On May 18th, 2011 my company purchased 133 boxes of prefinished hardwood flooring from Hernandez Carpet Brokers. The merchandise was to be picked up my a client not more than 10 days later, however the client had financial difficulties and did not purchase the flooring, even though it had already been paid by me.

The product was warehoused at Hernandez until July 7th, 2011 when I was able to sell 51 (FIFTY ONE) boxes of the merchandise. The client was billed, the client paid for the 51 boxes and he was authorized to pick these up at Hernandez Carpet Brokers. For some odd reason Hernandez Carpet Brokers initially released 68 boxes to the client and two weeks later they released an additional 65 boxes of the same product!! All of this was done while ONLY 51 boxes had been authorized to have been released.

According to the warehouse release logs that were obtained from Hernandez Carpet Brokers, the initial pick up took place 07/13/11 and the second pick up was done on 07/27/11.

The Vice President of the company is now indicating that Hernandez Carpet Brokers has no responsibility because they thought that the client was in reality the owner... to use the VP's own words, the client "had been very nice and spoken to all the guys at the back of the warehouse "and that the client "seemed to be the owner of the merchandise". At no point during the phone conversations that were held did he take any responsibility for releasing MY product to an unauthorized person.

The same VP has indicated that this is a matter for the attorneys to handle and that HCB has no fault in this. Meanwhile, we already found a client interested in the 82 boxes of flooring that HCB is supposed to be warehousing.

I am now out close to $4,000 of hardwood flooring and have no way to recover the money or the product as the product was taken to Mexico and installed there. NO ONE SHOULD DO BUSINESS WITH HERNANDEZ CARPET BROKERS!
