On November 30, 2008 I received a collection letter from a company called AmSher Collection Services. This company demanded payment of 1565.98. I replied asking for documentation of this debt, i.e. name of party I owed, copies of invoices from the original party, all the usual documentation.

I received a letter on December 29, 2008 I received a letter from the Portfolio Recovery Associates, LLC demanding the above stated amount. The letter stated that RAC had purchased this debt on 6/30/05. If that was a fact, why would AmSher Collection Services be contacting me? Okay, now for the real kicker!

First of all, it is not my debt. But the best part is, and don't think this date is a typo...the due date for paying this debt is: January 1, 1986! Yes, you read it right, 22 years have passed. I haven't checked it out yet and don't intend to be bothered to do so, but I'm confident the statute of limitations comes into play here!

So, whoever actually is responsible for this debt I'm sure it was 'written off' as uncollectible many years ago!

Although it is a 22 year old debt - that will not stop the bottomfeeders from trying to collect it or sueing you for it. Portfolio is also known for filing false 1099 tax paperwork on you, which means the IRS will want to know why you did not pay taxes on it even if it is not yours. Everything in writing, certified mail return receipt (proof) with collection agencies - stay off the phone EDUCATE YOURSELF http://www.budhibbs.com/index.html a consumer advocate website that specializes in debt collections - and exposes all the illegal tricks they use to try and collect debts that you may not even know. Read what they have on Portfolio Recovery They do not care if you are not the correct person - they only want to collect.
