In March 07 a rep from Integrity of Texas, Mr Fred Garner, came to my new small check cashing business and fed me a line about this check machine that would guarantee checks that had been run through it. Mr Garner said the Federal Reserve uses this machine to keep from being scammed by fraudulent checks because this was the only machine that could tell if a check was copied, stolen or fraudulent. Being new to the check cashing business this sounded wonderful. There were other issues but not to do with the machine that were fraudulently represented.

I agreed to a 12 month trial with the check cashing machine and signed the contract, (bad business practice) which was blank because Mr. Garner said he had another pressing appointment, after talking at length about his wifes teaching experiences (one of my areas of interest). I was left with no way to contact anyone--no address, no phone number, nothing except a check stub $294.95 for the deposit. The great price you quoted was $99.95 per month.

When I received the contract several days later, it was for 48 months and I receive notice that I would also have to pay an additional $4.95 for insurance coverage on the machine even after I returned the machine to them. They were also charging me 22 cents per check run through the machine. And when my bank account was charged it was for different amounts altogether. After I received the contract I contacted everyone concerned and told them I would not pay and had my bank account changed which stopped the payments from coming out.

MBF began calling me 10-15 times a day at work and home and sending letters to my work and home. Then the lawyers office began to write and call and when I had my attorney write and tell them I would not ever pay there sorry selves any more money the lawyers office had my credit rating checked several times (the lawyers office used a different name but the same address as the business who checked my credit). This is when they began to call and leave a phone number for me to call back. Even when I answered the phone there would be a message to return the call; I never did. Now I have been served with a summons to appear in court in New York . I always wanted to go back to New York, I guess this is my opportunity.

If anyone out there has been successful in fighting these ripoff artists please respond.

I was served with papers from New York (I am in Mississippi) I had 30 days to file a response in the New York County Civil Court. I spent days researching other cases against MBF and incorporated that into my response and wrote my response and sent it in May to the Courts and MBF's attorney. I am awaiting a court date and will fly to New York to defend myself against these low lifes to the best of my ability. I tried to get an attorney through the New York Bar Association but they said because of the amount of money involved they would not take the case even when I told them I would spend more to fight them than it would cost to pay them. Good luck with your fight if they do sue; you just contact the clerk where the papers are served out of and ask for their advice. They were very helpful to me.

Hey Gerri, I'm in the same boat, except I think i'm about 2 months behind you. MBF Leasing is planning to sue me in couple weeks. Can you tell me if you already went, and how it went? If you havent gone yet, can you tell me what is your plan? Are you planning to fight back with a lawyer or not? Any information will be helpful. I have 0 experience with lawsuits, kinda scared, but I'd rather spend 1000's of dollars fighting, than paying them a dime. Thanks!

I was summoned to go to court. The first step was to answer the complaint with the clerk of the court. It was easy. I had typed up an answer ahead of time. This answer was stapled to a form that the clerk helps you fill out. Make sure you have extra copies of your answer with you. Now I have a court date in July which should be the actual hearing before a judge. Make sure that you counter sue and make it big. These people are criminals. Go after them.
