July 13th 2006 my wife and I take a trip to local Prestige Home Center to talk to a sales man and found out that in 2-3weeks we would be approved for new manufactured and 3-4 weeks later the new home would be done and ready to move to property. We will have p.o.# from factory with in 3 1/2weeks from sign date July 14th 2006 sign buy order gave $4,220 deposit check clears our bank 7/18/06 Note: (be approved) means some type of financing was to be in place.

4 weeks later august 11th 2006 manager of center calls me at 5:11p.m. and states that he had to order new appraisal of property due to low appraisal after my wife and I disscuss this new turn of events 5:20p.m. We call manager back and tell him to cancel order due to poor performance and the lack of any disclosure information Interest on loan,payments,length of loan?

When someone accepts buyers order or orders new home with financing involved does that person or persons have the right to know what the interest rate will be? Length of time of loan? payment amount? To see if it is affordable? and if purchase is contingent to financing doesn't that mean contingent to both parties? Signed truth in lending statement?

Buyers order has no time frame indicated as to length of time to build this fact that there is no time also should work on behalf of the buyer.

Non refundable fees (does not mean deposit is non refundable just fees paid out I.E. title search, land appraisal)

If no time frame in buyers order then lets wait 5-6 years then build it.

Land appraisal comes into prestige homes August 16th 2006 land is worth almost double cost of home but 5 days after we notified manager that this was enough.

I don't have a lot of advice for you on how to get your money back, but definitely keep fighting. What I will say, be THANKFUL this happened. Manufactured homes are probably THE WORST thing you could ever get into. Of course salespeople will never tell you that, as they want the sale. I currently live in one of these albatrosses. We are moving next month and I cannot wait to be rid of this pile of junk. We have lived in ours since 1987 and to tell you it's falling apart is an understatement. We have even had an appraisal done on it, we cannot give it away that's how little value these homes have now. I can buy a brand new car for more money than they are selling these homes for. And let me tell you, once you get in one, you'll have a very hard time getting out of it. We still owe close to $17,000 on ours and will be paying that off for probably another 5 years. Manufactured/Mobile homes should be banned. Salespeople prey on people that have limited funds and no other way out. I hope everything works out for you.

In response to "Contracts are Contracts" "Truth in Lending Statement" is a part of contract.!!! Have never signed one. Nor received copy of one. your former manager also forged my signature on paper work no one can copy my signature my last name has three loops that cross the capital T. so you might want to review your paper work and check the signature's. Check your time frames "appraisel" was ordered after Alton (your former manager) was told to cancel this or his B.S. 8/11/06 spoke to appraisel person she didn't even go out to property she looked it up on Line So you still want to keep The $ 4,220.00 the states attorney might want to see How many others you (Prestige Homes) have signed into contract. Kept in contact with sales staff ? Last dealings with sales staff was November December '06 when someone came in from Punta Gorda Sales area and told me Alton (former Manager) was gone! wonder why??? who is the new manager?

As per my taking over the management of this sales center from Dec. , I have reviewed this file with the parties still in my employ and have concluded: 1) The customer was treated as any would be in relation to our financing a land-in-lieu transaction 2)The property they wished to use as collateral suffered from market conditions as to appraisal and therefore had to be reappraised by another company in order to obtain the required amount 3)As per our non-refundables policy all monies collected will be used to pay for any and all expenses associated with obtaining financing , paying out of pockets,and other remaining monies collected on their behalf shall be kept 4) As per our policy , we will be glad to give them FULL credit for all monies received towards purchase of a modular/manufactured home for a period up to one year. 5) This customer has been in contact with my sales staff since I took over we and are trying to accomodate them and they may contact me at any time.
