McGrath Acura Of Westmont ripoff breach of sales contract by selling car despite deposit Westmont Illinois
I am writing to document the troubling experience I recently had with McGrath Acura of Westmont. After dealing with Carl Reed and Kevin McGrath at the dealership for about a week, I placed a $500.00 deposit on a used 2004 Mazda3 on the morning of 28 January 2006, with the agreement that I would pick up the vehicle on 4 February 2006. I then began the process of getting insurance and financing for it.
Two days later I was informed that the car had been sold later that Saturday. This was problematic for at least two reasons. First, any seller with an ounce of decency or liability concern would have at least informed me that another party had offered to purchase. Second, the completed price sheet on McGrath Acura letterhead constitutes a valid purchase agreement, which became a legally binding transaction with my deposit applied towards it. This was not only a verbal commitment, but a written agreement with cash involved.
Not only did I spend time and money getting things in order for the expected purchase, I also suffered opportunity costs in forgoing other purchases. This is the type of thing that contributes to the bad reputation of car dealerships. The McGrath franchise is dishonest and should not be trusted or dealt with.
