Homecomings Financial seems to be in the 'business' of CHEATING people OUT of their homes based on everything I've seen written online...scared me so much a couple of weeks age that I posted my complaint on a class action site and now have a law firm in NY interested in a class action suit against Homecomings. They are GREAT people at the law firm helping me personally so I won't (hopefully) lose my home to this FRAUDULENT company.

If any of you out there have any suggestions for help or know anyone who has/had problems with Homecomings. PLEASE have them post and/or email me ASAP, The law firm, Wolf Popper, NY is looking into CLASS ACTION SUIT against Homecomings Financial. You may contact me by using the rebuttal box below.

Homecomings refused to help me get refinanced to a lower rate and was harassing me as my "late" fees were building up. I could make the payment but not the extra fees. GMAC is no better as they keep tacking on more fees. I have tried to get the payment date changed and they refuse so more fees keep being added unfairly. I have been watching to see if anyone gets any head way on a class action suit as these people need to stop taking what we have worked so hard for.

My wife and I built our dream home in 2003. We were told by yhe lender that all was fine until we came to closing. Suddenly there were additional fees and to our surprise a ARM that was raised from 6.750 up to 9.750 in less than a Year.

In a short amount of time the housing market went bust and I was having serious health issues. We tried several times to contact someone at Homecomings and each time was given the run around, we begged to speak with someone and were sent packages to submit to them several times. Each time we submited them we heard nothing.

Finally we lost our home to forclosure and ultimately filed bankrupcy as well. I suffered a heart attack shortly after all of this happened as well.

These people are ruthless and as heartless as they come, I can only hope they get their's in the end and someone really looks into their shady business practices

I have seen some of the reports listed here detailing some information on either law firms and/or persons involved with various types of lawsuits against Homecomings Financial. PLEASE let me know on how to join such lawsuits!! Homecomings Financial has made my life miserable with their extortion's, outrageous legal fees and reinstatement fees and so much more!!

Now that they have been taken over by GMAC, I am ** STILL ** paying 13.49% interest on a loan that I took out in 2000, which Homecomings "re-started" the loan over again in 2005!! This "re-start" basically voided out all of the payments I had made up until 2005, then it was just like paying on the loan from the beginning again!!

PLEASE inform me on how to join any class-action lawsuits against Homecomings Financial. THANKS!!

I wondered how in the world we were even approved for a loan almost 6 years ago. After a lot of life changes our credit was anything but pretty and we didn't even have a down payment. I was skeptical especially when we had no evidence of an appraisal or inspection. But we were so eager to own our own home and we loved the house. The man who sold it to us was an investor and he told us that he took care of all those details that showed paid by the seller. He also paid our down payment...which we later discovered isn't an acceptable practice.

My guess, now that I am seeing all of these reports, is that the investor was in cahoots with homecomings and they intentionally set us up for failure. We were vulnerable and blinded by the chance to own our own home. And he pounced on the opportunity.

We have managed to hold on to our house, by the sin of our teeth and after many close calls, including foreclosure notices. I had to borrow the money to hang on to it in 2008 and it was at that time that I realized I had charges on my account for appraisals that never occurred. I told them that no one has appraised our house and they said that they take pictures from the outside. I said that you can not appraise a house without looking at the inside and that I wanted to see the pictures. She said she doesn't have them. I insisted that is be use they don't exist. I was also being charged for other misc. items such as a payoff request that I never requested nor received.

We are, by the grace of God, current on the house and working to refinance with another company. Unfortunately it is difficult because of the damage to our credit.

It all makes a lot more sense now. If I can help and/or receive any help on this, please let me know.

I am very interested in any class action suit that you may file as Homecomings gave my elderly father an interest-only loan adjustable arm loan.  They should never have given an elderly man this type of loan.  Moreover, they inflated his income in order to ensure that he qualified for it.  Lied about the interest rate, tried to force-policy insurance on him, and more.  Definitely predatory lending practices going on.  Please contact me at (((Redacted))) and let me know if a class-action suit will be filed.  Thank you.

Homecomings Financial tried to steal my home as well, they are aware that my home is worth 5 times what I owe on it.  I got behind on my payments and they called and said I was the perfect candidate for a modification loan.  I told them I could catch my payments up within a few weeks, they said no, just pay this new modified lower payment for 6 months, then we will lower your interest rate and your new payment ammt will be ____(alot lower).

3 months later they said my modification was declined and if I didn't pay over 10,000.00 within 10 days they were going to forclose. I explained that I would be behind this much if it hadn't been for the modification plan they did.

They agreed to let me make payments alot higher than my original monthly payment to catchup the arrears, and set it up to automatically draft my bank account.

 

I was not happy, but this would work out OK.  Then the 2nd automatic payment did not come out of my acct when it was suppose to.  I called and they said I defaulted and they were in the process of forclosing. After argueing for over an hour and being on hold for over an hour, they offered me several payment options that were outrageous, then finally we came to an agreement and I am making payments that are way too high every other week. now I am just barely hanging onto my home.

This should never have happened. This was their doings from the start. I believe they had every intention of stealing my home because it is still worth way more than the loan.

John please get a hold of me I would like to join you. I live in Virginia Beach. I am now dealing with GMAC and have been for the past 9 months tring to a loan Modification. It has been to say the least a nightmare dealing with these people. The have put me on two differnet plan till they so call go over my case. Which was only suppose to take 3 months yeah well we are on month 9 and still nothing. They said I had to be three months behind. Now they send me a letter that they might foreclose since I am behind. How can they do this? I feel they want to take my home and sell it to make a better profit rather than help me.

I am looking for help anywhere I can before I lose everything all because I asked for help from a company that got over 13 billion in bailout money and another 3.5 just recently in Dec.

After all the trouble I have had I just found out they missed a payment on my taxes and the county sent them a bill with fines and the back tax and they reassest my escrow and are trying to raise my house payment over 2 times. If you look back I don't think there is a law suit againt Homecomings. Does anyone have a good suggestions to get this ball rolling? We need to get together and find out what we can do.

I was having problems making the payments last year before GMAC took over. I was told I couldn't get any help with their version of a loan modification unless I was three months behind. I told them I wanted to stay current but I was struggling. I never went more than 30 days late but had a man out here taking pictures of my house. I asked who he was and he said he was checking on the property as they were concerned I was going to go into default. I told him (at that time ) I was only 28 days late and it would be in before the 30 days period. In the 3 years I have had this loan I have only been late twice more than 30 days and that was over a year ago. They never gave me any kind of help only their version of advice which ws to go past my 30 days so it would go into default and then they could help --but usually not for 90 days after that! Might as well have given the house back to them. I must say thta GMAC is not living up to their Obama home loan modificaton either -I filed papers 4 months ago and they keep saying it is being processed.

We lost our home in 2005 to these guys. Reading through the stories of many of the posts I thought I was reading mine.  We were behind on our payments can't argue that, however we were told to make a payment now over the phone and we could get our account to mitigation. Did that. Mitigation had us fill out all kinds of paper work and send in proof of income ect. Did that was told by mitigation that they were working on resturcturing our loan bring it current and place the late payments at the end of the loan.  Relief at last!  Well not so much before my next payment was due we got a notice of intent to forclose. I called and of course they had no record of any of the previous and that I had 2 options let the forclosure happen or do a deed in leiu of.  I of course chose the deed in leiu of given my options they sent out the paper work which happened to arrive about a week after the sherrif showed up to my door to give me my forclosure notice, imagine that.  At a point where there was nothing else to do, I accepted the fact this was going to happen licked my wounds and we stayed in the house until it sold at auction. I would recommend that to anyone going through forclouser. Stay there until the house sells at auction. Don't wait until evicted because that is just another black mark on credit but stay dont make anymore payments to them while your there it is not going to help your situation instead save up your money for when you have to move. I have been looking for someone to file for years against Homecomings. They denied my very first payment because it was sent to the wrong office (that they have a dozen of). Yet this address was on there closing papers. Then by the time it sat on someones desk for 2 months it was foreclosure time and I had no clue! Well then the fighting started and I Finally got someone on the phone to talk to, they said resubmit the check, so I did! After that set on a desk for awhile that was rejected because an online payment is void after ninety days, Thats 90. Now we get even more forclosure forms and to top that off they are reporting me late on my credit score this whole time and are slamming me with late charges, and will not help me. That was 2-1/2 years ago and I am still fighting with them to fix my credit and I have letters from them stating that I was not late but they refuse to stop reporting me! I hope this Wolf Popper is good and will file a suit against them.

