I refinanced with Suntrust Bank. My second mortgage being held by Homecoming Financial. Suntrust and I received pay-off letter from Homecoming with exact amount needed to close my second mortgage with them. (Homecoming) I easily refinanced with Suntrust and Suntrust sent the full amount (plus $270.10) to Homecoming Financial. The full amount was sent to Homecoming within 4 days of receiving pay-off letter from Homecoming. A cashiers check was remitted to Homecoming April 3, 2007.

I started making payments to my new home equity company (Suntrust). I noticed on June 1, 2007 that Homecoming sent me an email that I was late on my payment. (nearly a full 2 months) I immediately drove to my bank to have the banker check on the status of the cashier check. Homecoming did not cash the check nor could they find it. Suntrust and I immediately stopped payment on first cashier's check and sent in second check for full amount plus $270.10. The pay-off letter stated that the amount of pay-off was 'good' until June 16, 2007. On June 20, 2007, I went to the bank on Wednesday June 20th to check the status of the second cashier's check. The second check had been cashed. I called Homecoming to check the status of my account. I was informed that I was another payment late. I was also being threatened with default. I talked with Collin Hoffman (probably a fake name like many fake names they have given me) and he told me there was no record of any cashiers check being deposited in my account. Not only was there 'no deposit' there was no record of the check at all. I verbalized to him that Suntrust said that the check had been cashed. The check was sent Federal express. Homecoming had not only lost the first check but they cashed, deposited and 'then lost' the second cashiers check.

Suntrust and I noticed an odd number on the second cashier check when we pulled the cashed check log. The number was an account number that was no where close to my account number. I discussed this odd number on my second cashier check with Collin. (because he could not find the money anywhere!!) He pulled up the number that I gave him and Homecoming had given my entire pay off to someone else. The money was transferred to my account, finally.

The 'fun' is just getting started. The money that 'finally' got transferred into my account was 'labeled' a payment and not a pay-off. I immediately called and was 'told' it would be taken care of. I received a formal letter from Homecoming 'non' dated legal document format that I owed an additional 1,746.00. They reported me as having late payments and I was threatened with foreclosure.

I called again and told them that I sent $270.10 more than I officially owed them and they cashed it. I reminded them that they never responded to me concerning the pattern of errors that they had made. I was told that the money that was transferred into my account was never transferred into my account as a pay-off but a payment. It was becoming very clear to me that Homecoming Financially was a fraudulent company and they did not want to release my loan at all but wanted to hide my money/lose my money/keep me running in perpetual circles so that they could charge me interest and force me into default.

I received another letter stating that I owed 614.15. I am now in default. It is August 2, 2007. I can not get anyone consistent on the phone. I am given wrong extension numbers and no case manager to handle my concerns.

I continued to call. I waited up to 90 minutes on my cell phone waiting on 'the magic' supervisor to show up. After waiting multiple times, I got Michael Pat on the phone. Michael told me that Homecoming financial was in the wrong. He told me that he used to work for 'the other' collection division and that he would get the whole thing straightened out. I waited for almost 2 hours. He came back once and told me he was sorry I was still waiting. Being a patient person, I stayed on the phone. Finally Racheal answered. She didn't know Micheal Pat and did not recognize his extension number of #6818. She said that extension numbers were 5 digits and not 4. There was no Micheal Pat and no extension 6818.

I continued to call back. It, again, was clear that I was involved in a fraudulent situation. The phone game started again. I lost it. I demanded to talk to the boss. I yelled at them. I had to go on Zoloft because emotional angst this has caused me. The have reported me. I have had honorable mortgages for 25 years and these con artists actually reported me. I have never been through anything as stressful as fraudulent behavior.

On June 21, 2007 I sent a detailed urgent memorandum to Collin Hoffman and his superiors to include quality control and department manager. The memorandum outlined the pattern of mistakes that Homecoming had made over the previous 2 1/2 months. I did every thing in my power to help them in knowing 'what could have gone wrong'. Being in upper management myself, I could see patterns of erroneous details and multiple mistakes. Homecoming changed my mortgage account number with no notification, moved their address for pay-off's, lost my first cashier's check, gave my money to the wrong person and could not find the second cashier's check because they deposited it as 'payment' instead of 'pay-off' in someone elses account. They finally got the money in my account but it was a payment and not a pay off. Collin assurred me I would get a response of confirmation that they received my facsimile. No response ever came. I could never find Collin again.

SUMMARY

The bottom line is this... Homecoming Financial did not want to release my loan. They have strong-armed me, lied to me, lost money, given my money to someone else, changed my account number, not honored their pay off letter, changed their address and threatened me in every way with default and credit failure. Suntrust Bank witnessed the entire ordeal. I am innocent of all wrong doing. I have never had anger, resentment or felt vindictive toward any institution but Homecoming Financial are professional fraud/con artists. This will be my first lawsuit. I just need to find a compentent lawyer to help me.
