Promised delivery of signed Warhol Silkscreen withhis signed Contract amount stating "all funds were fully refundable if item not as described". Sent wire transfer deposits in full, per his request to AMG Financial. Four months later the item was not delivered. His signed contract stated full reimbursement of funds. Outstanding amount due is $25,000.

He makes promises of other deals (but still has my funds) implicates the gallery of fraud (and others) makes emotional pleas, blames others, blames me. He took the 25k to pay off his debts personally and will not agree to payback or make an agreement. Avoids contact and I can only believe he has done this before and will continue to do so.

Galleries and Buyers Beware. He has no inventory as posted on www.grunart.com, he is a broker and insists on full payment before shipping, when it does ship he keeps the money (or part of) and plays his game. He defaulted on his signed agreement and refuses to pay the balance in full. Will not speak directly but random communication via text occasionally until not at all. I give you fair warning. He has a reputation and it is bad for galleries and buyers.

He sounds persuasive - but that is a sign of a salesman, selling a dream his dream. His site is purely eye candy. Posing as reputable art dealer, real galleries know his scam. He still owes me $25,000 dollars. And shows no remorse. Or willingness to pay me backas I have asked over, and over, and over again. He skirts the issue and avoids responsibility. Ihave the doccuments and lengthy texts to attempt to resolve the issue - Gary just goes dark.

All the previous Customer Comments are my response, they are mine as a password issue.

Bottom line: Gruenberg  did not deliver the art purchased for 65K, via demanded wire transfer to his company AMG Financial, Inc.

He also has not honored the full return of funds, for item not delivered via signed contract. Refuses to pay back $25,000.00, and is keeping it for himself (quite an entitled compensation for non delivery of goods).

There is no side deal purchase with the gallery (deflection of guilt).I f he has questions he should direct the alligations directly to the owner.

My contract is with Gruenberg. His contract is with the gallery (and should name them as such). 

All applicable agencies have been informed of his actions: False / Fradulent advertising of "items available in inventory", Promising the return of funds, Promising a fair deal, etc...as well as perpitrating Commercial Fraud for non payment of full amount on my contract, etc...

 

As I stated in the customer responses:

Judgement day is near and the legal system is in process.

He needs to morally and ethically make good on his advertised and contracted services.

Denial and Deflection of Guilt does not make you innocent of Theft.

All evidence that is needed is compiled as needed. Your demands are premature "counselor" Gruenberg and in the wrong forum.

The basic fact is you withheld my 25k personally, so you killed the deal (with your contracted broker, your deal, not mine)  kept the money for personal use and... I have no art as contracted with you nor the funds you witheld.

This is the overriding issue. No need to deflect the theft you perpetrated. As I said, awaiting Judgement Day. I would save you demands for court as you see appropriate. That is the correct forum.

Defendant denies the allegations as set forth in the complaint and demands strict proof thereof.  The defendant re-aver and re-adopt their answer as to all the allegations of the complaint. The defendant demands strict proof of the galleries that are not doing business with Grun Art, the reasons why and any documented proof including court cases and all other documented evidence and proof that the galleries in question have not wronged Grun Art. 

Defendant demands any evidence in writing, emails or text of Grun Art's Pyramid Scheme, Greed and Entitlement which John Obrien is alleging in his complaint. Defendant demands documents which Obrien claims the legal system will prevail with including all text and electronic messages provided to Obrien by Grun Art and from the New York Gallery referring to the purchase of all artwork. 

Defendant demands information that Obrien knew what Grun Art was making such as Obrien mentions $5k, $10k or $25K profit on the sale of artwork sold to Mr. Obrien. Defendant demands a notorized affidavit from John Obrien denying having any collusion with the New York Gallery purchasing artwork directly from them.   So in summary Mr. Obrien makes all these allegations so he must have all the answers.  Please provide strict proof thereof of ALL the above.

 Mr. Gruenberg needs no assistance in destroying his credibility and dealings (see additional Ripoff Reports) and galleries which refuse to deal with him. All will be proven in court, as he has forced me to procure representation, at additional time and cost. Hollow rebuttal, false accusations on his part, Deflection of guilt, Denial of wrong doing, Accusations of galley collusion, Greed and Entitlement - hardly a trustworthy individual. The New York galleries legal team will support my position and clarify HIS FAILED contactual agreement (due to his nonpayment for the item), all part of the documentation. He had the full sum for the artwork in January but used 25k for his own bills (as stated in his text to me), now he denies and makes no effort to repay the contractual obligation.

Left me with no art, 25K short, and almost half the money wired tom him in his pocket (hardly appropriate money due for services rendered)... Why get 5k for brokering a deal when you can keep 25K.. His claims of repayment terms on grunart.com are false. His claims of inventory on grunart.com are false. He accesses images form the web to seduce the buyer to believe he has access. He does not even know what he is selling (note: my 2 contracts with different edition numbers) But he runs a great Art Pyramid Scheme. I am confident the legal system will prevail with all the documentation provided. And hopefully, send him a clear message that his dealings, past and present are abhorrent behavior. He assumes his typical victim roll, while all the while being the perpetrator. Awaiting Judgement Day.

The story that Mr Obrien portrays is full of holes.  Very simply, he conspired with our supplier gallery to sell direct to him and cut us out of the deal.  The gallery in question purchased the artwork in December and sold it direct to our client.  We are not getting screwed over without a fight and are entitled to our profit margin.   All the rest of story is just a lot of fake news and inflamatory statements in order to damage our business.  We have worked hard to complete more than 257 sales in 2017 without any negative incidents.
