Love, Beal & Nixon,LBN Suing for Confirmation Of Arbitration Award on old MBNA/Bank Of America account past SOL Oklahoma City Oklahoma
On 11/07 was issued a summons from LBN and NCO Portfolio Management for confirmation of arbitration award. Requested validation of debt plus signed agreements. Received from LBN, that is was a MBNA acct.
In the Answer that I filed, not only disputed the validity of the alleged debt, but stated that I checked with the State Attorney General's office and that the SOL had expired on this type of debt.
LBN sent a letter stating they were moving forward and set a hearing for 2/1/08. By checking this website and other research, I filed a Motion to Dismiss including OK statutes 12-3-95(2) Limitations of Actions, 14A-2-108(1)(2) revolving credit card acct as being an open end acct with a 3 year SOL, ----etc. Plus, I sent a copy of credit report specifing MBNA/BOA acct was closed in 2003 and was a credit card - revolving acct. LBN strickened (canceled) the hearing.
Here's the problem: The court sent a letter saying they automatically set up a hearing for my Motion to Dismiss. I contacted them and said I didn't want or request a hearing, and to cancel it. That my MOD was for the hearing set for 2/1/08 that was set by LBN and strickened.
In the mean time, LBN has filed a Plaintiff's response to Motion to Dismiss and Brief in support. Stating "MOD is not timely that is was after the answer". "That it is not for a collection of a revolving charge acct that its for confirmation of arbitration". "That SOL does not apply". "Defendant is not able to prevent the confirmation of Arbitration award, has failed to dispute within 90 days of award."
Help!!! Where do I go from here? What can I do?

If this is for an arbitration jmnt you need to look up National Arbitration Forum,
They have stopped disputing these credit type of Jmnts.
I used to work for LBN and for some reason I always thought the SOL's were 5 yrs.
I would advise that everyone dealing with ANY debt firm find out the facts about
NAt'l Arbitration and Arbitration Jmnts and take these keep these Atty's in court.
I read here on the net that NAF (NAt'l Arbtn Forum) was involved in a hedge fund
ring with several debt firms using funds obtained from persons paying their debts.
(be it illegally obtained or not).
I cant disclose the way LBN runs their business but I can provide general public info.
Also I dont know of ANY new good atty there ..NEVER SETTLE ALWAYS CHALLENGE.
Consumers have won their day in court, but you have to show up to win!

Shelly, the first thing you have to do is this; Google the words, THE SCORE BY RUDY STANKO and go to the amazon.com site and read the 'Reviews' that are there. This will give you the answer to the 'ROOT' of all the problems in our so-called 'Legal System' & Banking Industry in the USA and around the world. The problem here is that you have done some research, but not enough. You have entered the legal realm against attorneys who do this day in and day out for a living. You are working on a limited amount of research. You filed a Motion to Dismiss. Any motion is set for hearing in Oklahoma. They won't dismiss just because you filed a motion. They will dismiss because you had a hearing and won said hearing. At this point, you need an attorney.
