My Husband and I bought our first home in Jan. 2006. We were financed through a different company. We made our first 2 payments to this company and then we received a letter stating that our loan had been sold to Homecoming financial. The letter stated that we would get a letter from Homecomings as to where to send our payments. We never got this letter.

I had to look them up on the internet to get their information. I called Homecomings at that time and asked them why they had not sent us a payment booklet(to this day we have yet to receive this)Never got a straight answer on that.

In July of 06 our AC unit on our house went out and our only option was to ask for an extension. They had informed us that one of our payments had bounced. I could not in a million years understand why. So I called my bank and found out that Homecomings had returned the payment.

So I got a statement from my bank saying that the funds were there(at the time the payment was made). i called Homecomings back and they said that they had to have 2100.00 to bring the account current. I said what? I said that is 2 payments. The next payment wasnt even due yet. I fought with them over several days to straighten it out. i made 3 payments back to back 1 on the 1st of the month another on the 15th and then another on the 1st again. This is what I was told to do. Thinking that everything is on the right track again..

A letter comes in the mail for forclosure. then our statement saying that we owe 2100.00 again. I called them again and they said that we owed 2 months worth of payments. i said there is no way we owe this amount. We were never behind even 15 days. i told them I would not pay it unless they can show it too me in writing. I wanted a payment history. nothing ever came. We never got another letter saying that we were behind. Im thinking all is well. we were not getting our monthly statements either. which I found odd.

In Febuary 07 we go to finance some funiture and are informed that we are 60 days past due on our mortgage. My husband is looking at me like why havent you been making payments..I said I have and I have the proof. So I call Homecomings and ask them what is going on. they said that we owed them 2 payments. i said no we only owed one payment which i paid. we even send in exta every month to go toward principal. they send me a work out package which i told them i didnt need. they said lets just do one to see what your options are. they asked the information over the phone and said we would here something in a few days. never got that call. but I knew that we didnt owe that money to them. i printed out copies of payments made to them and they said that that didnt mean anything to them. Im now afraid that they are wanting to take our home. we got this house to 40,000 less than what its worth because we rented it 2 years before we bought it. we were given a deal. i thinking that they know that this is an investment.

THEY WANT MY HOUSE...I have started looking into re-fi but since they have been reporting badly on our credit its hurting our chances of getting out. we want in on any class action please before its too late.

I have done this several times with this company to fix a clients credit, restore there lost points then refinanced them. The longest it has taken me with them is 6.5 weeks. Nothing bothers me more then this. Just so you know you can go to ftc.gov and file a formal complaint. RESPA section 6 states if you refinance or your loan is sold the borrower is to receive a 60 day grace period. the lender can not charge LATE FEES OR PENALTIES OR REPORT LATE PAYMENTS TO THE CREDIT BUREAU. THAT IS 3 - VIOLATIONS OF RESPA SECTION 6 YOU OLD LENDER IS ALSO IN VIOLATION OF RESPA SECTION 6 FOR REFUSING YOUR PAYMENTS AFTER SELLING YOUR LOAN OR TELLING YOU THEY WILL NOT EXCEPT ANY PAYMENTS FROM YOU. The old lender and the new lender must contact you in writing no less then 15 days before the first payment is do to the new lender if they failed to do this that is also a violation of respa. File your complaint at www.ftc.gov to get back all the penalties and late fees you were charged plus interest. While that is going on it takes a while. if you like call me at 619-204-2173 and I will glad to help you with your documents have the late payments permantly removed. god bless
