THEY ARE USING THEN SAME MODUS OPERANDA OF SENDING A FRAUDULENT BILL AND REQUESTING THAT THIS COULD BE SETTLE PAYING 50% PERCENT OF THE TOTAL OR IN MONTHLY PAYMENTS. THIS TYPE OF FRADU IS COMMONT WITH THIS CORPORATION WHICH APPEARS CHANGE NAMES AS IT SUITS BEST. TO MY RECOLLECTION, I DO NOT OWE MONEY TO THIS COMPANY AND HAVE PROCEEDED TO CONTAC MY ATTORNEY. WE NEED TO GET TOGETHER AND STOP THIS CHISTERS FORM KEEP ON SWINDLING HARD WORKING FOLKS LIKES US.

I RECEIVED A LETTER OF NOTIFICATION ON A DEBT WHIHC I AM SURE I DO NOT HAVE AND THEY CLAIM THAT I MUST PAY THEM FOR IT. IT IS VERY LITTLE MONEY BUT, I AM GOING TO FIGHT IT, ALSO, I HAVE CONTATED THE BETTER BUSSINES BUREAU AND FILE A COMPLAINT AGAINST THIS PEOPLE.

Steve, Thanks for the advice. I was considering suing them - and Sears too. I actually had to put my new car loan in my husband's name to get a fair interest rate based on what they perpetuated against me. In addition I tried to order a small collectible item and the company would not extend the smallest (under $20) credit to me due to the trashing my credit report took from them. I was not sure where to start with a lawsuit since the lawyer I talked to did not seem that helpful. But clearly my rights were violated along with countless other victims out there. I appreciate your advice and will post back here if I go after them... and win!

SUE THEM!! They caused damages and need to pay! It is easy to win. Contact the NACA for a referral. Junk Debt Buyers like LVNV need to be held accountable. The entire industry needs stronger legislation. These lowlife should be required to verify the debt is valid and legally collectable BEFORE making the first phone call or sending the first letter, AND before putting a collections entry on a credit report.

These people are despicable. They reported me to the credit agencies as a deadbeat before ever attempting to collect any money from me. My credit score dropped into the basement and I had difficulties in getting the simplest credit extended to me. Fortunately I am in a good financial position and did not need to open any new credit lines. So I fought them for six months. Certified letters, phone calls were fruitless. They REFUSED to show me the original "debt" because there was none! The FTC did nothing, Equifax did nothing they have an "Investigative team" and all they do is verify that the issue is reported correctly and not that the information is valid. I contacted a lawyer and he told me that until LVNV took me to court I could do nothing. My final resort was contacting the attorney general in the State of South Carolina. The attorney General sent them a letter requesting that they comply with the law and send me information on the "debt" 45 days later LVNV funding sent a letter to the attorney general stating there was no longer a debt and they would contact the credit reporting agencies to have the information removed. You MUST fight these people. Take my advice and go directly to the attorney general. They are the ONLY people that responded and helped. These people are legally stealing from American citizens and holding innocent parties' credit ratings hostage. Don't give up. Don't be their victim. You can win. By the way Sears /Citibank were the origianl : "creditors" and they are just as disgusting.

Enoc, The address you gave on this post I believe is that of Merchant's Credit Guide Co, and not that of LVNV funding. They are both collection agencies AND junk debt buyers. They were probably listed as the "original creditor" on your collection notice. (excellent information) All of these bottom-feeders started from the same mold, Sherman/Alegis out of Houston was originally started by Frank S. Russo, Tony M. Ettinger, Thomas E. Upton, Samuel Bergman and Richard Dunn all of Houston, Texas. They purchased old debts for pennies, and then set up collection agencies to collect on them at inflated prices. As with most bottom-feeders, they have had to resort to placing all accounts on consumer credit reports, inflate the balances and demand settlements. Alegis became Sherman, which became LVNV and now Resurgent and Ventus are all in the bottom-feeder business. They do file lawsuits, most with bogus affidavits and pleadings. They use under-educated employees such as Allison Moon B. Moon of Greenville, SC to sign affidavits where she lies about the authenticity of accounts (see ?Allison Moon is a Liar' below) in their attempts to give credibility to their bogus pleadings. The problem with liars like Allison B. Moon is she makes statements that are known to be false. Her swearing is nothing more than hearsay and an attempt to defraud consumers out of monies they may not legally owe, not to mention the fraud she and her organizations bring into the courts. Consumers dealing with these bogus filings and affidavits are urged to challenge their validity in order to avoid becoming another victim to their scam and being ripped off. You are further urged to go after these bottom-feeders for the lies they place on your credit reports. Under provisions of the federal law, the Fair Credit Reporting Act (FCRA) any item placed upon your credit bureau reports MUST be ?accurate.' In my experience, I doubt anything placed by a bottom-feeder could ever meet the legitimacy of that test. Consumers are urged to dispute any LVNV, Sherman, Alegis, Resurgent, Ventus account with the credit bureaus and make demand upon the organizations and their owners to abide by the law.