Homecomings Financial & GMAC has sold our home without notifiying us. We have done several loan modifications with them and the lowest they would lower our payment was $3200. The loan would be an adjustable (we're already in an adjustable!) and our payments would increase every six months! Why would I sign away my life again for the same terrible loan?! So their representative told us if we would like to do another loan modification I would have to wait until the other loan modification was cancelled. So we receive a letter (the letter was produced and mailed Sept.29, 2009) Oct.2, 2009. The house was sold at an auction Oct.1, 2009. They intended for us to receive the letter after the home was sold. We didn't receive any letter saying the home was going to be sold on this date. We received a letter saying the loan modification is cancelled and default perceeding would continue and to please contact them. Again that letter was dated and mailed Sept. 29th from Waterloo, IA and the home was sold Oct. 1 without any notification! Now this new company (Marbury LLC) owns OUR home and wants to know if they offer us between $1000 to $3000 to move in 45 days will we accept it! Are you kidding! We need help!

Homecoming Financial representatives based on actions and/or lack of actions appear to have no intentions of assisting homeowners with loan modifications to assist in saving their homes. I started speaking to them prior to becoming deliquent, and they stated they could not help me; give me information on my financial options unless I was 60 days past due. Once I was 60 days past due I attempted to get assistance. I was only able to get through to loss mitigation because a friend found the "magic" 7 digit extension number required to get past the recorded messages. You must have a 7 digit #. Homecomings never provides the 7 digit # in their mailings, yet they say in their letters to call Loss Mitigation. They give you the 800 #, but alas, when you call if you do not have the "magic" 7 digit # you can not get through. I have been told I qualify for a loan modification by their representative, yet I do not ever hear from them. When I have spoken to representatives over the past 5 months, they give me different information each time. I submitted paperwork requested by them for consideration of a loan modification 5 times!!!! They kept changing requirements of information they wanted. Recently I received notification that Homecomings is not responsible for my loan, but GMAC? What is the difference? Aren't they the same company? When I call the previous "magic" 7 digit # now to try to reach a representative- it informs me that this is an invalid extension. AGAIN, another tactic by Homecomings to not be available to assist you. They send you letters and leave voice messages on your answering machine asking you to contact them- making the appearance that they are doing everything possible to help you. I believe that they will argue that it is not their fault that WE do not contact them...BUT we do not have the "magic" 7 digit #! Currently I am unable to even inquire about whether they are still considering (ya right) providing me a loan modification or if the intend to continue with the foreclosure process....anyone else have similar stories???

My story and history with Homecomeings is quite lengthy, it goes back at least 8 years. I have literally had a breakdown over the scams this company has put me through, that was about 6 years ago, this time I am older, stronger and a bit wiser, so they are not going to drive me to that point in my life again. I was told 2 years ago that the company I worked for was going to relocate to Mexico, that alone was very stressfull, my time with the company ended in March 2009, knowing this was going to happen, In October of 2008 I put my home up for sale. The economy has hit my town very hard so my house did not sale and actually was appraised considerable lower than 2 years ago. Like I stated earlier Homecomeings has made my life as a home owner a nitemare, I have faced forclosure with them 2 times, and I paid all their bogus penalties they put on me and jumped all their hoops. Was forced to file chapter 13 to get them off my back for a while, but as soon as that was over they had more hurdles for me. The took out their own insurance polocy, saying I had no Home owners Ins. but I never lapsed on my Insurance. Like I said one rediculas plow to extort money from me after another. Now to the present time, now I am unemployed, my house wont sell yet, and Homecomeings took it upon the themselves to pay my back property taxes, in which I was makeing payments. Not only did they pay the back taxes they paid nearly 2 years in advance. They did not notify me or discuss anything with me, when I received my severance money I went in to pay my taxes, and they were paid, at the time I thought that was a blessing. So I did some research and found out Homecomeings had paid them, so I contacted them. I knew I of course would have to pay it but they told me at that my payment would go up about $45.00 a month, that was acceptable to me. However, within a week or two of that conversation, I received a letter stateing that I had a year to pay that back, and now my house payment has doubled. In true Homecomeings fashion, I can not talk to anyone that can help, all I get is the statement " well it's unfortunate but there is nothing we can do to help" they tell me that if I dont pay the full amount, they wont accept any payment. I tried to get them to accept my regular monthly payment, and additional money to apply towards taxes, but they have even changed my bills, it was set up that I could pay on pricipal and then pay on other amounts on separate lines, but that is not an option at all, the woman I talked to yeasterday said pay full amount or they wont accept any payment, and will beginn forclosure Again. If there is anyone who can help stop these financial preditors, please! I have cried and felt sorry for myself long enough, I am ready to fight! G.H. in Ohio

Since Febuary 08' I have been nogotiating with Homecomings. I am currantly on my fourth modification and still have no results! The first ended in lost paper work. The second ended with a late posting of a payment. The third started with a certain payment and ended when they raised a payment without a reason. Now the fourth is payment figured by the Lord Obama plan. The first three mods all ended without an error by me. I sent all the payments on time, with reciepts. All the mods have ended with errors by Homecomings. Come on, can anyone help.... All that I ask is fairness. Unfortunately now that my credit is shot I can't seek different companies. Homecomings is the worst company that I have ever dealt with. So YES, any lawsuit against Homecomings is well worth my time. Please contact me with info...

LONG STORY SHORT...I HAVE ALL MY PAPER WORK, SHOWING MY MODIFICATION (NOV 08), THEY SAID I DIDNT MAKE PAYMENTS, AND PUT ME IN FORECLOSURE (JAN 09), THEY EVEN SENT MY PAYMENT BACK DURING THIS TIME. AFTER NUMBEROUS CALLS TO THEM (I HAVE ALL THE NAMES), THEY FINALLY TOOK IT OUT OF FORECLOSURE (ONE PERSON ADMITTED THE MISTAKE) BUT THEY HAVE ME LISTED AS FORECLOSURE ON MY CREDIT REPORT, THERE RESPONSE WAS "OH WELL" WERE NOT CHANGING IT. My husband and I are interested in this Class Action Lawsuit. We have had Homecomings as our mortgage lender for the last several years, and have never made a late payment to them. In the past two months, my job has transferred from Ohio to Houston, Texas and we have relocated. I called Homecomings immediately and let them know and told them the house was listed with a realtor, and we would be looking at a short sale, due to the current home market, and the fact that the property value was significantly less than what I had bought it for 6 years ago. This is a 4-bedroom, 4-bath home in a very nice area. We stopped making payments in April because of two mortgage payments. I have been contacting Homecomings frequently to keep them in the loop of what progress was being made in the sale of the house. In April, prior to leaving, there was a hail storm, and State Farm issued us a check for $22,000 to replace the roof and vinyl siding. This check was made out (by State Farm's policy) to both us and Homecomings, as the investor. This entire check is going to the home improvement company. We are keeping no monies. Homecomings told my husband and I to endorse the check, send it to them, and they would deposit it into their account, and then they would send an inspector out to ensure the work was done satisfactorily, and upon that time, the check would be reissued to us and our Home Improvement Company, which we had no problem with. This job was completed almost two months ago, and the inspector (their own employee) sent his report into Homecomings a month ago, and we still have no check. We have called daily and have been lied to repeatedly. They stated this past Friday that it would be overnighted for Monday delivery, and I called this morning, and it has not even been issued! On top of this, we have been completely helpful in getting this house sold for our interest and theirs - as of last Thursday, an offer was accepted on the house by our husband and I through our realtor. Per Homecomings policy, I sent over the sales contract, along with our realtor and attorney's names, and about 30 pages I had to complete from Homecomings for a short sale. I called to ensure they received it. We have kept this house immaculate and it has a new furnace, siding and roof! So, now the ball is in their court as to whether they will accept this offer, OR let us go into foreclosure after having paid over $100k in interest on this home, and never until in the past 60 days out of 6 years - not ever making a late payment to them! They are stealing the home improvement companies money and lying. We will see what happens with the house - I have no faith it will go how it should. Ok, long story short, i have also had nothing but horrible experiences with Homecomings and am at risk of losing my home! They sent me a "proposal" for a loan modification that has my payments going up $ 400.00!!!! How does that help???? Also, my escrow account has ALWAYS come up short somehow although taxes and insurance have not gone up! My payments have crept up consistently since I have had the loan, and of ocurse, I am no loan expert so i can not for the life of me figure out why! I am willing to join any lawsuit, go to ANY length to stop them from continuing to screw people out of their homes while they profit enormously! Anyone with any suggestions, info., anything please feel free to contact. I am desperate to get out of this loan and save my home!!

