Back in February 2016 I requested clothing from a designer in Italy for a photo shoot. They agreed to send me the looks on their charge and I would return the looks using their shipping account. Some of the designers favorite looks were being held for a long time by a photographer named Joshua Haines in Chicago. They asked Joshua to send me the pieces to my location in LA. (It was his responsibility to return the pieces to Italy on his charge) He then waits until one day before my shoot to send the items, driving up the shipping charges (his responsibility) he then calls me from the shipping office and asks me if I will cover the charges. I told him I would ask my booker, (but asked isn't he responsible to return the items to wherever the designer asks? Including LA?) Reluctantly I forwarded an invoice to my booker (a notable magazine) and the standard pay time is 60 days. With no discussion nor response to the fact that he is responsible for the return, Joshua sends me an invoice. In the invoice the terms say due in 15 days. In speaking to a notable photographer Howard Huang NY, and Legal Advisor Stephen Peretta, without a written agreement, sending an invoice with terms after the fact, those terms which are not standard and null and void and I informed him of the magazine's policy. In keeping good standing, I allowed the invoice to pay Joshua to go through, even though returning these items for the designer was his responsibility. Soon after I began to receive threatening and harassing calls from Joshua, threatening to defame my name at a corporate level to the industry and take food and money off my plate because the magazine had missed his 15 day deadline, even though I explained their policy and further more, I don't believe that the return is our responsibility, plus he saved money shipping to LA instead of France. He became nasty and obnoxious, sent more threats and was very unprofessional so I called the magazine to get the status of my check so that he can leave me alone. Soon after I call him to get a W9 form requested by the magazine to pay him direct, but he doesn't pick up and says I have to speak to a lawyer. I spoke to the lawyer, she is in agreeable that we just want to settle and move on. Still no W9. I feel like I was scammed. I thought I would form a good relationship but instead got bullied into paying for something that was Joshua's responsibility. I had other expenses that now the magazine won't pay because Joshua took me over budget and refused to wait according to their terms. I'm a small independent company and these mistakes cause setbacks. I believe he should refund us the money because it was his responsibility according to the designer.

So Joshua was paid by the magazine, however when addressed regarding the expense he is responsible for I get no response. It's not worth going to court over, but now I'm left to do what he was supposed to. After all the harassment, racial emails behind the lawyers back, calling and lying to my clients, and forcing me into covering his delivery to me, I feel it is just that he pay for the return to the designer. He is a cyber-bully and hides behind a woman's skirt in which a reasonable person such as I only wished for a peaceable resolve. He owes me the price of this return. I have been robbed.

As the magazine is finalizing the invoice for the moneys allegedly due to Joshua, he is choosing to drag the the issue out by asking a corporate client to pay him by PayPal. Is he kidding??? This is a major international publication. They just bought our magazine out for 100s of thousands of dollars. They don't operate through a "Paypal". That's for small individuals who don't have enough money to maintain a bank account. For their records, the magazine requires a W9 which of course the simple minded kindergarten student level wimp refuses to release. I'm surprised this lawyer is entertaining this debacle for so long. Don't they get paid by the hour? I'd assume that she would want to close this as soon as possible. Especially for 136.00. I'm tired of it and want him to just go away. He is still yet to offer to pay for the return to Italy which is his responsibility. I want him to pay for it. And he refuses. I'll do anything for the designer because they are the best ever. I want what's right, but should this cry baby with nothing better to than harass people get away with this because I prefer to be at peace? This is my best option to get my point across. Unless someone can suggest a better approach. #makehimpayforitaly
