To Whom It May Concern:

Please help us, we desperately need your assistance. Iryna and her son Victor are writing this letter.

We purchased a new vehicle, signed contracts, and took the car home from Healey Brothers Hyundai in Mount Kisco, NY on February 20, 2004. They are now trying to raise the price of the vehicle by $2500.00 and when I refused to pay these additional funds they sent over REPO MEN which tried to take my car but were only successful in stealing my plates and vehicle registration. My first payment in the contract isn't even due until April 5, 2004.

The details are as follows:

Victor Hoshovskyj (son) went to Healey Brothers Hyundai in Mount Kisco and asked if they could beat a deal he had previously negotiated at another dealership. After a test drive and some discussion with Matt (sales associate), Victor was told that he in fact had a very good deal and that they could not beat it, but their policy was that they would meet the price. Victor felt that the customer service he was provided and general more friendly atmosphere he encountered at Healy Brothers made him much more comfortable buying the vehicle there.

The team at Healey Brothers ensured Victor that he had to be refunded his deposit from the previous dealership and that if any problems arose that they would definitely help recover the deposit if the deal was done with them. Victor put a $100.00 deposit on February 18, 2004 and signed a contract to the cash price of $12298.00, with additional rebates of $500.00 for Owner Loyalty and $2000.00 for some Hyundai Elantra Incentive Program.

On February 20, 2004 Victor returned with his mother Iryna to Healey Brothers Hyundai to sign the finance papers and to drive the car home. On February 20, 2004 Iryna signed a Vehicle Invoice in the dealership stating

The price of the car: $12298.00

VSI(?): $55.00

NYS Tire Tax: $12.50

Sales Tax(7%): $860.86

Inspection: $10.00

Dealers Fee: $45.00

Registration: $100.00

Total Cash Price: $13381.36

Depost: $100.00

Rebate: $2500.00

Amount Financed: $11929.20

Total: $14529.20 / $13381.36

Iryna also signed a Retail Installment Contract by Citizens Auto Finance, Inc.on the same day in the dealership, stating

Annual percentage rate: 3.99%

Finance Charge: $1147.84

Amount Financed: $10781.36

Total of Payments: $11929.20

Total cost of purchase on credit, including down payment of $2600.00 is $14529.20

Line C of the contract shows where the Owner Loyalty and Incentives were applied towards the down payment and Line D shows the total down payment as $2600.00. The first payment is to be made on April 5, 2004.

On the same day in the dealership, Iryna also signed a Hyundai Customer Purchase Assistance Incentive Claim Form where in section 6 she elected to use the $2500.00 incentive towards the down payment of the purchase, therefore assigning it to the dealer.

On February 24, 2004 Victor received a phone call from Debbie at the dealership. She wanted to sell a warranty for the car and additional Theft Protection. After a discussion Victor agreed to pay $848.00 for an extended warranty to 100,000 miles as well as $199.00 for Theft Protection.

He wanted to pay for them by credit card in full but she told him that she would be able to reduce the financing rate to 3.19% if the cost of the extended warranty and theft protection were included in the financing package. Victor and Iryna discussed this issue and decided to include the additional costs in order to obtain more favorable financing.

Since Iryna was unable to come to the dealership at that time to sign the papers, Debbie suggested Victor bring them to her job, have her sign them, and return them to the dealership. Victor did this and Iryna signed a new, second, Citizens Auto Finance, Inc. Retail Installment Contract and a Complete Care Vehicle Service Contract.

The Retail Installment Contract by Citizens Auto Finance, Inc. stated

Annual percentage rate: 3.19%

Finance Charge: $1006.15

Amount Financed: $11901.65

Total of Payments: $12907.80

Total cost of purchase on credit, including down payment of $2600.00 is $15507.80

On February 25, 2004 Victor received several messages asking him to call the dealership immediately. Victor called the dealership and asked what was wrong, but no one would tell him anything except that he had to get to the dealership right away. Late that evening after work Victor went to the dealership and sat with Debbie to find out what was going on. She told him that he and his mother had to pay $2500.00 more for the car and a higher interest rate or he had to return it right away.

They had new contracts all ready prepared and said that they have to be signed tonight OR ELSE! She said someone will follow him home and get the car from him that night if we didn't re-sign. He kept asking why they are raising the price of the vehicle after the fact, after contracts were signed and he already took it home and drove it for a while? They told him they can do whatever they want and we have to abide by it. Victor was very distraught, took the new contracts, and left.

On February 26, 2004 Victor called the Consumer Protection Board, Attorney General's Office and asked several lawyers to review his documents. Everyone said the we didn't do anything wrong and that we shouldn't allow ourselves to be bullied around by Healey Brothers Hyundai.

On February 28, 2004 Jennie (or that was the name the man gave Victor) from Bounty Hunters (845) 278 9087 (came in a red 1994 Toyota Camry, Plate # CDT 3744) came to reposes the vehicle. He refused to show me any of his paperwork and made many treats to Victor. He said he would rip out all our bushes and damage whatever he felt he had to in order to get the car. He stole the Registration and License Plates and he made a huge scene. The police came and the man eventually left.

Now I have no way to drive my new car and this has created numerous costly inconveniences for our entire family as well as a lot of undue stress and sleepless nights.

We are in a very disturbing situation and we appreciate any and all help that you may offer us.
