and obtain the necessary proceedures to challenge the filing of the 1099. Another ploy to try: send a certified return receipt requested letter to the president of NCO financial demanding that they recind their 1099c filing in your name. Make it very clear in your letter that you will contact the IRS to challenge the fraudulent filing of the 1099c and will be seeking council for any and all legal remedies for their fraudulent 1099c filing. I would go so far as to give them the address of the IRS office nearest your location. In your letter, clearly state that if you don't receive written verification from them that they have recinded the 1099C filing within 10 business days, you will seek civil and criminal remedies for the fraudulent filing. If you don't receive a written verification from them, file a challenge to the 1099C filing with the IRS, and file a criminal complaint with the Justice Department. You might also consult with a competant tax ATTORNEY (forget tax preparers) to seek CIVIL remedy. Good luck.

that there are numerous tax fraud violations here. Hopefully you have all the written communication proving their fraud in submitting the 1099 against you wrongfully. You would have to consult a lawyer. Also, odds are they did not pay full monetary value of the debt so I don't think they could not write off the full monetary value and claim it themselves but, I don't know-just something to look into. There would also be the outrageous jacking of "interst" and other "fees" that they probably unlawfully added as well. The real original creditor is the one who took the tax break already as they are the ones who actuallly lent the money. Also, I'm sure they are trying to portray themselves as "creditors" and they are not as you know. You would have to talk to an accountant. But, this is why you never talk to these scum and the burden of proof is on them-which they clearly didn't have. You need to talk to the right people now as you may have screwed yourself.
