Rebuttal: The reason why I went to settlement is because I had turn in my rental townhouse and had packed everything in storage. Mr. Eric Ber would not let us look at the house until the day of settlement. I hired Able Inspection Company as advise from my Realtor. At the inspection, the inspector told me he could not give any report on the internal walls, because I paid to have the basement finished. He also told me the the contracts such as windows not fans is a contract dispute and they do not handle what is in a contract. Well, I expect that if I'm given a Specification of what is being offer this is what I'm suppose to get. The concrete is terrible and when I spoke to the contractor they tell me, that I did not hired them my builder Eric Ber did and I need to speak to him. When I call Eric Ber he gets upset and tell me that I need to know what a home owner is and what my responsibility is, but he gives me a list of people who help to build my home, but yet they do nothing. I even wrote to RCW Warranty within a year, Eric refuse to do the work and he also refuse to listen to Consumer Affair in Howard County that they had to subpoena him in their office because he would not respond, and he brought along his lawyers. When I ask Eric to just refund me my money back since he was showing the house, His reply was that I breach the contract and he was keeping my deposit and he would not return it unless I took him to court and he would make sure that this money would get tied up for as long as he could hold it. Also, he said he would not talk to me anymore only by mail. He even wrote my Realtor that he promise me a back door and thats what I got. I also told you that I paid for my front door, and he wrote me a letter telling me he would refund me the money at settlement which I have in writing, then at settlement he made up some lie that now he would not give me back my money. My sliding door is on my contract when I got my home he told me the Bilco Door was to protect his material and that the door would be remove to my surprise back in September I found out it would stay. Eric, my husband, and my initials are on every sheet but this one. He change our drive-way and told me he could not put a driveway there because of the county tree. Another LIE, I called the county and they remove it. He wrote my Realtor if we wanted the tree down she should give my husband a saw for a house warming present. I did not know he was suing us until my Realtor Ms. MaryJane McGill from Long & Foster received a memo from the settlement office that Eric was claiming damage quess what he wrote this 12/7/98 one day before closing. Mr. Ber was going to keep my deposit with some clause him and his lawyer schemed up - to make me not settle so he could keep this large some of money and also sell the house. No, I did not want to settled, but we were out of lease by now, any problems with the house I was told he would straight out. I could not see that the wall were soft. Now my walls are cracking they dent very easy, when we walk across the floor you can hear board pop up, going down the basement the doors from the basement and back door when open you have to knock or be carefully because when going downstair and someone is opening back door they collide together. You have to open one door at a time. The back where my air compressor is on a block of cement is about to go thru the ground. The foundation is poor and my loan company never been out here to see the property. Since my house is under HUD, tomorrow I will contact them and find out what the say. Well, to my surprise the Arbitrator only reward me the paint job and two of the rooms I already painted because I could not take it, the windows, and everything else was contractor problem not builder. I was also told because of the time limit, but the arbitrator when back to letters in 2000,but the RCW included the letters from 9/99 I wrote about the problems, but neither RCW or arbitrator would take consideration that these items were presented before one-year and this is documented. Eric did however sent in a check for $150.00 not to do this work, but the arbitrator declined. This contract that I sign was back in January 1998. It took 10 months to complete and some days. Eric rushed to get this house done at the last minute. I understand there going to be problems with a new or maybe older home, but these problems were seen only months later. Eric promise he would fix things then he would prolong the issue until you just got tired of calling or writing. I'm not the only one he ripped off but the only one that won't give up. The money he was going to keep was all that I had saved up to buy a home. All I could do is pay at settlement what he sued me and write on the check that I was paying under pressure not liability. I'm just glad that someone responsed. Any sugestions, whether I like it or not, I'm willing to sugestions. It will be my opinion whether I listening. Oh, by the way the concrete work was not awarded. I forgot, I did get the back porch, but the sliding door nothing. This house of mine is the only one with a Bilco door, and I can see that the foundation around this door is seeking in. There is something wrong that he put this door on. This is a new house, even now you don't see Bilco door on homes unless you have a cellar. My neighbor also ask me why I have this door. Eric said its better then a sliding door, and it meets the code. But my contract doesn't show this door it shows a sliding door. The way this house look I did not need a contract. Any help is appreciated. I did have another home inspection done by US Insect - Mr. Sonny Mosier in December 2001, and the things he wrote down was exactly what I had been saying all along. He also wrote down suggestions, he could not be at my Arbitration, and most of his report was not even talk about.

I do home inspection Let me try to clear something up for up.1st I support this program form.
2nd you may not like what I tell you do not take it personally but, the truth is what I'll give you.
Why did you go to settlement?
You Home inspector what's his/her report say about your problems?
Law cases and your (lawyer, Mr. C. Michael Brawshaw - Crofton MD)has he had other case's (he WON) like yours.?why not say where you live and what Home Association.

Have you written the mortgage company, and gave them all the (Proof) and all paper work?
You know that if the mortgage see that you have a valid point the tell other's quicker and better than you can also have you
ever seen home set for years and wonder why ,Well if you can not get the mortgage to back you homes you build your out of business.
I'm going to tell you what you do not have a case with. Paint,Window's that work,( For get the small stuff-Screen's)Carpet that's dirty, exhaust fans in the bathroom he puts
in windows and tell me it meet Howard County Code.I hate to inform you but it's a State Code, And I can go on but you get the point. ( I hope) You have 10 year back up of HUD let them know the more legal stuff.
1.small window in the family room has no lock-bolt, and is off the center allowing air to blown in.
2.At settlement he charges me close to $2,000.00 for not settling on time - which was a lie.
3.a washer and dryer cannot fit in. (But not larger for YOUR storage space)
4.And this one a maybe.,The driveway is cracking and there are large holes underneath Driveway.
5.The back porch needs to be re-built there is nothing supporting it, the porch is currently being held up by a cement block, and an old broken piece of board placed there by the builder.
6.Cracks on the cement surrounding the door.
7.Shower wall on your right side is slightly crack.
