Teresa: First off, write a letter directly to the company appearing on your credit reports (via certified mail, return receipt) informing them that you are disputing the accounts that they have posted on your TU & Equifax reports. Request that they send validation of the debt to your attention. They are required by law to send you a breakdown on where they got the debt from, how they came up with the amount they say you owe, and provide proof that it's really you that owes it from the original creditor. (If they send some bogus in-house statement or affidavit prepared by their own employee's, immediately send a letter back to them disputing what they sent as fake.) A few days letter, send letters to both TransUnion and Equifax disputing the accounts (via certified mail, return receipt). Be sure to include as much detail as possible i your dispute (i.e. the account does not belong to me or the amount due is incorrect). The credit reporting bureaus will send you your dispute results within 30-45 days (45 if you are disputing info from your free annual credit report). If LVNV's account is deleted, do nothing for right now (wait and see if they reappear). However, more than likely, the account will remain (because LVNV likes to extort money, no matter if they have the right person or not and are trusting that you won't go after them). If it remains, go straight to a consumer law attorney, which can be found by doing an internet search for NACA. At that point you will be able to file a lawsuit against LVNV for violations of the FDCPA, FCRA and your state's debt collection laws. You'll then be able to recover statutory, actual and perhaps punitive damages from LVNV for breaking the law. Basically, every time they update your credit report, they are breaking the law. They are preying on consumers left and right and most times get away with it because consumers don't know their rights or don't do enough to make them follow the law. If they don't delete this fraudulent account, make them pay for their illegal activity.