I am an attorney and Homecomings has just blatantly spent 3 months telling my client that she would get a modification and then posted a notice on her door. I don't do this kind of litigation so if there is a class action looking for additional defendants then let me know and I will forward your info to her.

In Nov 08 we notified Homecomings of our concern that our income was dropping 25K at the first of the year and our payment was becoming later and later each month. We were on the phone for 1 1/2 hours shifted to 5 diiferent loan service agents who ultimately told us until we were over 30 days late they could not look into a loan modification for us. Dec we become 30 days late and provide proof of loss of income and request 2 months forgiveness placed on the back of the loan and fix out interest rate. No response from lendor only late notices! We pay Decembers Feb 12th and send over a loan worksheet for them to review beginning of March...again we do not hear a thing other that a lady showing up at our door inspecting the premises and left us a note to cal Homecomings. When we call no one addresses the loan modification worksheet and when we reference to it "oh we are unable to help, are you going to short sale?" We attempt to pay another payment in March with additional, which gets credited back to my bank account last week as refused. Apparently they have started the foreclosure process without even trying to help us. We have been at our jobs 15 years each, we had excellent credit until they told us they could not help us until we were later than 30 days and we have already paid $142,000.00 in interest to them just in the last 5 years! We are so frustrated and feel that this company is only out to make money and screw the consumer. I would like to join any class action lawsuit which would be willing to represent this situation!

I too am having a horrible experience with Homecomings Financial. I originally called them in Sept. 2008 to report that I was having financial difficulties and would not be able to make the next month's payment. I was told there was nothing I could do until I was actually late on a payment. Subsequently I was late on that months payment and attempted to contact loss mitigation to try and work something out. The property had been listed for over a year yet because of the downturn in the market I hadn't even had a showing. This is a waterview investment condominium. All calls despite whatever phone numbers for different departments you may have been given, seem to be routed through collections. I have been treated extremely rudely by these people and threatened routinely with foreclosure if I don't send in at least one payment. They keep assuring me that one payment will give me another month to try and work something out with loss mitigation. Finally reaching loss mitigation I was told to fill out the financial package they would send me and return two years of tax returns, bank statement, letter of hardship etc. I faxed this to them 6 times with many phone calls in between and whomever I talked to saying they had not received it and it was not in my file. I called them every day and ended each call in tears, not believing that I couldn't even get someone to listen. They refuse to give you last names or customer service ID #'s. Eventually the only option I had was to pursue deed in lieu of foreclosure. I was told that the person I needed to speak with who covered the state of NH was Keisha Thompson. They would not give me her phone number but said she would contact me. I was finally (2 weeks later) contacted by Ms. Thompson who said she did not have my financial information and could I fax it again!!! I asked for a phone number to reach her at in the future and was told she would call me. She finally called me back about a week later and told me she had received the information and that she would send out someone to do an appraisal on the property which would take 2-3 weeks. 4 weeks later she called and said she had received the appraisal and would now have to do a title search to see if there were any other liens on the property. (There weren't) I waited another 3 weeks and in the meantime was bullied by the collection department for another payment. I told them I was working on deed in lieu but they said it didn't matter, once I was 3 months behind I would automatically be sent to foreclosure and it didn't matter whether I was working with anyone on deed in lieu once it was sent to the foreclosure department the process would begin. I again waited and two weeks later again was left a voicemail from Keisha Thompson stating that there were no other liens, but now she had to send it to my private mortgage insurance company and that they could make me sign a promissary note for their portion of the mortgage. She has now said she would get back to me when she hears back from them. In the meantime I have begun receiving letters from the credit card companies with which I have done business with for many years with spotless credit. These credit card companies are automatically reducing my line of credit. Obviously the collection department was lying when they said if I made another payment my credit would not be affected. I can't even begin to say what this has done to me. The frustration of daily phone calls, lack of advice, inability to reach either departments or people, lack of return phone calls, multiple duplicate faxes have left me feeling angry and betrayed by a supposedly professional company. I am still playing the waiting game with Keisha Thompson and still have no way to contact her. Since they have obviously reported this to the credit bureau despite their assurances otherwise it is now impacting me across the board. When I began this in September I tried with my best intentions to inform them I would be unable to make a payment and to try to work something out. I am a professional and expected the same from Homecomings Financial. I am left in the middle of a nightmare with nowhere to turn and apalled that there exists such a company as this.

First let me say,Im truely feel for what your going thru right now. I,myself went thru the same heartache,headache 6 years ago with them. We however,lost our home.... We lost our home,not for NOT making our payments...not for even being late...but for changing our due date...Thats right,for changing our due date! My husband called,and changed our due date...all was said and done,agreed and sealed...we were to start the NEXT month...very long story,but they did not change it in the system. Sounds hokie,doesnt it? It did to us too...however,we were in mist of purcashing a new house,and HAD NO IDEA WE WERE EVEN IN FORCLOSURE...we found out thru our realitor,whos receptionist called homecomings for a payoff quote! Told her if we didnt pay that months mortage within 4 days the house was going to auction. The receptionist asked for a payoff...they wanted to seal the deal with homecomings before the deadline. Do you know those rat bastards told her "oh,let me transfer you to who you need to talk to for that info"...always a voicemail...she called several times a day,to get the same blow off...anyways,we lost the house..funny though,they returned her call THE DAY AFTER THEY AUCTIONED OUR HOUSE! CONVIENT. Well,our realior urged us to file with the higher up who governs mortages....we even sent our realitors cell phone bill as proof that she was trying to obtain the payoff quote prior to auction...there was a total of 87 calls made to them in a 4 das period...87! We sent proof of every single payment we ever made,and a written letter explaining in detail,name included of how the due date was to change,etc...for 5 months we waited to hear back. If they saw it was inour favor,they would either A)return the home b) if it was sold,they would owe us monies,and foreclosure erased... We checked daily on the status,we were told it was being personally investigated by the head investigator for this...Five months later we got letter,get this,saying simpley we didnt have enough proof! ARE THEY KIDDING ME?! We had it all! What more could we have given these people? We then were approached by Wolf and Pepper to get in on lawsuit,which we did..never heard anything back from them,we emailed constantly asking for status...we simply received an email from them later stating lawsuit was dropped..and this was over 3 years ago... I still want to fight for the wrongful foreclose...no attorney would touch our case unless we had a hefty equity..period. Im curious to know if Wolf and pepper are doing another lawsuit againest them,if so,why? When they never did anything with the prior one? Nor even offered to assist us when needed? We purchased a home just over a year ago with GMAC as the first mortgage and their sister company, Homecomings holding a large home equity line of credit for us. That was our security blanket, and we never would have purchased this home without this security blanket in place. Months after we closed and moved in, we received a letter from Homecomings saying that due to declining home values; they were shutting down any future draws on the home equity line. The letter said there was a clause in their contract that said if there was any change effecting the property, they had the right to do this. Of course, our business is down and our security blanket is gone. Now GMAC is threatening foreclosure since we cannot keep up with the payments until our business rebounds. I almost believe this was intentional fraud by Homecomings, and I wonder how many people they baite into purchasing a home with substantial equity in it.... only to then shut down their line of credit when times are tough.... forcing people into foreclosure. I would very much like to be a part of a class action suit against this company.

