In August of 2001 my husband and I received a foreclosure notice. We thought they had the wrong people because we were did not owe a mortgage payment until December 1st. Not only that, the forclosure suite was filed by a company named "Bank One as Trustee".

We had never heard of them nor did wse have a Trustee.

We got an attorney and have found out that when we refinanced our home we were with "Cimarron Mortgage" and we had a conventional mortgage NO TRUSTEE. When we refinanced we never received a NOTE only a mortgage which we did not notice because we did not know any better.

Then our loan was sold to "BANK ONE as TRUSTEE" or at least that is what Homecomings says and that is what is filed with the court house in Palm Beach County. BUT, the attorney's at Bank One said that they never purchased our home that GMAC-RFC (there is nothing on record showing any involvment with GMAC-RFC) purchased our home and hired them (Bank One) to be the trustee and hired Homecomings Financial to service the loan.

It is now June of 2004 and we are still in forclosure, our credit is ruined, every time we go to pay our property taxes we find out that Homecomings has already paid them even though we are in forclosure and our loan is not escrowed, we can not refinance, and to top it all off NO ONE KNOWS WHERE OUR NOTE IS!!!

Homecomings says that Bank One has it and Bank One says that they never had our Note that GMAC-RFC has it and GMAC-RFC says that they have nothing to do with our home but they have our files. Homecomings and GMAC-RFC have broken so many laws that our attorney does not even know how many. To start with we know that they have broken every Credit Law known to man, Fraud, and possibly a severe case of Fraud if they can not come up with our NOTE.

We have been in forclosure this long because there is no NOTE....NO NOTE NO MORTGAGE!!

AND WE WERE NEVER LATE ON OUR MORTGAGE 1 TIME AS A MATTER OF FACT WE PAID EARLY AND WE PAID EXTRA PAYMENTS WHICH WERE NEVER APPLIED TO OUR INTERESTED LIKE IT SHOULD HAVE BEEN.

OUR attorney is also confused because he does not know how our loan was turned over to a TRUSTEE without our consent or knowledge we did not have that type of mortgage.

If anyone out there knows of another attorney that specialises in Realestate that could help us quicker then our attorney please HELP!!!!!!

your responce sounds like an add for gmac this company needs to go away and pay for the dirty dead they have done to people i for one am going to do everything i can to see that they pay for what they have done to me everyone out there DONT DO BUSSINESS WITH THIS COMPANY OR ANY COMP THAT HAS CONTACTS TO GMAC they are a bunch of lieing crooks!

dear regina i am so sorry you are dealing with gmac i have been dealing with them for over a year and a half they are a lieing bunch of bastards i have proof i have just lost my home of 16yr because of a mistake they made and they know it see the gmac deaf dumb and blind report i filed if gmac said they dont have your file but they really do you need to contact me i will give you all kinds of info and places to call also i have recieved a letter from 60 minutes wanting me to tell them my story for a possible airing and if your story is good will can send them in together it will just give more credit to the fact that this company is a bunch of crooks and need to be taken down i also have the name of an attorney for you to call he has my case now that my home is gone and he seems like a real go getter also a word of advise every time you call in you are only getting a $6.00 phone operator start screaming at them and asking for a higher up person and a direct number to call that person back dont forget to keep a log with dates times and phone numbers in it i have a file almost four inches thick hope this helps dan in ftl
