Help! These bastards have been calling for months, trying to say I owe AT&T money. I have called AT&T on 3 way and they have told these crooks. "THEY OWE US NO MONEY, they aren't on Collections."  The lady apologized and said "You wont get anymore calls" Well they are still happening. And now they crossed the line.

I'm doing a Refi on my house and they just submitted a false collections hit on my credit report! These bastards.. I sent them a fax that shows my account are in good standings and I cant get a straight answer. HOW IS THIS LEGAL! How can these crooks just put a fake collections report on someone?

Please someone tell me me what I can do, and I want to take these bastards to court.

I am an employee of the company, I have worked there many years (over 10, less than 20), they do NOT train their employees and they post signs in parking lots to get "collectors" - some of which the last job was McDonalds.  They do tape ALL the calls, and the calls are monitored for "quality assurance".  The reps do not document the conversation as it happens and the reps leave out things and make things up, so you cannot go by what they read you in the notes.  I would definitely pursue legal action against them.  I have a friend that just got laid off after over 20 years for making a minor error.  This person will be suing them, no doubt.  They have a "dialer" and they mark things "hot" which means you will come up to be called repeatedly and they don't care what hour and they can manipulate the time they called (if you are EST, MST, PST,etc) if you are in California and call their office in NY or PA or GA or TN the notes will be from the time zone THEY document, not what time they call you.  They are 100% dirty.  I can only say so much but trust me, they don't know their a*s from their heads most of the time.  Get a good lawyer (Bud Hibbs has a good website on these people) - I would subpeona their notes and the call you received too, by law they have to give you the notes and the "tape" they made of your conversation.  The Credit Bureau department (that is supposed to erase your bad credit or delete you from credit bureau reporting) is a bunch of idiots and they never do what they are supposed to do when they are supposed to do it ....get this....some work out of Barbados and the Phillipines and Puerto Rico so you are not even dealing with someone in America.  Get the name of who you talked to.....I am not sure what kind of bill you have if it is a credit card, college loan or Healthcare bill - you would need to let me know and I can get you straight to the top of the ladder.  I can give you the phone# to make sure that this does not happen again.  These people are like card sharks with a sleight of hand, destroying lives.  I have seen it happen many many times first hand and they laugh about it.  Tell me what kind of bill you are harassed about and I will tell you a direct line to someone to call and harass.

On one hand, NCO aggressively peruses and takes over other collectors in a bid to be the world's largest. Meanwhile, corporate collection policy seems to sway daily, depending upon the wind.  One call might bring threats to our active duty military personnel and their families, on a level reserved for terrorists.  The next call will be gentlemanly, helpful and not-at-all like the NCO of old.  You never know which one you'll get. On some occasions, NCO takes the debtor into court, scratching and fighting for pennies and spending thousands to get it.  On others, they fold like a paper tiger at the hint of consumer counter activity.  Perhaps the giant is learning from the mistakes of the past.  Perhaps the sting of some many fines and penalties caused stockholders to crack the whip.  We do know that two years ago, our email box and phone were overflowing with NCO complaints.  At that time, every other complaint was about NCO.  Now they just trickle in. What's lacking in this big agency is a resolution department.  If they had a team of 3 people to handle consumer complaints, put out public relations fires and resolve problems - someone with the authority to make decisions - they'd not only disappear from our list of America's worst, they'd do themselves much good.   Send them a cease communications letter via certified mail with return receipt requested - keep copies of all these items They will violate this cease communications (know from experience) - make sure you photograph your caller id and do not answer the phone!!! Let your machine or voice mail pick it up - tape the messages - Do not believe anything they say for they lie!! Good luck and kick em where it hurts - their net income line

By all means you should sue them in District Court.  In District Court you can be awarded up to $1000 in statutory damages for their violating the Fair Debt Collections Practices Act.  You can also be awarded reasonable attorney fees.  What's even MORE important is that you can sue for ACTUAL DAMAGES.  Since you are in the process of financing a mortgage, ACTUAL DAMAGES becomes readily provable, thus increasing the award you're likely to win.

Further, you can also sue them for violating the Fair Credit Reporting Act.

What to do:  1.  Contact an attorney in your area that knows consumer credit laws-many law firms are now SUING these bad collection agencies.  File formal complaints with your State Attorney General and THEIR State Attorney General.  Also file complaints with the FTC.  Also, go to the FTC website, www.ftc.gov and download the FDCPA and the FCRA.  If you can get ATT to verify in writing that there was the 3 way call and that you do not owe this debt, all the better for you when you SUE THEM.

2.  Send them a certified, return receipt requested letter that explains this is not your debt and that you expect them to contact the three credit reporting agencies to have this false debt line deleted immediately.

Good luck.  Don't waste any time.  The statute of limitations for you to sue them for FDCPA violations is 12 MONTHS from the time that the violation was committed.