Hello, I'm also a victim of Homecomings. For the 4th time they have filed a false foreclosure on my home. My husband has file bankruptcy now 3 time ( ch 13 ) due to homecomings screw ups. They have repeatedly told me im in the rears with our mortgage payment causing us to scramble to make multiple payments, for them only months later to say that im in the rears again. I have spoken to my lawyer and haven't gotten any where. I just received a letter stating that my house will be on the auction block on December 17th 2008 . I have called homecomings and have been advised that I have been behind since march of 2008 but at the same time they continually take all my payments and cash my checks, and when brought up to them they say that we haven't received them. I send payments certified and have them signed to make sure they get there and a lot of times they get payments and they are not posted to my acct for weeks on end. If I have been in the rears then why hasn't it showed in my monthly mortgage statement ?? Their response is ???? that's what I get. I went through this last December only to have the lawyer that represents them in my area and my lawyer to say that I was behind and once I make a double payment im current. When presented the question how I can I be hind neither side really can prove it. So basically our house has in the hands of the incompetent homecomings financial. I have sent these reports to my lawyer and they know that there has been many complaints against homecomings but it seems as if no one wants to do anything against them. We all need to come together and get this company before they ruin more peoples lives and while we still have our homes.

I purchased my first home in august of 2005 or 2006. Due to the failing economy in michigan I lost my job and was unable to make a few of the the mortgage payment. Once i recieved finances to make my situation current, the first thing I did was make payments to homecoming financial. I was only 2 or 3 months behind. Since my monthly payment was only 550, once i had the money it was not hard to make the payment. I paid what I believed was the past due amount. I was later informed that my payment was short $100 and that my home had been place into foreclosure. When i tried to pay the money they refused my payments. I had to pay over $1000 in additional fees when the amount that I owed was not even that much rufused to let me pay what i actually owe. After paying over $1000 I was placed into some terrible repayment agreement that continued to raise my payment to an unaffordable amount. My payment doubled and at that point I could no longer afford the payment and they refused to allow me to make payments at my original loan amount. I am now in the coming days of my redemption period. I have not recieved any court documents from homecoming financial and just 3 days ago a man came to my home stating that he was from the mortgage company and the he was there to LOCK THE DOORS ON MY HOME!!! Another man also came by offering cash for the keys to my home. Fortunately we are moving already, but home can you show up to my home and kick me out without notice of eviction and refuse payments from a client that is clearly trying to save her home. What do you when the lender is just plain working against you! Myself, my partner and children hate to leave our home but homecoming has made it impossible. They have taken away our American dream without a care. I would love to be a part of any lawsuit against them, this is definitely a violation against all hard working consumers giving their hard earned money to a business that doesn't care.

In january 2008 I knew that I may be in trouble with the mortgage. This was due to circumstances I had no controll of. I called Homecoming to see if they would work with me and do a loan modification. I was litterally laughed at and was told that there was no way I could ever get that done. I waited three days and called back to speak with someone else and recieved the same response but not quite as harsh. It was at that point I started to ajust my thinking on my property, I would let it foreclose.

They set me up on this loan modification plan - pay certain amount for two months, by certain date, then modification will be done. I followed all instructions, met my obligations, and now they are trying to forclose on my home. I have a problem with this. Can someone help who knows about this company.

I actually sold my house and was never notified about a forecloser. WE HAVE LOST OUR HOME TO HOMECOMINGS FINANCIAL AFTER 17 YEARS, WE HAD NO PROBLEM WITH OUR MORTGAGE UNTIL IT WAS TRANSFERRED TO HOMECOMING FINANCIAL, SINCE THEN WE HAVE HAD SO MANY PROBLEMS. THEY KEPT ADDING ON ADDITIONAL HOMEOWNERS INSURANCE, THEN I WOULD HAVE TO HAVE OUR INSURANCE AGENT FAX THE INFORMATION TO THEM ONCE AGAIN. WE FILED A CHAPTER 13 TRYING TO SAVE OUR HOME, AND AFTER 5 YEARS AND EVERYTHING WAS PAID FOR, THEY WERE AT IT AGAIN. HOMECOMINGS KEPT SAYING THE TRUSTEE DID NOT MAKE ALL THE PAYMENTS, AND WE STILL OWED THEM 5,000 DOLLARS. I CALLED THE TRUSTEE AND HE SAID EVERYTHING WAS PAID FOR EXACTLY LIKE EVERYTHING WAS STATED AND THEY WERE GOING AGAINST THE FEDERAL COURTS. SO HOMECOMINGS WAS GOING TO DO AN AUDIT, IN THE MEANTIME MY PAYMENT WENT UP $300. AND MY HUSBAND AND I WERE TRYING TO RAISE OUR LITTLE BOY, DOING WITHOUT ANY EXTRAS TRYING TO KEEP UP WITH THE PAYMENTS. I CALLED THEM ALL THE TIME ABOUT THE AUDIT, AND THEY WOULD SAY THE SUPERVISOR IS BUSY, OR GONE, OR WILL CALL ME BACK ETC... WHICH I NEVER HAD ANY PHONE CALL AT ALL FROM THESE PEOPLE. I have a home loan with Homecomings. This past spring I fell behind on my payments. They said I can qualify for a loan modification program. They rewrote my loan and put my back payments (payments I didn't make), taxes, and late charges all back into the original loan and rewrote the loan. That was fine. So come August I get my statement and it shows that I still owe the $800 of late fees. WRONG! I paid this when they rewrote my loan. Ok, come September I get my statement and it shows $800 of late fees. So, I called them. I was on the phone for 45 minutes. I was transfered a total of 6 times, talking to 6 different people. No one knew what I was talking about, they kept passing the buck to the next operator. Each person I talked to I could barely hear or understand. TERRIBLE and FRUSTRATING! I got so mad I hung up. So nothing is solved as of now. My next step I will make paper copies of all the paper work showing my problem and will send it to them. Maybe that will help. Who knows! All I can say is I hope someday I can get my mortgage out of this company...it has been nothing but a headache dealing with them!!!!!!!!!

I would like to be part of the class action suit against Homecoming's Financial. I have had nothing but trouble with them since the beginning. They have already tried to foreclose on me once but could not because I made payments via Wells Fargo and we had a three way conversation. I was making the payments on time which Wells Fargo could confirm but Homecomings Financial had changed my account number without any notification. Luckily, I keep everything and could prove the original account number given to me. Now, they are trying to force me to pay for insurance and include it in my payments which I already have insurance on the home that is current. They are saying it does not carry enough Hazard insurance on the property. I am currently looking to refinace with someone else before they ruin my credit. So yes, I am definitely interested in bringing this horrendous company to its knees.

My second mortgage was sold to Homecomings Financial without my knowledge or approval. Now each month I owe more than the previous month after payment was made. The payment amount increases as does the total amount owed. I have tried repeatedly to refinance the second mortgage but no bank will work with me on this. I would appreciate any suggestions or help I can get reguarding this matter. I don't know if what Homecomings Financial does is legal or not. What I do know is that it is unethical and should be illeagal and needs to be stopped.

My husband and I refinanced our home about 2 years ago. As we are signing all the docs with the Notary Public we noticed some discrepancies. We had agreed to a 30 year fixed conventional. Most pages of the docs said this but one page mentioned interest only. The notary said it was probably a clerical error and called our mortgage guy. He said it was an error and that he would replace that page with the correct one and would send it out to us the next day. The next day came and went, and here we are 2 years later with an interest only loan. Oh yes, and one day on their website while logging in to make a payment, I saw that they changed the loan again to an ARM!!!! They just changed it!!! I have called them several times about this and they basically blow me off. How can a company get away with this? The list of victims of this company is endless. If there is a class action law suit I want on board. Please let me know what I can do.

