Love Beal & Nixon - Asset Acceptance debt over 3 years old Ripoff Oklahoma City Oklahoma
I received a letter from Love, Beal & Nixon stating my obligation with Asset Acceptance LLC has been placed with their law firm for collection. They say I have 30 days to respond and if I don't dispute within 30 days the debt is valid.
If there finding a debt it has to be over 5 years old at least. Is their trying to get money from me legal at this point?

They can still try to recover the debt as long as they want to. If something comes off your credit report, they can still try to get the money. You just don't have to pay it (depending on the situation)

They can try anything. five years is the statute, but you must cover your bases. You should respond with a letter requesting proof of the debt. Ask for original account numbers, amounts, fees, interest. search the internet for sample letters. Send the letter certified and keep the receipts. be assured that LBN will show up again in your future and the best way to fight them is to not admit to any debt, deny ownership unless proven. They won't give up easily, but with your documentation you will make it tougher for them and protect yourself at the same time. Remember, deny the debt until proven. Do not offer to pay a penny, any amount given to them will reactivate the statute of limitations and you will be starting all over again with the time limits on the debt.

I mailed Love, Beal & Nixon a letter (via certified mail) a day or two after I posted this report. That was in the end of July and I have not heard from them. Not one phone call or letter, nothing. I am getting ready to send a follow-up letter to this company. I did keep my receipts, copy of my initial debt dispute letter and a copy of their letter to send along with the follow-up letter. From reading situations on this site and the internet it is my understanding they have to file in my county. I keep checking (((redacted))) to see if there has been something filed against me that I don't know about - so far nothing. Let's hope after my follow-up letter that will be the end of them contacting me. Even if they do pursue I would like to thank all on this website for the helpful information. I tried to file this report but nothing came up the first time. Anyway, I keep getting calls from this company and also received a letter stating: "Your obligation with Asset Acceptance LLC has been placed with this law firm for collection. We encourage you to telephone us in order to discuss the above referenced account. We will assist you in making arrangements for payment. You will be treated with courtesy and respect while working with us. When you call, ask for the collection representative assigned to the account. The phone is 405-720-0466. Please refer to your file number when you call." Then it states something about NOTICE OF RIGHT TO DEBT VALIDATION. I believe this is from an old (like 7 years or so) Citibank credit card account. Is it within the law for them to try and collect at this time? Does anyone have any idea what I need to do at this point. I have sent off for a free credit report. The letter states I have 30 days to respond and is dated July 9, 2007. Any information would be appreciated.
