Dear Sir or Madam and To Whom It May Concern:

This letter is to formally inform you that you are not to contact persons that are listed on our paper work as personal references or neighbors. You are currently harassing them and using them as your personal messenger service disclosing to them the nature of your calls, which may be in violation of Federal and State laws, which they do not appreciate. You are also using them as skip trace tools outside the context for which they were originally intended. We assure you we have not relocated and any further correspondence with us is to be by mail. These people have asked you to stop contacting them and yet you continue to do so. We have verbally asked in the past that you not engage in this practice and you still insist on doing it.

You have a person/s in your company have left messages with the people on our reference list and in doing so have committed possible violations of the FDCPA and the FCRA. They place on their messages that are with the Repossession Department of your company. In effect they have disclosed information about the status of our account (ie credit information to persons without a legal business need for such information) and basically disclosed information about our account in possible violation of the FCRA and possible Third Party Disclosure under the provisions of the FDCPA and the CDCPA of Colorado. People you have contacted and they have left messages with on their voicemails have retained copies for our future use if needed.

At the request of all the persons on the list we are writing you to let you know they want you to cease contacting them. A copy of this letter and a complaint will be forwarded to the Colorado State Attorney Generals Office and the Federal Trade Commission if the practice is not ceased immediately. You may contact us by mail, as we have not moved if you have any further need to contact us.

According to the persons you have contacted you actions are at a point constituting phone harassment. They have informed us they have asked you to stop calling them.

We are currently in possession of a minimum of 14 pages of customer or prior customer personal written accounts describing a pattern of the above tactics, across the country. The dates are from various months and years showing a pattern of possible harassment and or possible third party disclosure.

Attached is a note from our ELDERLY neighbor. Olga called and asked her to have us call her. This lady is not even on our list of references. We told Olga just prior to this phone call that all future contacts are to be by mail and not to call anyone on the list or call us again. Your company was calling at 8:00 am in the morning and continually rang people's phones. You have done this to us in the past as well. Please note the carbon copies at the bottom of the page.

Attached is our complaint as we have identified it to Long Beach Acceptance Corp. Their main office is in Paramus New Jersey. This complaint was faxed to them on August 31, 2002 with confirmation pages to show they went through. We do not dispute we owe money to them but they are practicing possible deceptive and using possible illegal methods to collect it. They notify our neighbors and tell them they were references and we did not list them at all. They continue to harass and call our friends and family in even after they have been asked to stop, by the people they call and by us. They continue to call us when we have asked them to correspond by letter. We have asked them to stop calling "the references" as that is outside the intended purpose. They also disclose the status of our account with person/s who do not have a legal or business reason to have such knowledge. This is done when they leave their names and say they are with "the collections department" and we are calling about "their car payments" or they claim they are with "the repossession department" and so on. We are asking that the State Attorney Generals Office have Long Beach Acceptance stop such practices and take some sort of injunctive action against this lender so this does not happen to other persons. We at your request, will make available to you at least 14 pages of written accounts of Long Beach Acceptance Customers describing such practices by this lender. These customers are from around the country and not just Colorado. We believe these accounts to show a pattern of misconduct b the lender.


Long Beach Acceptance Turned Up The Harrassment Factor.

As we stated in our first report we asked them to stop calling our friends family and neighbors and harassing them. Not 10 minutes after that call they turned up the harassment factor.

They called a friend of mine and he told them to stop calling him and he hung up. He said they called him 4 more times in about 8 minutes and made the same assertions about our account. He is willing to file harrassment charges on them or sign a statement about what they have done.

They also have called another friend both morning and night to the point where he called and told me to take care of whatever it was. I told him they were not supposed to be calling him and he said he told them that and to stop. They called him again the very morning he told them to stop. He has told them on several occasions to not call him back and they still do.

My references were only willing to have there names used as long as they would not be harrassed. The paper work we filled out at Christopher Dodge World in Golden Co even calssified them as a reference.

We asked the salesman why we had to list these references and he said it was to make sure that we were who we said we were. We asked if they would ever be called or harassed. He said no so we filled out the paper work.

When they call our friends and family. The way they get them hacked off is by telling them they were used as a reference and then proceed with their tactics. The result is the person gets so hacked they either call and yell at you or they tell Long Beach whatever they want to hear.

Long Beach treats your references as if they actually owe you loans and turns up the screws.

We have faxed copies of our letter as stated before and will be filing online complaints with the FTC and colorado State Attorney Generals Office as well.