I am currently in the process of being "swindled" by Homecomings Financial. To make a long story short, we had been put into a repayment plan by Homecomings to help us get current on our mortgage and pay off any and all fees that may have been incurred on our account. We finished the repayment an now, a couple months later, they have filed for foreclosure proceedings. Every time we speak with a representative they tell us that everything is fine and they do see where we've come through on our end, not to worry, they don't know where the fees are originating from, etc. Then we are put on hold and transferred to another person where the whole process of questions and bogus answers starts all over again. We have spent hours on the phone being transferred from person to person and then being 'magically' disconnected, only to have to start over yet again. I don't know what to do or who to talk to. How can these people purposefully and maliciously scam our houses away from us? I would like to know if this class action suit is still happening and what law firm in NY is handling it. Any help or suggestions would be appreciated. Thanks,

I have been dealing with this company for almost 2 years now. I found out that then never paid my real estate taxes out of my escrow and then penalized my account for the late charges and then increased my monthly payment by $200. I requested that my escrow account be terminated and that I just pay P & I on my loan. They agreed and I paid P & I for 4 months. They then terminated that agreement. We then entered an agreement for a repayment plan and made our first payment as agreed and 2 weeks after that cleared, they then called us and told us that this plan had been terminated. There have been several other agreements we entered with this company which they conveniently terminate even though the consumer is upholding their end of the agreement. It left us no other option but to put the house up for sale last year. It never sold. We tried by owner and through a realtor and could not sell. It will be forclosed on, on July 10, 2008. Their business practices leave alot to be desired and I want action taken against them. I want immediate correction on my credit credit report, removing any derogatories regarding our mortgage with either Bank One, Homecomings, etal. Please HELP!!!

It is too late for me - it is a matter of weeks before I get the final notice that I have to be out of my house. This has been the most gut wrenching, painful and humiliating situation that I have ever had to deal with. Homecoming Financial not only took my home - but they took my dignity along with it. A single mother who has to break it to her children, why we have to leave their home. When they (if they) reach out to you - to tell you they want to "work with you", DO NOT sit around and actually wait for them to do just that. That is a tactic to buy them a little time and lower your defense so they can step up the foreclosure. Anyone who can - REFINANCE NOW before it is too late for you. For what's left of my sanity, I have to believe that some day in some way - those of us that lost everything we worked so hard for..might be made whole again. I don't know what I will do if I let go of that thread of hope.

WE ARE VICTIMS OF ALL OF THE UNLAWFUL PRACTICES OF HOMECOMINGS FINANCIAL. Such as force-placing hazard insurance, that is, purchasing insurance for the borrower's property and charging the borrower for it. Ridiculous fess such as "Corp Adv 3 Drm" had to be transfered to 3 different reps to get an explanantion for this one, their response: "this is a fee for an advance" rep explained that if acc is default, an appraiser is sent out to appraise property. We were hit with this fee quite a number of times. NO NOTIFICATION WAS SENT TO US REGARDING THESE "APPRAISALS". Monies are not being applied towards principal/interest balances instead applied elswhere, "made up fees/charges" therefore putting the account into "default" status. TO THIS DAY, AFTER SPENDING HOURS ON THE PHONE MONTH AFTER MONTH THEY ARE STILL STRINGING US ALONG. ANY HELP YOU CAN OFFER US WOULD BE APPRECIATED.

i am read your comments and i am so sorry that they are treating your family this way. i know first hand how scary it is the situation that you and your wife are in. i lost my job 5 months after i bought my home and i was a single mom at the time and of course i could not pay my bills and everything including my mortgage was behind. so what does a mom do but reach out for help from the aid that our government offers. i also and this is something you may want to look into, went beyond goverment help but was refered by social service. went to a company that was started 2.5 yrs ago when all these arm mortgages started adjusting and people started getting in trouble. i am not sure what you would look under to find it in your area but they specialize in loan modification for mortgages in trouble.it was started in our community because we are a textile community and one of the biggest companies in our area closed down and they were trained to help people who had lost their jobs and in trouble with their mortgages. AND LET ME TELL YOU THESE LADIES HAVE BEEN A BLESSING TO ME AND LOTS LIKE ME...... an i know you said that they said that you do not qualify but that is LIE you do qualify everyone that has a arm mortgage no matter what their income qualifies. this is something that the government put in place in first of the year to help us. contact your local social services and they maybe able to direct you in the right direction. i am sorry i can not tell who yours is.....or you and your wife could contact your representative that is something that i am getting ready to do... it cant hurt and i know from experience that they are really good about getting back to you. he or she needs to know that it is happening in their back yard and maybe they will have a solution for you. now to my situation,when Prosperity got me back on track with my mortgage and i got back to work everything was moving along great(lot of bad credit) but i still have my home. July 2007 my mortgage rate adjusted from 4.75 to 10.2 my payment went from $477 to $677 a month and of course we got behind and i went right back to that same company that helped me when i was out of work. she got in touch with homecoming dept called load modifications and he told her and i quote word for word "IF SHE CAN NOT PAY HERE MORTGAGE THEN SHE NEEDS TO GET A SECOND JOB". maybe i am carzy but a person should not have to work two jobs and my husbnds income to pay my mortgage. that is what this society has come to we care more about people in other countries than we do our own citizens...that is a different topic....now remember Prosperity is a christian based company... after he told her i needed to get a scecond job that made her really angry. she sent us home and she continued working on it and a week later we received in the mail from Homecomings Financial paperwork for a loan modification..and be very very very careful because as we fund out they will word it so you do not meet all the demands to qualify and without you knowing this maybe what caused you not to qualify. in the stips we had to make 2 payments at a certain amount and the next month we would not need to make a payment that we would receive our modification paperwork in the mail. well after the 2 payment was made by money order i called and made sure that they did receive my payment and to find out what the next step was. and the lady on the other end proceeded to tell me that you have not met all the qualifications and of course i am like huh! she told me that we had 1 more payment due the next month. what i am getting to is if i had not called we would not have had no idea because in the agreement they gave us the dates and the amounts they we had to send to them. after the last payment we received our modification info and we were suppose to show no late payments and paid on time. well of course NO we pulled the credit report and it showed having late payments since the rate adjusted. so we had to file a dispute to get them to take care of that... we are in the last month of our modifiction and having no luck getting refinanced because of my being out of work for 9 months and homecomings is not willing to set the rate back to its orginal rate and we do not know what to do next..... of course you have these companies that will loan us money at 12 or 14 % but that does not help.... if anyone has any ideas or advise PLEASE let us know.

I continue to struggle with Homecomings Financial. I have been trying to get my mortgage refinanced since November 11, 2007. I foolishly expected Homecomings Financial to "STEP UP" and assist me with the refinancing. I have excellent credit and have never missed a payment. They rejected my initial refinancing based on fradulent information. When I reported all of the problems to the head of the customer service department, Mr. Renzi, he referred my complaints to a woman who is the supervisor of the loan processors. She really wasn't much better at follow through than the rest of the people who work there. Although they had switched my loan documentation with a home owner in Kansas, they never sent me the envelope to return the documentation to the New Jersey office. I finally sent the paperwork back to him AT MY EXPENSE. I have lots of business background and I have owned several homes--THIS IS ABSOLUTELY THE WORST COMPANY I HAVE EVER WORKED WITH.

