  I leased a Mercedes Benz 2010 ML 350 for 39 months. Over that period, my vehicle was in various repair shops for 60 days, not including visits to correct tire pressure and a faulty Bluetooth system. In September 2011, my car ran out of gas at 9PM on route 80 yet the gas gauge indicated almost a half tank of gas remaining. With cars passing at 75-80 mph, I called MB roadside assistance for help. They refused to send help until I did an interview with them. I ended up calling 911 and the state police showed yp with a tow truck within minutes.

This  vehicle stalled six times over the course of my lease...the last time on 5/18/13 with three people in the vehicle. I called for an appointment to check the vehicle and got an appointment on May 20. MB Nanuet was the dealership where I went and it was where the car had been leased from. They refused to check my car out because there was a pending lemon lawsuit. I had attempted to turn this car in on twoseparate occasions either for an early termination of my lease or a replacement, but was turned down on both occasions by case managers with Mercedes.

My lemon lawsuit was reviewed by a mediator and I was represented by an attorney. Mercedes Benz was also represented by an outside attorney. The mediator determined I had brought my lawsuit too late over the course of my lease and didn't award me any compensation. The mediator, upon hearing that I was denied service on 5/20/13, stated that the Merecedes Benz Corp. broke the terms of my warranty agreement and I was not responsible for the disposition fee.

 

i have been contacted by MB Financialon three occasions for collection of this disposition fee. I have lost my patience now after finding out that this charge is on my credit report and is affecting my credit. I have also talked with the GM of the dealership and various case managers atMercedes Corp., but have not gotten satisfaction.

i would like this disposition charge to disappear from my credit report at this time. After thinking about this, I now think I'm owed some compensation fro Mercedes for not honoring their warranty.
