Andrew Tickle Realty Does Not Provide Heat or Hot Water

I almost died on the morning of January 4, 2018 when the carbon monoxide from the burning hot over I had to run over-took me. It brought all of the signs of classic of carbon monoxide poisoning because I had to heat my apartment with a burning, hot over just to stay warm.

Neither Andrew Tickle or the City of Rochester, NY give a d**n about that. The city will not enforce it's very own code violations.

I WILL BE HOMELESS COME OCTOBER 1, 2018 BECAUSE ANDREW TICKLE REFUSES TO PROVIDE HEAT!

The Big Deal question to this whole Rip-Off is this: the City of Rochester Code Enforcement inspected my apartment on March 23, 2018. At that time, they documented 60 degrees in my apartment, way below the legal minimum of 68 degrees. (see below docs from Rochester City Code Enforcement)

Chief City Inspector Carl Clifford told me that day that my landlord, Andrew Tickle, would be told that he MUST fix this problem "immediately" or else he would face a fine of $100 per day.

The problem is, Carl Clifford and his City Code Crooks now REFUSE, with absolutely zero explanation, to enforce their valid inspection. Instead, Andrew Tickle will not have to replace my furnace and I will be homeless because of this!

In the 7 years I have lived in this apartment, under two separate landlords, I have never had legal heat. I have always had to supplement my heat by burning (illegally) a hot oven and several electric space heaters. (We won't get into why this has gone on so long over 2 landlords now. Just the issue at hand today.)

Andrew Tickle took over ownership of this apartment at (((REDACTED))) Rochester, NY in March 2017. I told him on the very first day that I lacked legal heat i.e. above 68 degrees F.

The Big Deal question to this whole Rip-Off is, the City of Rochester Code Enforcement inspected my apartment on March 23, 2018. At that time, they documented 60 degrees in my apartment (see docs immediately below "Notice & Order Violations" and "Open Case Violations"  from Rochester City Code Enforcement), way below the legal minimum of 68 degrees.

On that day, March 23, 2018, Chief City Inspector Carl Clifford told me that my landlord, Andrew Tickle, would be told he MUST fix this problem “immediately” by replacing my furnace or else he would face a fine of $100 per day. The problem is, Carl Clifford and his City Code Crooks now REFUSE, with absolutely zero explanation, to enforce their valid inspection. Instead, Andrew Tickle will not have to replace my furnace and I will be homeless because of this!

So, instead of extending my lease one more year, Andrew Tickle sent me the above "Notice of Non-Renewal of Lease" document. Instead of enforcing the violations they laid upon Andrew Tickle on March 23, 2018 to install a new, workable furnace in my apartment, I will be without a place to live come October 1, 2108.   I am too poor to move. I do not have the necessary $1,000 just to pay a mover. I have no idea where to go and do not have the money or desire to move. Why should I? Just because The City of Rochester, New York REFUSES  to enforce it's own building code regulations? How is that?



 Why won't the City Of Rochester NY enforce legal heat laws? 

Andrew Tickle tells me to be out of my apartment by October 1, 2018; however, the only reason Andrew is not renewing my lease is because he does not want to pay the $4,000 for a new furnace that the city told him to install. This is retaliation on the part of Andrew against me.

It is against the law to retaliate against a tenant who has made....

A good faith complaint, by or in behalf of the tenant, to a governmental authority of the landlord's alleged violation of any health health or safety law, regulation, code, or ordinance, or any law or regulation which has as its objective the regulation of premises used for dwelling purposes or which pertains to the offense of rent gouging in the third,

second or first degree;

You've lived in an apartment which is freezing all winter and has NEVER had "legal heat," for seven years, which  makes you sick because you have to run the burners in a gas oven (I think that's what you are saying?)  And you are angry because your landlord won't renew your lease?  Why on earth would you want to remain in that apartment???? Why haven't you been proactive about finding a place to live for seven years?

I think there must be something missing in your story.  Are you actually paying rent, or is this a case of you refusing to pay rent because of inadequate heat and your landlord failing to find a way to evict you?
