Jeremy Fouse, JL Fouse Auctions, JLFOUSE, sold me a office copier on ebay. It was advertised in his words as "A NICE WORKING COPYSTAR COPY MACHINE MODEL CS 2221. THIS UNIT WAS JUST PULLED FROM A WORKING PROFESSIONAL OFFICE THIS WEEK AND IS READY TO BE A GREAT ADDITION TO YOUR BUISNESS. THIS COPYSTAR MODEL HAS A LIST PRICE OF CLOSE TO $2500.00, IT HAS BEEN TESTED TO WORK WITH NO PROBLEMS. IT IS IN GREAT CONDITION. WE GAVE THIS ONE A 9.
He goes on to claim in is advertisment at eBay: THAT WE MUST ASK YOU TO ADD $65.00 FOR A HANDLING CHARGE, WHICH COVERS ALL THE WORK DONE BY A THIRD PARTY SHIPPING/WAREHOUSE COMPANY, WHERE THEY WRAP MOST THINGS WITH BUBBLE WRAP, THEN BUILD A BOX AROUND IT AND FINALLY SHRINK WRAP IT TIGHTLY AND BAND IT TO A CORRECTLY SIZED PALLET FIT FOR THE ITEM. THEY ALSO HAVE A FORKLIFT AND MEN TO HELP LOAD IF YOU WERE TO PICK UP AN ITEM PERSONALLY. THIS IS A PREDETERMINED COST BETWEEN US AND THE WAREHOUSE AND STILL APPLIES IF THE ITEM IS PICKED UP IN PERSON OR SHIPPED OUT; YOU STILL SAVE THE SHIPPING CHARGE IF YOU PICK IT UP.
Then he claims that he can arrange shipping on this item in his auction as such: We HAVE SHIPPED AN ITEM SIMILAR TO THIS WEIGHT TO COLORADO AT A COST OF $125.00.
Looking at the pictures that were listed on eBay it shows a copier that was A9 in working condition. As a result I bought it.
When we went to have it shipped his THIRD PARTY PACKER sent us an email that the shipping rates were as follows. WE ARE THE SHIPPERS FOR JLFOUSE. WE RECEIVED AN "ESTIMATED" QUOTE FROM YELLOW FREIGHT TO SHIP ITEM #5677255698 TO ZIP CODE 64058. THE QUOTE IS, $232.34 @ 370 LBS. THIS QUOTE IS FOR A BUSINESS. THERE WOULD BE AN ADDITIONAL FEE OF, $66.95, FOR RESIDENTIAL DELIVERY AND $95.00, IF A LIFT GATE IS NEEDED TO TAKE THE ITEM OFF OF THE TRUCK. this is over twice what was suggested durring the auction by him.
So I made the decession to send two of my men on a 430 mile round trip mission to pick up this coppier. When they arrived at GOLD AUCTION House located at 5506 N SENECA ST, WICHITA, KS 67204 phone (316)522-1446 our copier was packed perfect... the copier was wrapped several tiimes in buble wrap, then encased in several layers of cardboard, and strap banded on a good palet. the THIRD PARTY (which later turned out too be his employee) loaded the palet in our agents truck and after making paymnet away they left for Kansas City.
Upon arrival at our office, I was shocked to unwrap a copier that was not what we paid for.... it was a different copier than the one we bought and paid for. This copier he snet had broken panels, Was worn out, Filthy inside, had broken ground wires on the copier lid system, the automatic document feeder was broken and had loose screws falling out, there was no output paper tray, There were broken plastic parts floating around in the automatic paper duplexer it had 5 paper trays in stead of the 4 that I had bid on in the pictures... So knowing there was a mistake, we called Mr Fouse on at the following phone numbers 316-680-8070, his home, 316-409-4235 his cell, and his THIRD PARTY which is one of his offices 316-409-7944.
Finally we cought him and he said that this was thier mistake, that they had sold the one that was pictured pictured on eBay and that this was the same kind of copy machine, but since it was broken he would trade it out with a different type of copier, but that he needed to check it out first to insure it worked.
DAY TWO... He never called me back dispite several call to each number. Later in the evening I cought up with him and he said he was working on the replacement copier.
