We bought our doublewide in July 1997, making this year 11 years we have had our home. It was financed through Green Tree at that time, payments were $448.80. In 1998, we refinanced at $68,400, making the payment $679.97 through Southern Atlantic then sold to Conseco, then a few years later sold back to Green Tree. Now our payments are $705.60.

We have had our problems, same as everyone else. My husband became Diabetic and in the hospital for a while on and off since 2002.

Just recently we have became 2 months behind on our home. Green Tree had called every day and I do not and ill not answer their calls, because I have been called a liar, they have litterally called my husband a dog and I refuse to talk to them anymore. They have called our neighbors, people down the street that do not even know us, and our family members. They have even scared my 15 year old niece *at the time* one day when she was babysitting for me, they called and told her they were coming to this house to get it while she was in it. That was ridiculous. Who sounds childish?

My husband talked to them on the 30th of June and told them he would have the money on July 3rd, well, wasn't good enough. She took the bank info and told my husband she was taking it out on that day, June 30th and then july 24th. Needless to say it bounced on July 1st. The same day my husband talked to the company, they sent us a deafault letter dated the same day June 30th.

We recieved yet another letter from Green Tree of a "Notice of reciept of partial payment" that was dated July 1st, *they didn't actually get that payment, it bounced* saying "Thank you for your payment of $705.20, .40 cents less then they said they were taking out, which was recieved in our office on 06/30/2008. Please be advised that we have started to take the necessary steps required by law to gain possession of the creditor's collateral.( Does this mean they are already starting reposession?) We have already sent you a "Notice of Default and right to Cure Default Notice" adivisng the amount of default. that notice is still in effect, and we will proceed as outlined in the Notice unless we recieve $894.63 before the due date set forth in the Notice. This is simply to notify you of the terms acceptable to green tree to forbear from pursuing its rights to the collateral. YOU ARE UNDER NO PERSONAL OBLIGATION TO MAKE PAYMENT AND ANY AMOUNT YOU DO PAY GREEN TREE ARE AT YOUR DESCRETION." But yet we have been paying on *their* home from Nov. 2005 to 2 months ago without any knowledge of the home being in the Bankrutpcy. Not including the insurance we were paying to them for them, that we thought *WE* had.

Well, I just recently got my husbands credit report and it showed Green Tree "Included in Bankrutpcy", Secure Loan, closed account, with the same account number. $0.00 Balance. It wasn't listed once, but twice. I was in shock.

We did file Bankruptcy in August 2005 and wanted to keep the home. I called the US bankruptcy Court and found out that our home was filed bankrutpcy on and that we DID NOT sign an re-affirmation. As soon as I heard this, it felt like a huge burden had been lifted. I quickly raced to the bank and took out all the money we did have.

Green Tree has not mentioned anything about the bankrutpcy on the home. I guess just a way to keep money rolling in.

We have gotten so tired of all the harrassment thay have given us over the past 11 years. We have decided to walk away from the home that will never be ours now. They are not worth it. And I don't think they will be getting what they want out of this place. Doors falling off hinges, bathroom floor is coming apart, light switches needs reaplacing. I guess thats what you get when you get a crappy home from a crappy company. I will miss the fact that the kids were raised in this home and we were secluded from the neighborhood, but thats about all I will miss. I would not recommend anyone to Green Tree.

Well, Jan.6th was the court date for the foreclosure. We didn't go since we had already moved out. In Novemeber they had the auction. Starting bid was $65,000 and ending bid was $65,000. The bank bought it back. But........they had to pay the back taxes of $4,000 some dollars and have to build a drive way that will cost over $15,000 or more, if they want to sell it. The drive way we used is not an easement and goes through 5 family members which do not give permission to them to use. We seen the cleaners go through there and also the Real estate man to put up signs in the woods next to the house which isn't on the land also. We had a family member talk to the real estate guy and told him about the driveway, which he said he would have to let the bank know and they wanted $65,000. After he found out about the driveway he told my cousin that he could probobly get it for $40,000...which is still not worth it. The deed we had made states that the drive way has to be built from my sister in laws to the home, which it is a good ways from her house to the home. I am so glad that we aren't under those rude people anymore. I just don't know how they sleep at night. But, I know my life is better without them in it. So, who is stuck now?

