Midland Credit Management is a scavenger debt buyer, bottom-feeder. They buy a lot of old debts that are (again) placed on consumer credit reports. MCM has BIG problem. Like most bottom-feeders, they must pay (usually $50.00) to retrieve documents on accounts the CLAIM are legitimate. So, like the others, it's easier and cheaper for them to ignore consumer complaints and NOT respond to your complaints. Midland is a subsidary of Encore Capital Group, Inc. They routinely violate the law, and when called on it, claim it was a "clerical error". Go to FTC.gov and file a complaint online every time they call and for any other violation of the FDCPA and/or FCRA. File individual complaints as it is the number of complaints that brings enforcement on a collection agency by the FTC. NEVER pay a collection account just so you can get a home loan. If it is an old charge off, you are better off disputing it and getting it REMOVED because paying an old charge off/collection account will actually hurt your credit score and restart the date of last activity with another 7 years negative reporting showing now as a "paid collection". That loan officer is only doing what it takes for him/her to get the commission on the deal, they do not care what is really best for you.

A collection agency is legally allowed to discuss a debt with a spouse in 47 states. The only states that have laws prohibiting this are Alabama, Iowa, and Massachusetts. Once you refered to yourself as his wife, they are within the law to discuss it with you. I realize that the agency has to prove that you owe the debt. However, if you have proof showing the debt was paid, by sending them a copy of it, the calls should stop. You could definately send a cease and desist letter whihc would stop the calls as well.
