Complaint Review: Kara Burke (assistant To Attorney General) - Phoenix Arizona

I have been waiting since May 18, 2000, after being ordered by the judge to get with the State and Expedited Support Services to get a calculation of arrears owed from child support.

I have eight miscalculations from both offices with amounts from me owing my ex two hundred and fifty dollars to him owing me twenty-two thousand.

They collected the money from him yet they can't figure out how to calculate what is owed. Or at least that is what they say. I believe my ex has some connection downtown because all their mistakes are in his favor.

We divorced in 1983 he was ordered to pay two hundred a month child support. I went without the child support until taking him back to court in 1989 he owed fourteen thousand by that time.

I received a judgement that day in the amount of twelve thousand plus interest at the highest rate. They shorted me two thousand.

I didn't realize they couldn't be depended on to add correctly. He was ordered to pay the two hundred a month child support plus one hundred to go toward the arrears. For the next seven years he paid when he felt like it. In 1996 he was behind by six thousand five hundred so back to court I took him.

To my surprise we were sent to a little office upstairs with no judge and the state was there telephonically because I had the misfortune of having to go on welfare for eight months because I was sick and didn't have insurance.

My ex was asked why he fell behind again and he said he had just bought his foreman a new truck and he didn't want to ruin his good credit. He is self employed. He also didn't realize he had fallen behind. I received another judgement that day for the six thousand five hundred.

They calculated the amount correct. From now on whenever I filed contempt on him we ended up in the fake courtroom.

Okay I received one more judgement in 1999 for nine hundred sixty three dollars bringing the total amount of judgements to three. So you would figure it would be easy for them to calculate the total amount he owed with interest. Not exactly because Expedited Support calculates differently than the state.

Can you imagine? two places in the same building and they calculate differently. Expedited Support rewards the deadbeat when they don't pay on time. So does the Attorney Generals office but you won't get them to admit it.

An example would be like this:

My ex owes two hundred a month child support and say he misses three months then he pays four months of child support at once. Well they apply one payment towards the current month and all other go toward the interest earning judgement but they don't charge interest on the missed or late payments.

He was financially better off when he didn't pay on time. I was astounded at this and I kept writing letters to anyone who I could think of and they either ignored me or they out right lied to me saying this was the way it was done.

I called their bluff and kept objection to the calculations they sent me. In December we were back in court and we are always the last case of the day because our case is so complicated they tell me. I think its because they don't want anyone else to hear what they do.

Anyway we have to go upstairs first to report with the Attorney Generals Office. We are called into a little office in the back and this man comes in and he asks me just what am I objecting to and I say the way they calculated and I say I believe I am entitled to interest from day one of a missed payment and he says no the judge would of had to order it and I say the one time I did get to see a real judge he did he said twelve thousand plus interest and plus means in addition to I argue. The man says "what dictionary are you reading"? He gets up and the real Kara Burke comes in and she has a calculation of her own for me and its for less than Expedited Supports that I objected to and she later lies and says in the minute entry the state didn't have a calculation prepared that day, she basically blamed the whole thing on Expedited Support who just didn't happen to be there to defend themselves.

Okay she finally admits to me after almost three years of lying I am by law entitled to interest on missed and late payments from day one. I am elated let me tell you because if I hadn't called their bluff I would of ended up with ten thousand less. Its the law she says and her and my ex start arguing and its going on an hour and we were suppose to be in court an hour earlier so I stand up saying I'm tired of listening to them and I am going to the courtroom before its too late, they follow plus some other lady who never introduces herself.

Well my happiness was short lived because the judge (Lee) says in order for them to calculate the amount owed with interest from day one they have to do away with my judgements. I say I don't like that because until they are paid I am entitled to interest and nobody listens to me and we are told to meet back February 26, 2003 with the new calculation.

Kara Burke sent me a copy and yes they did away with the judgements. I told her I didn't want to do that and explained why because I have nothing to enforce and record on my ex now and I don't like the record showing all principal is paid and he only owes interest. Kara said that is how they are doing it and its up to the judge to decide.

I prepared my own calculation I was able to calculate using the judgements but Kara says they are not smart enough downtown to do that. I think they are up to something and will cheat me somehow next week. I know this has been long and believe me I have left out so much of the things they pulled on me. No one down there helped me with this case.

Like I said my ex is self employed he advertises in Phoenix Home and Garden. He owns all kinds of property and slowly over the past five years of this bullshit he has put his property in someone elses name or only in his wifes.

I can prove they are commiting fraud. The state never made him post security bond because hes self employed. They allowed him to give illegal reasons for falling behind. I never say his income tax returns because he always said he forgot to bring them to court and that was allowed. I asked for him to pay some medical bills I had and the judge said no. I have paid all medical and dental out of my own pocket without insurance for eighteen years because they wouldn't make him pay.

I asked the judge in December if he could pay the five thousand I paid the last three years to an attorney and the judge said,"Wheres your attorney now"? I said I couldn't afford him any longer and he said no he wouldn't make him pay. He was never turned into the credit bureaus, lost his business license or drivers license or his passport. I just want my money that is all and someone to be fair and not treat me like they do in court or any office down there.