Who the heck are these people? I have debt collectors harassing me over a debt they claim was originally through HomeComings Financial. I've never even had a mortgage through them. The only mortgage I've ever had was only recently created and is still owned by the same mortgage lender as created it. I am having similar problems with Homecomings Financial. I am supposedly in a repayment plan which was originally set up for an 18 month increase in my monthly mortgage amount. It has been cancelled three times in less than a year never to be allowed to reach full maturity. All three times a letter was sent stating a mute reason for the cancellation of the plan and a large amount that was expected to be paid or the house would go into foreclosure. Numerous phone calls made to the company have found me bouncing around from one person to the next only to be mysteriously disconnected or on hold on and off for periods of time ranging from 45 minutes to 2 hours. Not one associate could explain why my statements never seemed current, why entire payments came up missing only to be "rediscovered" at a later time. And once we would be in contact with a particular person they seemed to take various vacations and couldn't be contacted or return voicemails from that point on. Can someone redirect me? Who do I have to contact in order for me to keep my house? Any help would be greatly appreciated. Thanks

In May 2007, I made a 2,012 dollar payment to Homecomings Financial. I paid by phone so the payment was taken directly from my bank account. Weeks later when I called Homecomings to make another payment they told me that I still owed the $2,012. So I called my bank to see if the money was taken out of my bank account and where it went, they told me that it indeed had been taken out by my Homecomings. My bank give me the record of where homecomings had taken our money out of my bank account and I faxed it twice to the company. Homecomings was extremely evasive when I called and all of the people that I spoke with directed my call to someone else. Finally after a couple of months of falling behind in my payments because the company won't allow me to make any payment untill the account is completely caught up. All of that being their fault. They put me into foreclosure. I finally talked to someone who said she had found the money and applied it to my account and the money was applied to my account. A couple of weeks later we were notified by Homecomings that our house was going back into foreclosure over the lost payments they said they found. But this time when our house was about to be foreclosed on we had to borrow money from family to pay $9,400 to get it out of foreclosure. $2012 of that amount we had already paid. Some of the amount we owed them but couldn't pay because they had us so behind,some of the amount was late charges piled on, and most of the amount was for their attorney fees. I have a wife and 3 kids, I work at a paper mill and we're barely getting by. We can't afford to pay thousands of dollars over faulty accounting practices. Please help me someone.

My success story is that if you look, GMAC will have probably done other things such as: Get you to sign a temporary repayment agreement which you cannot live with. Force this on you. DO NOT SIGN IT. If they changed the terms of your mortgage without your signature, they are in breach of contract. If they made false reports on your credit report, this is defamation. KEEP VERY GOOD NOTES OF TIMES, DATES AND PERSON YOU SPOKE WITH. BETTER YET RECORD YOUR TELEPHONE CONVERSATIONS ALL PERFECTLY LEGAL. I had success becasue I wrote to the Chairman Mike Rossi in Minneapolis at Rescap. To do this, you must keep your cool. You must make your points succinctly as to what the company has done incorrectly. He put me in touch with a senior person at Rescap Homecomings in Dallas. Trust me GMAC is in big trouble financaily and they do not want your house. They have already gone to their major shareholder and gotten a 3billion bailout . They might be the next Countrywide Bankruptcy. CONTACT YOUR ATTORNEY GENERALS OFFICE! One point of law to look at is if the company has violated deceptive trade laws. You must calucate your losses, and they must be real. Second, do they actually own your loan, or are they servicing it. They cannot foreclose if they do not. CHECK YOUR DEEDS! I feel that Homecomings cheated me. I waquoted a monthly payment that was adjusted up almost 700/month when a calculation mistake was found in the escrow impound....tax data from aprevious sale (1967) was used instead of the 2004 data relevant to current annual tax. I suspect this 'mistake' was a a way of convincing me to sign for the loan, thinking it was an affordable payement, then raise the payment, backed by the fact that I did, in fact, have 72 hours to find this miscalculation myself. Though this original sequence events was perpetuated by a broker called 'Direct lending' homecomings bought the loan, announced the 'mistake' and refused to even negotiate or acknowledge this situation. i am now only paying the original amount, falling behind and in danger of foreclosure because i cannot pay the new rate and would have never agreed to a loan at that rate.

We lost our home to Homecomings.. to make long story short. in 8-02 someone got into checking account. clean us out. mort. pmt. bounced. I called them set up arraignment. 1 1/2 in Sept. and same in Oct. I did this. sent 1 1/2 wester union in Sept. and 1 1/2 in Oct. check over phone. They sent me to foreclosure. Stated I never made payments. I sent wester union form to attorney (foreclosure). they concacted homecomings. they never picked it up. so in 11/02 they picked it up. but won't accept the Oct pmt. told us we had to pay 2262.00 by 11-26 to save house from foreclosure on 12=19. Once they picked up WU. chanced foreclosure date to 1-7-03... in the 2262.00 was only 1098.00 payments. rest was fees. for attorney, paperwork, and even a fee to have someone come and check to make sure we still lived there, once a week. I called on 11-25 to give them money , and was told that the person that made the arraignments was out on maternaty leave, and the fees were now 3295.00 and I had til 12-15 to pay it, but to include another monthly payment. so now new fees were 3812.99 ok, My mom died on 12-10-02 funeral was on 12-13-02. I contacted them on 12-17-02 to give them all the money. and was told that I had signed some contract with them to go ahead with the foreclosure. Supposely I signed them on 12-10-02. and they had copies. I contacted an attorney, he asked for copies of letter, and guess what, not my signuature.. We tried to refinance on 12-28, and was told we couldn't. because our house was already sold at the sheriff's sale. Even though we had the notice the sale wasn't suppose to be until 1-7. Well, needless to say, we lost a home we had lived in for 12 yrs, and only owed 82,000. Was worth 135,000. Get this, on credit reports, they reported we owed them only 2100.00 after foreclosure. Now 3 yrs later, we go to buy new home, and the new mortgage company get letter from them that I owe them *0*.... they know they took our home.. And made a profit... so any class action suit, put me in.......

I work for GMAC and I'd like to help anyone I can. If what you have stated here is true, and you feel wronged, please contact me to see if I can help. Because of the overwhelming posts on here, I am hesitant to include any contact information. However, I have set up a yahoo email address for you to send information to. I have registered on yahoo mail under gmachelp. You can email me there. In order to help you, I'll need at the very least your first and last name, and your city and state. But, the more information you provide, the better I can serve you. I have access to everyone's records. Please remember, I can read the notes that have been logged in throughout the history of the loan. If you are just ranting on here and aren't being completely honest, please do not send me an email. I have read many posts today, and have found several people saying that Homecomings "suddenly" foreclosed on their homes, only to find out in the notes of the file that the borrower actually contacted Homecomings to say they couldn't pay, and the notes would go on, back and forth, for months or even years, before foreclosure was started. If you're mad about your pre-payment penalty, look at your original documents first. If Homecomings bought your loan from another company, the ppp would have been through them, not Homecomings. When Homecomings purchased the loan, they also paid out of their pocket for the pre-payment penalty. If you do not pay it, Homecomings loses that money. You can't blame them for this. If you're mad about your interest rate, you need to go over your original documents. All terms stay the same as they were when you first got the loan with the other company. Homecomings does not just "change" the rate to amuse themselves. That is basically saying that Homecomings Financial set people up to fail on purpose so that they could foreclose on their home. Do you realize how silly that sounds? Is that what mortgage companies do? Help people get homes so that they can rip them away again? Then we have to pay for legal fees, improvements (if needed), and resale. We have to insure the property and pay taxes. What good does it do us to foreclose? If we keep people in the house, we make much more in the long run, and don't have the hassle of dealing with the actual property. If you're mad about not being able to refinance because you're hurting, remember... people assume that they can refinance whenever they want, but they fail to think that over the years things change. Credit scores go up and down, as do home prices. Income drops off, marriages fail, and kids grow up and have different needs. Having the ability to refinance in a few years does not guarantee it, it just means that if you keep your credit in good shape, your house stays in good shape, the housing market doesn't slump, and you don't lose your job, that we might be able to refinance you. You can hardly blame Homecomings if your credit/income/home value drops. Now, that being said, there are always issues when dealing with large corporations. That doesn't make it right, but with so many people in each segment of a company, it can be downright impossible to please everyone. I do agree that there can be servicing issues; I myself have dealt with a few. So, if you would like me to look into your complaint and see what I can do, let me know. If you just want to rail against a company that probably has nothing to do with your problem, then be my guest. Thank you.

