I am a certified HUD Inspector and FHA Consultant.

 

On June 8, 2014, I was contacted by a Adrian Quebengco of American Capital Corporation, located at 363 San Miguel Rd #130 Newport Beach, CA 92660, to perform a foundation inspection of a property located at 13939 Johnson Road, Phelan, CA 921371.

The property is under an existing FHA loan by owners Michele Lee Barlow and Mark E Barlow.

These borrowers are currently seeking a refi with Sue Southwick of Endeavour America 1990 N. California Blvd Suite 720 Walnut Creek, CA 94596.

During the course of inspection and investigation of the property, it became clear to me that the property is severely deteriorated caused by illegal construction work ordered by the borrowers with very serious life and safety issues which could cause collapse or explosion of the property.

It also became clear to me that the appraisal performed on this property conducted by Michael D. Fowler of peedy Appraisals located at Pacoima Road, Victorville CA 92392 Lic. No.032644, HUD no: CAAR032644 was fraudulent and fabricated and that the property was extremely overvalued.

Among the dangerous conditions of the property is the presence of an unpermitted propane tank and a water heater which have been installed without any permits and in very dangerous manner that could result in explosions any minute.

Also because of the unpermitted work done by borrowers on or around 2012, the whole foundation and floor system seems to have been severely compromised which could result in collapse of the structure at any given moment caused by lack of adequate ventilation.

When I informed all the parties, which includes JJ McAfee, the supervisor of Adrian Quebengco and the supervisors of Sue Southwick, of the extremely poor nature of property, I was threatened that I should either sign off on the property immediately the way it was or that they would fire me from the assignment immediately.

When I told them that if they did not take the necessary steps to remedy the situation I would have no choice but to report them to HUD, they began defaming and threatening me and accusing me of acts that I had not committed.

They have now solicited the help of an unscrupulous appraiser and inspector to sign off on the property which is awaiting inspection of local authorities, for the purpose of refi despite the fact that the extent of damage to the building cannot be determined until a thorough engineering evaluation of the foundation by a licensed engineer has been performed.

As a result of the actions of the borrowers, lenders, brokers and appraisers, I have filed complaints with San Bernardino County Code Enforcement and Fire Marshall for extremely dangerous conditions of the property and I have asked them to conduct inspections of the property, and I have filed criminal complaints for blackmail and threats against me with San Bernardino County’s Sheriff’s department.

It is this type of acts committed by these fraudulent individuals, borrowers, brokers, lenders and appraisers that have destroyed the real estate market.
