Midland Credit Management ,MCM I settled this debt in May 2008, now they are calling wanting more money. Oaks Pennsylvania
May 1, 2008 Jerry Hastings from MCM called left a message that they would accept 10% of the debt and it would be settled. I had made this offer a few days prior. May 2, 2008 I called in talked with Mr. Hastings and gave him my checking account information. I had tried to pay with Discover May 1st, they do not accept Discover. He assured me many times that I would never hear from them again. I paid $796.49.
In August they started calling me again. Now they want 6 monthly payments of $568.00. Ive told them over and over again this is settled and to listen to the recording of the conversation I had that day. They no longer have that recording.
Im not sure what to do at this point. Any advice?

Sorry bud....you made a mistake here. NEVER accept verbal promises about settlements from debt collectors. Get all terms IN WRITING PRIOR TO PAYING THEM. If you don't get this written agreement, there's nothing to stop them from coming after you for the remaining balance.

If you do not get a settlement offer in writing, you can forget about collection agencies ever adhering to it. Let me tell you of a scenario. Say one of their reps hasn't been doing well and is told they need to collect x amount of dollars today or they are fired. He/she could start telling people it is a settlement offer, just to get the payments he needs to keep his job. I'm not saying that's what happened, but it's possible. What does Mr. Hastings say, or is he gone?