I have never had to deal with such an AWFUL company. They are rude and will not worw with you. Our mortgage payment had gone up $1000 in 6 months and every time we call they say our account "will be reviewed." They have told us that 4 times. Never once have we gotten a call back from them. You never talk with the same person to get things ironed out. And I have been hanged up on once!! My interest rate is outrageous!! Thank you Joe E for your suggestions. I myself have thought about a class action suit. Class actions suits are great for justice but they are long and drawn out, with many plaintiffs all of which need to submit their testimony and agree, this ends up in a federal court due to the size of the claim. In the end, the lawyers win, the homeowners might get justice albeit a bit too late. Most will have lost their homes long ago( see Tuesday this week WSJ on chasing the trail of the mortgage /asset backed securities and Roger Rodriquez who is now living in a government assist home after losing his job and his house). w There are several sugggestions as to how to combat homecomimgs. 1. they make so many mistakes on your mortgage and the handling of your mortgage account that you can address this pretty quickly through an attorny that takes contingency cases in your town/ state. The list of state and federal violations is endless. Just keep records and within a short period of months, you will have them right where you want them. GMAC to stabilise the market, holds a moratorium on forclosures putting the bad debts on the back burner, stablising their cash flow, and stemming wirte offs both with its primary investors, as well as its balance sheet. This could be for as long as 90 days or more. It could also reduce its interest rates on its loan, as long as the mortgagee can service the debt. It can extend the loan terms. Most of these loan debts are under $10,000( avg house price guess times month in arrears( 3) There are a number of suggestions that this company and others could follow, not the least of which is changing their culture, and instead of axing its employees training them to to other jobs such as work outs with its mortgagees. I am fortunate becasue i am able to afford a lawyer, and so the result i will gain will be much swifter and in time to save my house. All of the complaining is educational, but it will do nothing at the end of the day to save your home., Keep records very good records as i have. it is not illegal to record telephone conversations for your own personal use( negotiations) later.

Count me in on the class action lawsuite. I am a 51year old 100% disabled american veteran. My dream was to have my own home. I agreed to a flexible rate plan, with the first 3 years being the same. After the first year, the mortgage payments went up 495.00, and I am on a fixed disabliltiy income. What Homecomings did is raise up the ESCROW, not the mortgage. However, they charged me almost 2,000.00 for taxes. Being a 100% DAV in Florida I only have to pay $75.00 per year in taxes. The tax office here even called Homecomings Financial regarding this. They would not reduce the tax stating before they can they need the hard copy of disablity and homestead proof. Thats not out until November, but the tax office said that most lenders will allow it as they know if you filed, you do have the correct paperwork. HOMECOMINGS WOULD NOT EVEN AFTER A CALL FROM THE TAX OFFICE. Then, I was sent an option for refinancing by Homecomings in the mail. I called and it was the first month I was late. Therefore, they told me I was NO LONGER ELIGIBLE. I called them asking what I can do. THEY SAID NOTHING. Now I am being forclosed on. I want to do a quick sale, but so far, it has taken them 5 days of my 20 day response period to foreclose. I have all the emails and dates. Yes, do I qualify, I would be happy to help rid the world of people who can shatter your dreams and make your life so miserable. I feel like I DID SOMETHING WRONG. Pam

Hello everyone......unfortuately my law firm informed me last month that the Class Action Suit filed in California had been dismissed.......I don't know why, can't understand it except that I do know that GMAC restructured Homecomings into a separate entity, so I figure that's why........ie. too much time, paperwork to refile against a whole NEW entity. Homecomings has updated it's servicing recently with a new computer system, so it is FINALLY possible to get people on the phone.....but, they still have problems with updated information, so be careful. We are in the process of losing home to Homecomings. They have raised the payment $300.00 in less then two years. They are now raising payment every 6 months. We are unable to make payments it has become to high cannot refinance becuase they forced us into BK to save the house once. We were unable to refinance so we had to walk away from it. Has anyone been charged a property fee? We could never get a straight answer as to exactly what that was. But $9 a month for 5 years !!!! that is over 50o, if they are colecting these fees form all thier customer they are making a gold mine on that alone. I would just love to see them go down and have to repay the billions they have ripped from thier customers.

I like all above have had hard and strenious dealings with Homecomings. Because of them and their ways of practice I had to go into Chapter 13 Bkr. They also failed to pay my insurance and tried to get their own. Luckily I had a wonderful lawyer who stopped that and got them to pay. I also recently found out that they failed to pay my property taxes. Both were to be escrowed. Imagine that! I think we all agree that we need some way to communicate better and to share info with one another. My suggestion is a message board. I am in the process now of finding one we can all communicate on and will find a way to get the info out. I am getting info together and looking as well to get involved in the class action lawsuit. If you are looking to get involved I would suggest doing a google search. i, Michael was also ripped off from this company. As a company in the business of customer service and helping people, it has failed! My rights were violated in this situation. My rights were violated according to the Laws of the Fair Debt Collection Act and the laws of the State of Colorado. (Unfair Debt Collection Process). I have tried to 1) sell my home, 2) make a reasonable payment arrangement or refinance with Homecoming, 3) try to refinance with other companies. Homecomings Financials has stopped me from any of these remedies, of which I had a legal right to do to save his home. Homecomings, in fact, on several occasions, has refused to provide payoff information when requested. Homecomings Financial is foreclosing because they think they can take my house away because hI had so much equity in it and profit considerably from the equity he worked hard for. I would like any information regarding any class action suit against Homecomings. They have misapplied payments, misrepresented themselves and their intentions, and destroyed our credit. I just found out today they have reported us 90 days late TWELVE TIMES! I have proof of every payment over the last several years and we have been 30 days late two times when my husband was out of work - but never ninety days - not even once! They are crooked and need to be stopped. I feel so helpless when talking to them and like I have no one to reach out to for advice. Any help would be priceless to me. Thanks.

We have also been scammed by Homecomings with a forced escrow being placed on our account after our taxes were already paid. No matter how much money we send them, our escrow account is also in the negative. We have payments always going into their so called "suspense account"! It seems that no matter what we pay, the account is always in the negative. I also sent an email to Wolf Popper in hopes of getting involved with a class action suit and we will do whatever we can to shut these crooks down.

I have dealt with Homecomings for 2 years and did not think I had any problems with the company until now. I am in the process of refinancing my home with another lender and discovered that my credit had been destroyed by Homecomings. I have never been late on ANY payments with ANY company. Upon reviewing my credit score for my refinance loan application, I noticed that my credit score was low with Equifax and points were deducted because I had multiple serious deliquencies. I ran a free credit report with Equifax and found that Homecomings reported that I was 120 days late with payments on 2 separate occasions. This info has been on my credit report for over 2 years which I have been unaware of it. This is causing problems for both my husband & I since were have a joint mortgage account with Homecomings. My husband & I both had perfect credit. Homecomings sent me a letter that I have not been late with any payments but the damage has already been done. I was just turned down for a car lease buy-out loan and was told that they had pulled my credit info from Equifax. I have never been turned down for anything. I need help!!!!!

I have been with Homecomings since December 2004. I had no problems with the company until early this year. I have an escrow account with Homecomings and due to some funny business; which I still do not understand, my escrow balance is now negative. In fact, my mortgage payments have been adjusted to account for this negative escrow balance. According to Homecomings and the adjusted payments, the negative balance will be paid up in about 7 years. Now back to the funny business .... During the first month of our payment adjustment, my husband and I talked to Homecomings on numerous occasions in order to gain a better understanding of why our escrow account went negative. Everytime we spoke with Homecomings we received a different answer along with different numbers, and let me add that the Homecoming representatives were not the friendliest or the most knowledgeable group of people to deal with. It was at this time that I realized that something was completely wrong. I strongly believe that Homecomings Financial needs to be investigated and possibly put out of business. I also support the need for a class action lawsuit against the company. Feel free to contact me in regards to any investigations or suits.

Help! I have done all I know to do to try to find out someone who can help. We need to get together and find an attorney that will help. I have a call into the attorney that handled Mr. Hammonds case in 2004, but he has not returned my call yet. We are being charged an inspection fee every month to see if we are still here. We have had same problems since Homecomings bought our mortgage in Nov 1999.. Have tried to foreclose on us four times. Even while we were in our chapter 13. They have lied to us and delayed us and even said we missed three payments in 05 which were payed and we also got the letter from Rosemary Love. Our mortgage started out at 45,000, 7years later the payoff is more than 50,000. We told them we were going to refinace with another company they have lied to them and delayed the refincing long enough to now say we are six payment late and are forclosing on us. They reported to credit companies that we were in bankruptcy 7 months after the bankruptcy was discharged. They need to be stopped soon...

