We purchased our home in July 1990, the mortgage sold several times. In June 1995 the mortgage was sold to Capsted Mortgage. We at the same time got legal custody of a young boy with special needs and issues which virtually deleted our banking accounts and caused the loss of my job of 12 years.

We filed for Chapter 13 in July of 1997; during that time, our Mortgage was sold to Gmac. We were able to pay off bankruptcy early and it was dischared Oct. 5,2000; at this time, Gmac was saying we were three months behind. They kept our file in default accepting mortgage payments and then refusing others, sending them back with forecloser notices.

I tried aimlessly to work this out. In March 2002, after getting a lawyer, Gmac has not accepted any payments and now our mortgage is behind in payments for 14 months. I have everything documented - all cancelled checks from 1997 to March 2002 (when they refused to accept payments). Gmac stated I owe them 17 months, not 14, as well as they want us to sign a settlement paper (which we, of course, will not). They took us to court twice already for a judgement concerning the situation; Gmac was denied both times.

Our family has tried our best to work with them; we have been unable to uncover the truth we have known since October 2, 2000. I have all the proof to make it a open and shut case yet we are still paying thousands of dollars for lawyer fees leaving me with intolerable familial stress and personal health problems. They are taking us to court for the third time. This is all unnecessary concerning the proof I hold; the documentation renders this unnecessary.

I will fight to the bitter end if this is what Gmac wants in order to keep this roof over my family's head. Two of my friends had there homes taken by this same corporation because they could not fight back. GMAC has not only robbed me of my credit and money to pay for a lawyer, its destroying my family and sanity! I am looking to start a group to fight back! They want a war? Lets step up and give them one! If interested, respond with rebuttal.

I finally realized the American Dream early this year. After years of saving I was finally able to buy a house and get a mortgage. Looking to lower my payments I was lured by the GMAC with a no fee refinancing offer. They had recently bought my loan and are the most insufferable people to eal with. I am very young and since I have started dealing with this people I had been closed to having a nervous break-down. My suggestion is that all consumers should become one loud voice instead of several hushed ones. I am tired of getting my calls ignored. Being given the run around and feeling like my life and sanity are jeopardized. I feel so help less sometimes. My husband and I are having serious problems because of them. There is a daily argument about GMAC in my house. I even missed my sister's wedding last weekend! I was told by GMAC that I would be able to closed before her wedding and sure enough, I cancelled my trip for last Thursday because of fear that I would miss the closing paperwork. When I finally got to speak with a supervisor last Wednesday, she gave me no comfort and was almost rude. I feel really desperate. My lock in agreement expired 9/16/03 and Peter my invisible rep claims he extended the lock in. I will live in panic until closing day if there is one? Y will join any group that will help someone get justice against this company. Where is the banking commission? What are they doing? Are we really all alone in a war a millionare company that prays in the little guy? Let's pray our justice comes soon!
