After filling a dispute with MBNA I waited, but not for long. Within a few short weeks I received a letter From Wolpoff & Abramson demanding payment. Followed shortly thereafter by a Notice of Claim by the National Arbitration Forum. I notified the NAF that no arbitration agreement exists between the parties and therefore they have no authority to continue and must immediately stop proceedings. Of course they ignored the truth and went on to give MBNA an award. The Fair Debt Collection Act says that ANY dispute is to be acknowledged within 30 days, investigated to a finding or conclusion within 60 days. During this time no fee's or interest of any kind may be added to the disputed amount nor may they close the account or report the account as delinquent credit bureau's . MBNA did all of these. More than one year after the initial dispute I receive a letter from MBNA claiming that my dispute is not valid. MBNA does not have the authority to determine weather a dispute is valid or not. This is a mater for a court of law to decide.

So thank you MBNA (aka: Scumbags) for trashing my credit. My hope is that there are enough of us out there who are willing to fight for our rights and CRUSH MBNA and the NAF into oblivion!

Most CC "agreements" require arbitration in lieu of lawsuits in a court of law.

When you use such a CC you have automatically agreed to arbritation. If you have an older CC account that does NOT stipulate arbitration, usually sooner or later you will receive a notice of a change in terms adding arbritration in lieu of using a court of law. If you use that card once after notice of the change in terms you have agreed to those changes. I read (somewhere) about an action, maybe in Chicago, about the arbitrators finding for the CC bank in 100% of all arbitration cases. Pretty good, huh?