I too have been a victim of this predatory lender. They posted my home on the net as a preforeclosure and I had no knowledge. I was never notified. I began to receive numerous amounts of notices in the mail and phone calls from companies wanting to save my home and I did not know why. I told a friend and she said that it sounded as if my house was in forclosure. She began to research for me and found that in deed it was listed to be sold in two weeks. Needless to say, they illegally foreclosed on us in less that a month. I am looking for a lawyer in the dallas area that is aware of Homecomings actions. If you know of one please let me know. I would also like to know more about this class action suit.

My parents are in their 70s. They refinanced with Homecomings. They needed to have their cash-out reduced. Homecomings did it all and told them that their monthly payments would be about $400 less than what they were currently paying. When the bill came it was only $200 less per month and then later, my folks found out that even though requested and promised, their house insurance and property taxes weren't included in this. They can't afford this! In my situation, they claimed I was late on a payment. I have been left on hold numerous amounts of time. I finally just paid the late payment. They put it in some other fund. Then I had to file bankruptcy. I was never once late on my 2nd mortgage (with Homecomings) yet I still had to pay $150 in bankruptcy fees, which I paid. And they stuck the fees in the extra fund with my late payment. This way, each month showed that I owed a late payment! I called them and finally got through to a real person who told me it was in a fund that they didn't know what to do with. Huh? After about a year they finally paid the lawyer fees and late payment. On my credit report now is my bankruptcy. Yes, it shows but the only negative remark made...the only one...is from Homecomings Financial and they weren't included in the bankruptcy whatsoever. I'm not trying to refinance with someone else and have been told that my load with Homecomings is dinging my credit as an equity line of credit. It is no such thing. It's a regular old 2nd mortgage with credit-card-type interest! I want to join a class action suit and so does my father. Please let us know what we need to do.

I also asked for help from the President of the US , seeing that Texas is his home state maybe he knows something we don't know and can offer help or advice. Please ask him as well. Hello everyone here. We would like to join in on this class action lawsuit as I will be contacting an attorney about them as well tomorrow. I would like everyone to know what Homecomings has done to us. Ok here it goes, we bought our house on 1/2/04 and the same day we bought and signed for our house it was immediately sold to Homecomings without us knowing about it. Then for 5 months we never got a letter stating where to make our payments, so therefore we kept mailing them to our original place of loan and they forwarded them onto Homecomings. Homecomings claims they never received them. So then in December our taxes were due and we just got our tax paperwork and the following week Homecomings paid for them. We do not have an escrow account with them so they should have never paid for them. Good god within 1 week of receiving our tax bill they paid for it. Can we say money hungry. Now in June we were trying to refinance with a different company and we found out Homecomings was reporting negativity on our reports so therefore we could not refinance. While trying to refinance they were getting mad at us and then they started to look at foreclosure. Well, while trying to refinance someone told us not to pay our mortgage as that would screw up the paperwork. 3 months later they sent a summons to us on the house stating that they were going to foreclose on our house. We contacted them for 3 weeks straight and they never replied back. The message they have is leave 1 message and we will contact you back in 24-48 hours. Well there still was never a phone call back to us. So we called again and again and again. Nothing has happened. Well we found out that supposedly we were $13,000.00 in the rears with them. We asked them how and they said you know "attorney fees, property inspection fees, late fees and much more." Well we sent them $6500.00 and they sent it back to us. We then sent it right back to them and that went on for about 2 weeks. Now they still have not cashed it and they said they will not cash it until we are caught up with them. Our original payments were $1200.00 now they want us to pay $1600.00. We can not afford that amount of an increase. That is unfair and unjustice. They also said they paid our taxes because they were late. How can they be late if you just receive your tax information. Another thing, Homecomings sent all of our paperwork to a different address in a different city and they said it was not their problem it is ours. There is more to this than what I just mentioned, but if I type anymore I might say something I should not say because I would then be speaking my mind in a bad way. Please have your attorney contact us and we will be willing to join in the fight against Homecomings. They are a bad mortgage company and they do need to be stopped. Also it is pretty sad when I can hear from other mortgage companines that Homecomings is the Worse place to have your mortgage with. Let's all fix this company once and for all.

We refinanced in December of 2003, and were sold to Homecomings. Since then we have recieved 3 bills from them, having no contact with them has caused payment problems which they told us that they would not go on our credit and it did. Then in November we became two payments behind, and knowing that we had the full amount in the mail, they called me and told us that if we didn't give them $1852 in three days that we would be forclosed on. Since then I have made regular payments but still am getting delinquincies on my credit and now they send me a letter stating that if I don't come up with $1255 by Febuary 3rd that they will forclose. Their customer service is absolutly rediculious they have cussed my wife out a number of times calling her a stupid lying B**ch, and other terrible things. We are trying to refi again just to get out from under neith them but unfortunately they have messed with our credit so bad that our payment would go up almost $200 a month. I need some serious help as to what to do with this company. I can't keep coming up with these extra payments just to keep our house. SOMEONE PLEASE HELP!!

I'm not in danger of losing my house to these knuckleheads,but knew they were shady from the start.I got an online equity loan that ended up with these guys.Somehow in the middle of the procedure my equity loan got turned into a revolving line of credit.I don't know how that slipped by me.The loan was supposed to be set up on a 15 year monthly payment deal.When I got my first statement and every one after that I was only being billed for the interest. I called them to ask why it wasn't set up like a normal equity loan with 1 payment split into principal and interest and they pretty much told me to shove it and figure out the payment for myself.I tried to dump the loan instantly after this but the other weasel company,Equifax denied me for too many inquieries and too much debt compared to income(BS).So I'm just buying my time until I can try to refinance again.Homecomings needs to be taught a lesson somehow , they stink. How did you get in touch with Rosemary. I have tried to no avail. It is next to impossible to get anyone to talk to you there. When you do they are nothing but rude. She says mail her but in most people's circumstances in is imperative that they talk to her immediately as in my case and I do not believe that is possible.

I just read the response of Ms. Love from Homecomings. She is the same person that my husbnad and I dealt with for months who at the end might as well told us, you wasted your time because we have your money and are not turning it loose. And then when we asked for a supervisor, we got a letter telling us to contact the Attorney General in our state. (Please see my postings in Sept/October of 2004) Tell all our friends and most of all, tell your lenders that you will not do business with Homecomings. We have already spoken to lenders who did deal with them and told our story. They were not impressed with the service and lack of understanding we received. Word of mouth does work !!!

I have a Chapter 7 bankruptcy that was finalized December 2003 and Homecomings still has me listed as an active account with no activity since August of 2000. Homecomings foreclosed on the property in quesstion and is still makign attempts to collect payment.

I have managed a post closing and servicing dept of a mortgage banking operation, and to find myself on the receiving end of illegal communication re: transfer of servicing was an exasperating experience. I know the laws regarding the handling of such. The "service" reps were indignant as were their supervisors. The servicing of my loan was transferred to HOmecomings, it was not my choice. People should have some say as to with which company they will do business. The same day that I received notification of transfer, I also received a threatening foreclosure letter from Homecomings. My payments were made to my prior loan servicer and apparently not transferred to Homecomings. My phone conversations to a rep and his supv. were met with apathy and the excuse that "these letters are computer generated and we cant control them". What a sorry excuse for lack of customer service. I would like to see some legislation passed giving the consumer the choice as to whom will service/ maintain a loan.

I have had similar problems with Homecomings. They continue to charge me for additional homeowners insurance when I have always secured and paid my own policy. They have been provided with insurance coverage information on several occasions. Homecomings misapplied my monthly mortgage payment to escrow and escrow shortage and then threatened foreclosure. They refuse to correct the error. They continue to charge late charges, when, in fact my payments have been in their office. When I attempt to contact Homecomings, I receive the automated system, get put on hold for a long period of time and have received no help whatsoever from this company.

I was thrilled to hear that a law firm was getting involved. PLEASE... I want to submit some information.. I did not lose my home to them but they were very "shady" in what they did at my closing. (My posting is from O'Fallon Missouri dated back in September/2004)
