Mr. Ludt is extremely unethical in his practices.  The job of an attorney is similar to that of a doctor, therapist, etc... it's their job to "lose" your clients... meaning helping them to get better and then moving on to the next client.  Instead, Mr. Ludt chooses to draw out his responses over weeks or even months, coming up with excuses as to why, in turn causing his clients and other clients to incur more and more fees.  He gives unethical advice to his clients as to keep them around for as long as possible bleeding more and more money out of them.  Complete scam artist.  He doesn't deserve to be licensed, and the bar quite frankly should be embarassed.

RE: Withdrawal of Legal Representation

Dear Jo Ann Zepher;

We regret your failure to maintain sufficient monetary funding to meet your contractual obligation, and are unable to retain ongoing representation through our firm as agreed in the Firm-Client Fee & Service Contract

The reasons for withdrawal of Legal Representation as permitted by 2, 4 and 10 are:

1. Failure to fulfill obligation of 2. Paragraph C., Client(s) agrees to make any and all payments according to this contract, on or before the due date.

2. Failure to fulfill obligation of 2. Paragraph F.,

Client(s) agrees to deposit {$___________} each and every month in a financial account controlled and maintained by Client(s) for future use toward addressing any and all financial arrears. This obligation benefits the Client(s) by timely accumulating funds in a manageable manner if the resolution between the Client(s) and the Lender requires funding. Failure to maintain these funds or to make timely deposits of these funds will seriously and adversely affect the Client(s)s ability to obtain a reasonable result. This obligation is the sole responsibility of the Client(s).

3. Failure to fulfill obligation of 2. Paragraph H.,

Client(s) must pay the legal fee in full as agreed in the Fee Invoice and Authorization Agreement and return a completed and signed Firm-Client Fee & Service Contract before work begins. Failure to pay or any subsequent rescission of payment or of this contract is cause for termination of services/representation. The billable hours on this file exceed the payment received, As there is nothing further this firm can do, the Law Office of M. E. Ludt is withdrawing from this attorney-client relationship.

4. Failure to fulfill obligation of 4. Paragraph A.,

The legal representation services described herein shall be provided for an initial payment of {$ ______________}, and subsequent payments of {$____________} per month until case completion or termination. Such payments cover the availability of the Firm and the legal services performed, as described hereafter. Further, possible additional expenses are described hereafter. This initial payment shall be paid upon the signing of this contract and work will not begin until payment and a completed and signed Firm-Client Fee & Service Contract is received by Firm. Client(s) acknowledges and understands that the initial payment shall be paid in advance to initiate representation. 2 of 2

5. Failure to fulfill obligation of 10.

Insufficient Funds/Returned Checks: If Client(s) writes a check, or advances credit that is returned for any reason, including a dishonor for insufficient funds, or a stop payment order, Client(s) shall pay all services charges for the return PLUS an additional handling fee that is 50% of the charged service fee. Client(s) also agrees to immediately make good on the payment due and owing. Failure to do so is cause for termination of this contract without refund of amounts already paid.

You must now deal directly with OCWEN LOAN SERVICING, LLC and/or the court to resolve the matter from this point. The contact number we have for OCWEN LOAN SERVICING, LLC is 800-746-2936.

I can't help those that don't want to be helped

In my first rebuttal to this client's complaint, I stated "I invite this client to call me if they have more questions or concerns and I will gladly talk with them."

The client has yet to call me. I have spoken my piece despite our services being misrepresented by the client and have asked him and her to call me to discuss this further. I have yet to hear from them.

I cannot help those people that do not want to be helped. That clearly includes this client. It is sad and unfortunate for them. I wish them luck in work to keep their home.

M. E. Ludt Complaint NOT True

#7REBUTTAL Owner of company

Fri, March 23, 2012

My name is Matthew E. Ludt and I am the owner of the Law Office of M. E. Ludt, LLC. Though there's no name given for the complainant, I know who this client is.

When a client, prior to retaining the firm, submits their own application for reformation of their mortgage, it should not be surprising that it is turned down as drafted nor should that application's denial be attributed to the firm's work. It is not wholly unusual for clients to have attempted self-help before retaining us, but hundreds of clients do hire us because we know what we are doing and we know how to get results from lenders. That's what we were doing for this client prior to client terminating the contract.

The fact is that we put together a well presented application and negotiated a new mortgage for the client. It was a great resolution given no money reserve and more than a year of no payments to the lender. It was only because the negotiated resolution didn't match the resolution the client's friend had did the client rebuff it entirely and terminate the contract.

Two discussions were had with the client prior to the client retaining the firm's services. During that time the services and programs were described to the client and the limitations were spelled out, which included the reality that the resolution for the client was not likely to match resolutions for others as the individuals' facts differ. The firm does not and cannot guarantee outcomes -- such would be unethical and violates the rules of professional responsibility. In no manner was the integrity of this absolute rule disregarded for the client. Such was stated verbally and such is explicit within the contract that the client reviewed and signed before sending it back to the firm.

The firm thrives on helping people protect themselves, their families, and their futures. That's our slogan and we live by it. I invite this client to call me if they have more questions or concerns and I will gladly talk with them. However I do not appreciate the mischaracterization of the firm's work (which resulted in a great outcome that the client thumbed their nose at) for the denied application that the client submitted themselves.
