At the time of my furniture purchase on sept.4th at La-Z Boy Galleries they were closing their doors. I was given a verbal 10 day delivery time line. When that allotted time passed without any word from La-Z Boy, I contacted them and was told that I needed to wait an additional two weeks for my furniture.

Again, after the two weeks, I heard nothing from La-Z boy regarding my furniture. I contacted them again, and was given October 18th as my delivery date. October 18th came and no word again from La-Z boy.

I contacted them for the third time and was told they had no idea when I would be receiving my furniture. From my initial purchase date to October 25th, I had waited a total of 7 weeks and 2 days for my furniture. This was past the 4-6 week delivery stated on the La-Z boy contract that I signed.

After speaking to La-Z boy for the third time, they could not tell me when my furniture would arrive or give me a specified date when I could be expecting my furniture. They were very rude, unprofessional, and not willing to commit to their original agreement. They were also not willing to work with me and told me that "they had more important customers to work with."

I told the manager of La-Z Boy that I wanted a refund. He agreed with my request. Subsequent to this agreement, I called my credit card companies and told a Visa/Discover representative my situation. The customer representative then specified to me that it was best to dispute the furniture charges.

After speaking to the credit card company, I called La-Z-boy and talked to Scott, the store manager. I informed him on October 25, 2005 that I called my credit card companies and I disputed the charges. I told him to cancel the order since it has not come in yet. He agreed to cancel the order. After this phone call, I did not have any contact with La-Z Boy again.

On December 5, 2005 I was notified by Discover that La-Z Boy is disputing the charge back. I then contacted Bank of America. I received a copy of the letter sent by La-Z Boy to Discover on December 27, 2005 and Bank of America on January 7, 2006 in the mail.

This merchant has lied about the facts in the letters they sent to both Bank of America and Discover. The merchant dated their letter on November 18th, 2005 to Bank of America. They specify on point #4 that they have been storing the furniture for almost 6 weeks. That would put the date at October 7, 2005.

This means that from October 7, 2005 to October 26, 2005 they had the furniture in their possession and they refused to delivery it. I contacted them on October 18, 23, 25, and 26th. I was told they did not have the furniture and had no idea when it would be arriving. Furthermore, on a similar letter sent to Discover dated dec 5, La-Z Boy specifies on point 4 statement that they have been storing the furniture for almost 3 weeks. This statement is contradictory.

Since the recipt said NO Refunds, No Exchanges, No Returns, Discover has now taken back the charge back and I am now paying for a couch ($ 3,100.00 )that I still have not received and La-Z Boy has made no attempt in any way to deliver!! It is now January 16, 2006.

Bank Of America Visa is still in dispute but I am looking at the charge back to be back on my credit card soon. This is for a china hutch and dining room chair and table set ($3,000.00).

I went out and bought the same furniture at another furniture store because LA-Z Boy agreed to the refund, and it was all delivered in 3 days! Now I am paying $6,100.00 for furniture I don't HAVE, OR WANT!!!

LA-Z Boy Galleries went out of Business but they have a store in Oneonta, NY called Drogen's. Again La-Z Boy Galleries/ Drogens has made no contact with me in any way during this whole process. Even though they have been paid in full now by Discover and are disputing Visa.

This customer did sign a no return, no exchange agreement. She was refunded, and the case was settled.
