First off all Rental car agencys insure only to the states minimum. Car rental agencies do not determine who is able to rent a vehicle, the DMV decides. If Enterprise refused to rent to a customer with a valid Drivers License, the Larry Parkers of the world would sue for millions in discrimination. The majority of licensed drivers only carry minimun liabilty. I am sorry for your loss but you are getting terrible information if you think you will win a lawsuit in this case. Do not let a scumbag lawyer fool you into giving them a retainer. If they really think they would win, which no good Ca. Lawyer would, they will take the case without payment.

Enterprise is self insured and in the end we could not collect a cent

I was seriously injured ten years ago by a car owned by Enterprise rent a car. The driver that totaled our vehicle and caused over $100,000 of medical bills did not have a valid drivers CA license. We sued Enterprise and they managed to have the judge order most of our evidence could not be used. The reason the judge gave was it would prejudice the jury. Enterprise is self insured and in the end we could not collect a cent from the driver or Enterprise over the CA minimum. From that civil action Enterprise should have warned all employees to verify customers driving records and license. Enterprise appears not to have given it a thought. I received a phone call from a large well known law firm this week. They are requesting all of my court documentation to review. They have a client that is a survivor of a person who died as a result of Enterprise renting to a person with a record. The trial will be held in San Francisco in Nov 04. I personally have pleaded with the public not to rent from Enterprise. Our accident should have sent a warning to Enterprise employees be more careful renting cars to strangers. I believe this civil action will cost Enterprise as the law firm has a record of success. None of this will bring back our broken neck, loss of a performing cat and one dead man. There is no reason anyone needs to do business with Enterprise.

actually... The former employee is absolutely correct.

#4UPDATE Employee

The former employee is absolutely correct. I work for the company right now as a manager and this seldom happens, but when it does, its important for the employee's to inform you. The reason they had $1000 off your card was because when you first took the car, they took out $250. But there is a signature on the contract saying you agree to let Enterprise charge your card for $250 plus any other fee's that may occur. We dont extend credit, similiar to a landlord of an apartment. When you rent an apartment, you put down a deposit and then pay once a month, your rent. When you rent a car, you put down a deposit, but if your bill is more than your deposit, you have to come in and pay more deposits, like a monthly bill or rent. The signature on the contract says you agree to allow Enterprise to keep your card current to the charges. Just like an apartment rental, you have to keep paying, you can't be 3 months behind and not expect to hear from the landlord! I hope this clears this up for you, and the former employee of the company is right, you can charge this back on your card and the company will lose the money. Again, my employee's do this all day, but the difference is we call our customers to get their approval first and explain why we are charging them. Your sitaution was odd because you paid while your cousin drove so they may have failed to clear everything up with you. Furthermore, dont be too mad at the employee because he risked his job doing what he did for you by letting your cousin drive while using your check card, so dont be too hard on them!

#5UPDATE EX-employee responds

Sat, April 26, 2003

I AM AN EX-EMPLOYEE FROM ENTERPRISE. aCCORDING TO ENTERPRISE POLICY WHEN YOU RENT A CAR THE SECURING CREDIT CARD HAS TO BE IN THE RENTERS NAME. IF YOU DID NOT SIGN FOR THE CAR ON THE CONTRACT THEN YOUR CARD CANNOT BE CHARGED UNLESS YOU ALLOW IT TO HAPPEN. ANY CHARGES ON YOUR CARD CAN BE CHARGED BACK TO ENTERPRISE AND THEY WILL LOSE THEIR MONEY. YOUR COUSIN IS SOLELY RESPONSIBLE FOR THE PAYMENT OF THE CONTRACT IF HE/SHE SIGNED FOR IT. SO IN EFFECT ALL CHARGES MADE TO YOUR CARD ARE INVALID. THIS IS ACCORDING TO THEIR POLICY AND CREDITCARD RULES. I WAS A MANAGER FOR THEM FOR 3 YEARS AND WORKED THERE 5 YEARS. OVERALL A GOOD COMPANY, BUT A FEW BAD PRACTICES AND "SOME" VERY DISPICABLE PEOPLE WORKING THERE.