Update: July 21, 2008 Recieved yet another phone call from Green Tree at 8:40am July 21, 2008, a different lady asking for my husband or me. I talked to the lady and she said she was calling about our payments that we were behind and asked when would we pay them.............My jaw dropped! There must be no communication at all throughout that company. I told her that I had talked to two other ladies last week and told them we were letting them have the house back. The new lady calling started to get huffy, so I gave it right back to her. She asked why we were doing this and I told her the payments were just too high. She replies, "You will not get any other houses for less then your payments you have now." I told her that there were several houses in the city that were 2 and 3 story homes, with basements, and a paved drive way for less then what we pay a month, to be exact, the payment listed was $527.00 a month. This is a doublewide with a gravel drive, and no basement for $705.60. She also goes on to tell me that we were moving out July 30th, I SAID "NO WE ARE NOT" that I never told anyone we would be moving at a certain date. I asked her why was she calling and she said that the account rep. that we have, had an injury and did not come in. She again became huffy and said for me to hold on.......she then puts me through to the lady I had talked to on the 16th, Tammy who I talked to on the 16th asked me who put me through to her.......You would think they would know this as well, and I told her I did not know the lady's name. I also asked Tammy what the deal was with the computer messages showing we told them we were moving on the 30th. She replies, "No, It doesn't have it showing you are leaving on the 30th, it says that you have no idea yet when you are leaving." She asked again if the property had any loans against it, like, credit cards, taxes, so on.....I said yeah we have taxes that haven't been paid, then she asked how far back, and I told her it had been a while. Then she said we should recieve the papers from the lawyer sometime this week. I told her we were taking the papers straight to our attorney to have them looked over. I also asked her what were they goin to do with the property, sell it? and she said yes and I asked her, for the price you want now? and she said no, that they would have to take a loss on the property and sell it cheaper, and then I told her yea, It will not go for much because the house really needs some work done. She then said that they were a huge financial company. If that is the case, then why did she tell me they were going to have to take a loss, and why will they not list it in the paper? I still cannot believe that they actually called us back to get payments after all the talking I did last week. Oh and another thing, My name is not on the Mortgage loan at all, but it is listed on the deed to the land. Can this company be taking my word on what we are doing or do they have to talk to my husband , which it is in his name. Guess we will find out from our attorney soon. axton, Virginia

A very rude *lady* called me on July 14th, asking was our intentions to keep the home. I told her we have decided that we can't afford the home anymore, and she said that "I'm showing you had bankrupted on the home".....NOW they tell us, after we just found out by my husbands credit report this year, and it has been now almost 3 years that we could have found another place to live and paid half the price. I told her "yeah, we just found that out and she was trying to get me to agree to leave by July 30th *the last day of the default letter*. I know my rights and know that we can stay til we get eviction notice. This *lady* was hollering and screaming at me on the phone to where I had to tell her she had no right talking to me like that.....twice! She goes as far as to say "Don't make no sense" and HUNG UP ON ME! I couldn't help but laugh. July 15th, Recieved another phone call the very next day, I called her back and she wasn't there so I left a message telling her, "I thought I had explained it all to the other *so called lady*. So, she called me back the very next morning and said she recieved an email from the other *lady*stating that we were letting the home go. I said yes, we were. She asked me why and I told her we couldn't afford the payments anymore that it would the same thing for the next 100 years or more til it was paid off. I also told her we just found out the house had been filed on and she said that was no reason to let the home go. Again having to explain the payments were to high. She asked could we be out by the 2nd week in August, I told her the same as the other woman, "I don't know". I even told this woman that the other *lady* I did not like and that she had better not call me ever again, she said "OK".Conversation ends. July 16th, I get another call from another lady *same day as the last lady calling*, asking if there was any loans against the property, I said no, so they have decided to do a "Deed to Lieu"......I asked her what that was and she said it was a simple, quick foreclosure, since we are voluntarily giving the home up and that they would not run the ad in the paper on the home. They are going to deal with an attorny in Va Beach and that I would recieve a letter Fed Ex from him. She also said she was goin to go ahead and draw up the papers to send, Do they not wait after the default date? I again told her I did not know when we were leaving, in case something came up to where we can't move by a certain date. When I recieve those papers from the attorney, I am taking them straight to town to get them checked over before we sign anything. When I recieve more info. I will update!
