Yes there is such thing as a cease and desist letter - look it up Steve - To the OP budhibbs.com will help you - This bottom feeder is on his list of the 10 most worthless collection agencies - and to Steve - go to bud hibbs site and click on marauder exposed - you will see my case and as you advertise that you are not an attorney - I think I will stick to my attorney's advice about the cease and desist since I have used them against NCO and other bottom feeder collection agencies who have tried to intimidate my deceased grandfather with unlimited phone calls and threats To the OP - Get good lawyer - If you were in Dallas I would recommend mine but I am sure there are lawyers in you are who specialize in suing debt collections as mine does - Good luck and let us know what happens Stacey

Cheryl, First of all, LBN are debt collectors and represent primarily junk debt buyers. They are true lowlife. These "investors" buy very old, usually uncollectable "debt" for less than a penny on the dollar. Then they hire lowlife bottomfeeders like LBN to collect by any means they can. NEVER speak to ANY debt collector on the phone. NEVER! This was the start of all problems. It is NEVER to your advantage to speak to any debt collector. At this point, you need a lawyer to get the judgement set aside. Do this right away!! As far as the other advice to send a "cease and desist" letter. It is too late for that. And FYI..There is no such thing as a "cease and desist" letter under the law in collections. The EXACT verbage straight from the FDCPA is a CEASE COMMUNICATIONS request. It is very important to use proper terminology in any legal proceeding. And, if your Mom is too old and/or not competent to handle her affairs, she should not be on her own to answer the phone. You might have to file a motion for a competency hearing to squash the judgement. Good luck.

I too have been a victim. This is such a shame to be bullying the elderly of our society. I recently had a court date with a case which they would not/ could not provide proof of the debt. I was worried sick. I'm a single mom of two children, low income and have no assets other than the roof over our head. I was told by several attorneys at legal aid (who called every friend and acquaintance that they could think of for advice) that the judge is supposedly there to protect my interests and will not garnish my salary. The worst case would be a lien against my home. I did as much paperwork (documented, certified and copied to the court) as I could possibly do, most of the information came from this site. The first step was to ask for proof of the debt, which they could not provide. But, if you have read most of these entries, you will see the steps listed repeatedly, so I won't list them again. Bottom line, I appeared in court on the hearing date, but they did not and the case was dismissed without prejudice, which means that they can sue again. Two weeks later, they did. So, I am going through the whole procedure again. They won't give up, but my main advice is to check the court dockets daily and make sure that they haven't slipped a court hearing date in there that you are unaware of. Not showing up gives them a win by default. This is what they thrive on. They file hundreds of these suits in Tulsa courts every week. I have checked the court site for their entries.
