my wife and i visited earnhardt ford in chandler az to price compare cars on sept 11 2000.



i told the pushy salesman that i have no interst in buying a car and could not afford it at the time.



he inssted on bringing me into the offce and started to write down figures on the 1995 jeep i was looking at and my wife said it was a nice jeep.



he took my information and came back saying he got an approval and showed me the figures and i got up and started waliking out the door.



the salesman stopped me and said whats wrong and i told him that payment and interest was too high and that i cannot afford it.



my wife and i were out in the parking lot walking toward our car when the pushy salesman walked out saying hold on i have someone from the finance co who wants to talk with you.



i wasonly being courteous when i walked back in to speak with the finance co rep on the phone.



i was to taling with a lady on the phone from fairlane credit and told her the samething i told the salesman that i have no intererst and cannot afford making payments at this time.



at this time my wife wanted the jeep and was saying come on john you wiil have raises as you go along working with elecrtical union and the rep on the phone from fairlane said listen to your wife.



the rep from fairlane said that she was going to put me in a special program and started to tell me about it.



the program was that if i kept my payments on time the interst and payment wiil be reduced every 6 months for the first 24 months and settle to rate and payment that was about half of the original qoute.



i said i need that in writing and the fairlane rep said she wiil mail me the updated contract for me to sign and to go ahead with the current one at the dealer.



i never did recieve no updated contract and when i cotacted fairlane they said they dont have no such program. do you have that in writing and i said no your finance rep said she was going to mail the contract to me.



7 months later i was laid off in april 2001 as the contractor closed shop and i was only working part time and doing side jobs.



i tried to work with fairlane despite their deceptive pracrtices and informed them i cannot not aafford the high payment or interst that was suppose to be reduced as promised after six months.



fairlane said what can you afford at i told them $100 at the time till i get more stable work and they said that was not acceptable and would not work out any suitable arrangements with me.



i did the only appropiate action at the time and did a voluntary repossession to save face and costs of a repo person taking the vehicle by force 4 months down the road.



the vehicle was sold and the $8100 balance was on my credit reports thanks to the deceptive practices of fairlane and the salesman and i told my wife nice jeep uhuh.



the charged off collection dropped off ny credit reports in 2008/2009 and thought all was done till wage garnishments started on my paychecks april 2010 9 years after the fact.



without knowledge or warning fairlane used an attorney and filed through l a county superior court a writ garnishment december 2009 against me.



the court voilated my rights as i was never contacted  summoned to appear or served any papers to appear in court and also i reside in san bernadido county not la.



fairlane is garnishing 25% of my wages which is putting me a cuurent financial bind and there will be complications on other financial obligations shortly.



can fairlane legally do this 9 years after the fact and can i file a counter suit against fairlane for their deceptive lending practices in 2000.  bait and switch is a criminal offense.



the current judgement is $23500 not $8100 as the outrageous interst as accrued the past 9 years.

as a result of the continuing garnishment  of 25% of wages i was evicted october 2010 from my residence and lost much of my household possesions. i cotinue to struggle to meet current obligations in which i obligated with no deceptive practices like fairlane did on  sept 11 2000.
i have contacted kern county court and informed them they have no jurisdiction in san bernadido county. i moved to barstow ca  from kingman az on dec 8 2009 and have been in barstow since.
kern county clerk said summons was sent and i responded that and never recieved that summons.
i researched and found that the summons was  sent  to an address in bakersfield ca wher i have never lived. i informed the court of that fact and that my rights are being violated.
the clerk informed me to seek legal council which i have attempted to do several times.
all attorney contact answers were to file for bankruptcy which is the big red flag that those attorneys do not know what they are doing and are using the easy way out instead of digging into the violations of fairlane and the kern county court.

You should contact the court and state there was NO summons, this is called "Sewer Service" and completely invalidates the judgment, also since this debt is over 9 years old It's far past Statute of limitations.

It's VERY IMPORTAINT THAT YOUR LAST-PAYING DATE WAS 7 YEARS OR MORE FROM THE COURT DATE

It's very Importaint that you know AND CAN PROVE the last date you made a payment, if less than 3 years from the suit date you'll probably have to pay(Google your state and ask Statute of limitations (Your State)) Over three year is iffy, and after 7 is a sure thing you've been cheated

That's a crime and YOU can prosecute the collectors. (Get your stolen money back and sue for damages0 as well

I highly recommend going to the Budd Hibbs website he has a ton of good inforation about scumbag collectors, the tricks they use, and how to MAKE them obey ALL laws

june 25 2010 the 800 monthly garnishment has taken its toll, my june rent on the apartment has not been paid and i am 60 days past due om my milstar card.

i have sent detailed information to the NACA and attorneys for consumers and asked why?

why?  a  business is not held accountable for the actions of their employees. if i had any knowledge that the credit manager of fairlane was lying, i would have walked away and never came back. she was very rehearsed and convincing on her deceptive practices. telling me that i have not financed a vehicle in awhile and that she is here to help.

quoting me a payment and rate that was about 100 dollars lower and 6% lower than the $404 and the outrageous 22.9% quoted by the salesman and that the updated contract will be mailed to me in a few days to sign and return was one of the best con artist jobs i have witnessed.

I have had two previous experiences where i was told that an updated contract with better terms will be mailed to me in a few days to sign and return.

on both occassions, I did get an updated contract with better terms to sign and return. the first one was on a ford ranger from poway ford and the second occurance was on a mercury sable wagon from drew ford.

so when fairlane said they were here to help me i believed them and now i know never to do any business with them.

if fairlane would have worked with me on a temporary reduced payment plan or any other temporary workable solution when i was laid off in april 2001 the current problems would not have happened.

8 months after i was laid off, i was activated 3 times back to back on stateside active duty missions covering a total of 62 months.

now 9 years later my wages are being garnished without warning or notice and the award amount greatly exceeds the original contract amount.

i did not have enough to buy my wife roses or a birhtday cake on mothers day which was also my wifes birthday due to the exceessive garnishment.

our 18th anniversery is may 15th and that will be celebrated at home due to the garnishment.

it will be diifficult to see our son in prescott az once a month as before due to the exceessive garnishment and some of my current obligations are being threatened also.
