish to post some kind of slander on this site I invite you to do so but you should consult your attorneys before you do.  Martindale Hubbell, the premier rating site for attorneys, rates my performance at 4.8 out of 5 and I am considered a premier provider.  Anyone who has any business relationship with a company that behaves in the way you have is an extreme danger and should seriously reconsider what theyre doing.

Finally as you have chosen this forum, I will advise you that the judgment I obtained against you for your wrongful acts has been filed in your local jurisdiction.  In that regard I also would call to your attention that you are no longer seem to be bragging about your Better Business Bureau rating which has rapidly slipped to a B. while this is far higher than it should be it is closer to the truth than your former rating. 

Since you asked me to Chase you because you refused to pay the judgment please be advised that that is my intent your state has a nice high interest rate in my judgment is an investment running against you at your statutory rate of interest of over 8%.  And while I am earning interest which will ultimately have to pay, your credit rating and Better Business Bureau ratings will reflect your unwilling this to pay a judgment that you have chosen not to appeal.

Mr. Ribble.  You should be ashamed of yourself as an attorney.  The small claims judge sided with you on fees past your contract length over an AMBIGUOUS ISSUE issue we could not illustrate OVER THE PHONE DURING OUR HEARING.  You tried to sue us for several thousand dollars and you lost.  We decided not to appeal the case.  You are a nuisance and a low life.
