This company is a complete nuicance. Any help you could give this Grove, OK lady would be most appreciated. Thanking you in advance for your kindness in helping me with this matter.

Single Mom's have it tough enough without constant harrassment.

Mary Jo, I have been through this with LBN. I lived in MWC, OK. You MUST respond in writing to BOTH the court and the Plaintiff. BE CAREFUL. In any way acknowledging the debt will result in a judgement against you. Guaranteed. You simply acknowledge the summons and dispute the claim. Period. Send this by CERTIFIED MAIL, RETURN RECIEPT REQUESTED and be sure to put the certified# on the letter itself. This proves exactly WHAT you sent. Keep in mind that this response is NOT a court date. It is simply a response. If you admit to anything, they will quickly file for summary judgement, and then move for a wage garnishment. DISPUTE EVERYTHING.!! LBN are the definition of lowlife!

By looking at the date on your report you may be too late to follow the guidelines. There is a response date time limit on those reports, either 30 or 35 days from service, read the text. You should first send a certified letter to LBN asking them to verify the debt. There are sample letters on the internet with all of the legal garble included. You must copy the courts on this, I am assuming the Tulsa District. I have been through this too. LBN does not give up. The one thing that they are trying to do is to win by default, with no response from you or you not showing up on the hearing date, they automatically win a judgment by default. They hardly ever show up at these hearings. So you will get a short reprieve from their harassment. The verification letter should also ask them to stop calling and reporting to credit bureaus while this is in negotiations. You will gain tons of information by searching this site and typing in statue of limitations of debts and doing a search on different links. Even if you have not responded yet, you should do so asap. Not doing so is a sure loss for you. You can fight them,, we all should, they are scavengers and they file hundreds of these cases in the Tulsa courts each month. You should check the court site OSCN and make sure that you do not have a court date that you are not notified of. This letter does not come certified and can slip by you. Not showing up will award them the money, even if they are not there. This is what they are counting on. Good luck. Being a single mom is not an easy feat these days, financial hardship is certainly an issue, keep fighting them. Good luck.

don't know what to tell you (where's Tim when you need him?) I know from experience that most courts around here will not accept "going on vacation" as a legitimate reason for missing or postponing a court date. Seems you need to get the rebuttal filed pretty quickly. I would check around in your area for a lawyer who handles consumer credit matters. You could contact the National Association of Consumer Advocates, visit naca.net They claim to be able to help locate an attorney who specializes in these matters. Didn't you get any notices or phone calls from them before they approached the court. Seems to me that would have been the time to demand validation of the debt per the FDCPA. Also, check the statute of limitations for debt in your state. If the statute is expired that is a positive defense to this action and you need to attend and motion for dismissal because the SOL has expired. The court will NOT envoke SOL defense for you. YOU MUST do it, so please don't miss that court date!

It was a Zales Jewelry Store Credit card where wedding rings & 2 watches were purchased. The account & purchases were made in December 1998 or December 1999. I do not have a court date, they stated that I had 35 days to respond to the summons. I called my local county court clerk earlier & she said to file it within 30 days (perhaps another of their tactics) by stating incorrect response time in order to obtain a judgement. I am for 2 weeks on vacation very close to that 30 day time period, so a court clerk informed me to submit in writing a rebuttal to the court citing why I would be unable to attend any court date within a 30 - 35 day time frame. You don't say what the summons is about! I'll assume that they are a collection agency. Do NOT ignore it - they will go to court and get a default judgement against you if you do. You might contest the "service" because they gave it to a minor, but it turns into a real mess if you simply ignore it. More information from you would be helpful.

In order to give you some advice, we need some more information. First, what debt are they collecting, and how old is it? Second, what is your court date? Third, aside from the statute of limitations, do you have any reason whereby you do not owe the debt that they are claiming? If you can provide this info, we can go from there. Best regards!
