I received a collection letter Ffrom Midland Credit Management In April of 2006 stating that they had purchased a debt from Pacific Bell. I checked my credit report and found Midland had already placed a negative and source was Pacific Bell. I allready have a negative on my credit file from a NCO Financial back in 2001 for the same debt though they stated SBC.

I have now been double dinged by two different companies saying they bought the debt from eithier Pacific Bell or SBC.

History: Pacific Bell along with Nevada Bell were part of the Pacific Telesis group. SBC comunications bought Pacific Telesis in I believe 2003.

Reported to the CRA that I had been double recorded for the same debt (awaiting response).

In the mean time I have sent a validation request letter to Midland as I dont think they own the debt that I disputed way back in 2001 anyway.. I know the SOL has expired but the fact that I am double dinged annoys me.

Do I have grounds for sueing Midland for Reporting to the CRA a negative that I have allready been dinged for by another company in 2001 (NFO Financial)? They also obtained my credit report without my permission.

Lastly I see Calvary Portfolio Services has obtained a CR file on me (Feb 2006) but has yet to do anything else. I wondering if they are going to be the 3rd company stating they now own this debt LOL. I sent Calvary a letter to determine there permissable purpose for obtaining my CR file. I want to sue them to.

I am definately showing up to court! youde have ta shoot me dead on the way there for me not to show up I want to nail them against satans wall for what they are doing to all these people and my family...Sorry to say they just pissed of the wrong woman here cause Im gonna take this all the way and then some! Ive also contacted 7 on your side and told them my story and refered them to this website for additional stories. Included in my tirade is another one against the CRB's for accepting false information from collection agencies. Now that was one weeks work just imagine what I could do in oh say 6 months! Im not givin up on this one!

Ok not an expert but here is my suggestion. 1) Show up in court or they will get a default judgement! This will surprize the heck out of them and they probably wont know what to do.

Kenneth I have a question for you. I am being hauled into Civil court with Midland for a debt I dont owe and have proof. So yesterday I filed a bunch of complaints with state and local entities one being the Atty. General also. How long till you recieved a response from them? Ps To the replier of the original post yes it does piss them off with the certified mail but in the long run they will either come after you in 6 months report other debts to your file sell the alleged account to another collection house...so it doesnt really work approaching it that way. The only way you are going to get a response that you like is to shut these people down. Either by taking them to court giving ammunition to the Atty general to get legislation controlling these collection agencies also try this report them to the BBB It was kind of tricky but I got around it to lodge a complaint against them, others have done so also and you can lodge the complaint in San Diego's office of the BBB on their website

That agency that just pulled your credit should be stopped right away. Do a pre-emptive strike. This is what I do. Send them a CEASE COMMUNICATION request IMMEDIATELY. Do this by certified mail, return reciept requested and to the fax#. Put the certified # on the letter itself. This really pisses them off.

Midland Credit Management Capitulated. THey responded to the Attorney general of California complaint I filed by stating: 1) They Moved the item to a special holding-queue wher all collection activity and credit reporting is prohibited. 2) All three CRA's were contacted to remove all reference to the account. 3) Client has NO financial obligation to Midland for this account. Basically, they gave up and could not prove I owed the debt they claimed. I will now re-obtain my credit file to see if they removed the negatives as they stated. Dont pay these bottom feeders anything. Make them validate the debt (chances are pretty good they cant). As to Calvary on the permissable purpose? No response yet. I plan on suing them soon. Will keep you posted.
