In 1999 my husband and I were notified by the IRS after three years waiting for a refund, that they were now going to audit us. We joined NADN 7/26/99 for a fee of $750 for two years and one free year. Since we were already involved with an audit, NADN further charged us $2,000 to represent us to the conclusion of the audit. Last year we had to renew our membership for an additional cost of $750 for two years.

Total of $3,500. The IRS said we owed $1,600 in additional taxes. NADN said simple mistake; they'd take care of it and it "probably would go away." Sent NADN tax records to the "audit coordinator, Archie Gustin." For the past three years, every time a notice was sent by the IRS, nothing was done by NADN. Mr. Gustin even notified the IRS he no longer represented us because we were no longer married. He must have made that up because we were never separated much less divorced. We were notified of taxes and penalties ranging from $3,600 to over $9,000. Mr. Gustin kept saying wait until it goes to court and we'll settle it then.

Understand we were only contacted by Mr. Gustin after the IRS sent us notices and we made many, many phone calls and frantic letters to NADN to start defending us. Last minute before a pretrial hearing in federal tax court Mr. Gustin realized he needed a new power of attorney and only two days before hearing notified us we didn't have to go to the hearing. Again, nothing happened after that. Finally got notice of court date for first Monday in June, 2002. Friday night before that Mr. Gustin calls my cellphone at 7:00 p.m. after the IRS is closed, court date is Monday to inform us the settlement would be over $3,000 plus penalties and interest. Mr. Gustin promised he would file an appeal for us and we could submit further evidence to adjust the amount set by the IRS.

Again, heard nothing. December 2, 2002, received notice from IRS Mr. Gustin informed them he no longer represents us. He didn't tell us. Two days later received letter from IRS that we have until December 5th to pay or make arrangements to pay over $7,000 in taxes, penalties and interest. Our income for the audit year 1996 was $29,000 for a family of three. Mr. Gustin never filed the appeal, never worked our case. He reacted to the IRS instead of defending our case and position. So instead of paying the $1,600 at the beginning, NADN delayed and delayed our case with the IRS, left us hanging out to dry at the last minute, and has now cost us over $10,000 with NADN fees and our current with the IRS.

NADN is responsible for the penalties being so high because Mr. Gustin and NADN made no attempt to settle this case for us.