DAY THREE... He never called me back dispite several call to each number. Later in the evening I cought up with him, he told me that If I wanted to take the broken machine and pay to have it sent back to him at my cost he would refund me $117.50 but no more... so far, I have over $500 in this piece of crap. and I still have to pay to have it sent to the dump or recycler yet and storage while this works it self into the courts.
Mr Fouse went on to say that he was an attorney and that if I was to buy something at walmart and it was broken walmart would only refund my money not pay for his gas or time to do it. I explained that he shipped a different item, that this makes it FRAUD and thats a feloney offense... He went on to tell me to sue him since he was an attorney and that all he had to give me as $117.50 and "that I was #@#@ out of luck"
So I am done attempting to talk with Jeremy Fouse, I am retired, disabled and will not be taken advantage of...
After researching Gold Auction, Kansas Secretary of State
Business Entity Search reports there is no company DBA "GOLD AUCTION" and Kansas Secretary of State Business Entity Search reports that Fouse is not a Resident Agent Name So it would appear he is operationg in violation of the State of Kansas Tax and Licensing requirements.
As to his claims of being an attory: ------ does not list him as a attorney under his name DBA in Wichita KS.
I have filed complaints with eBay and have contacted the National Consumers League. Be advised "Con artists are not stupid," says Holly of the National Consumers League, Jermey Fouse of JLAUCTIONS is one smart Cookie but what he did to me still makes him a con artist. and I will make every attempt to keep the presure of the authorites on him and his lucrative and profitable financial scam at the expense of others..
I will be contacting the Attorney General Offices of Phill in Kansas and Jay of Missouri and filing claims against Mr Jeremy Fouse and his assistant Vinnie (the QUOTE THIRD PARTY" who participated in this switch and extortion fraud.
Additionally I am contacting the Jackson County Sheriff Office here in my region and the Wichita Ks and filling claims of criminal mischief and internet fraud and whatever else they suggest.
Furthermore, I am moving forward with completing charges with the "The Internet Crime Complaint Center" (IC3) this is a partnership between the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C).
Additionally I will be notiying the IRS that what I found in my research and if he is found guility I will be eligable to collect a bounty on any back taxes that were not paid by this organization. Perhaps this will help make up for the money that this individual has set me back.
Lets see if this one can get away with his apparent criminal activities.

I realize in the world of business these days, that there is no way to make everone happy, especially when selling the wide variety of used equipment that we sell. There is no way we can know everything about everything, but we do try our best, and when we make a mistake, we do try to make it right according to the law. I also realize that there are many people out there that try their best to take advantage of sellers in such a volatile world where everyone is scrutinized that is in business and is expected to take advantage of people. So we as sellers have to be watchful when we get a complaint and watch how the complaint is made. In this case, I was skeptical from the start, the SIR emailed me at least 50 times within the first 24 hours wanting to know when the item will be shipped out and how much shipping would be. Our items close on Sunday, so obviously we dont get to anyone until Monday. This person ended up picking it up in person. Then we get a call a few hours later with him stating there is a problem. I was not able to get the message until a few hours later due to an auction I was at. By the time I was able to get his messages, just a few hours later mind you, I was already being accused of ripping him off. When I did call him, I let him know I was busy when he called, so I was calling him back now. He named off many thing about the item that he was not happy with. And stated it did not work. Now, I know it did work, because we did actually use it to make copies, but that's beside the point. After listening to him, I offered to let him trade one out for another one that we just got in after I try it out. Again, I had an auction the next morning, so I was not able to get back with him until after 3:00. By then, he had called at lest 10 times and again accused us of misleading him. I explained AGAIN that I was busy in the morning with my business and was just getting to the copier. I could not get it to work myself, so I put one of my employees on it the next day, after trying all day, they could not figure it out. I finally spoke to the SIR again, and let him know that I could not trade him and that I would be happy to refund his money. At this time he said only if I just send him the money, and he was going to keep the machine. WHAT??? No one would do that, that throws up a Red Flag to me. I left it with that. I told him I would refund his money if he brought it back. And this is the next communication I received. Again, the offer still stands, I am offering a full refund of the winning bid and even the handling charge as per EBay rules and the Kansas Law.
