Complaint Review: Newberrys Coffee - Boca Raton Florida

The only reason I am submitting this report is to replace report #647214.  I misspelled Newberrys as "Newberry's" in the title of that report, making it difficult to find, or be missed, by people looking for this company.  I did try to correct such, to no avail.  I apologize for my mistake. 

Newberrys Coffee has had advertisements on the internet, to include craigslist and various franchise web sites, advertising to sell franchises or distributorships, with a right to a specified areas.  Everything is handled verbally, there is no written documentation, which, in retrospect, I feel should tell you something about the company.   I have been told by a person with some knowledge of he subject that franchises are supposed to provide written documentation in at least some states.  I am not an expert in these matters, but that person had no reason to lie. 

In my case, Newberrys sold the same area twice, and then I found out, after ordering and paying for the machines,  that they do not include coin acceptors.  For three machines, that would be over an additional $1,000.00 over the advertised price. 

Newberrys recommended the use of a professional locator, although they subsequently denied such.  That is the problem of handling everything verbally.  Newberrys recommended locator was unable to place the machines.  At that point, I got fed up with the exagerations and outright lies, and informed Newberrrys that I wanted a refund due primarily to a selling of the area twice and a lack of coin acceptors.  They refused.  I filed a BBB complaint.  Newberrys took in excess of three months to respond to the BBB, and when they did, they lied.  I refuted their claims, Newberrys did not reply.  Their BBB rating has been changed to a B-.

I have also posted my machines on Craigslist for sale, at multiple locations throughout the country.  I have also found where to buy the machines and coin acceptors at 1/2 price or less than what Newberrys offers them for.  The machines admittedly are not programed and do not have the NesCafe image on them.  I have advised some people where to buy these items, at a considerable savings, it they desire.  More than one person has thanked me for my preventing them from making a bad investment.

I question if it is totally proper to advertise these machines are in fact "Nescafe" coffee vending machines.  The machines are made in Italy and then shipped to a vending company in the United States.  They are then sold to Newberrys, who put their facing on the machines, and program them before shipping.  The machines are not made or distributed by the Nescafe or Nestle coffee company. 

I have pursued other avenues to get this matter satisfactorily resolved.  I am determined to pursue all legal means to get justice in this matter.
