Benji Barrow's company did refund my 200.00 when I realized this was a bogus charge on my closing costs. They refunded it only because the company knew this was fraud. Since there are no warranty laws Benji refused to fix a bath tub that was improperly installed. When I called him up to ask him how he was going to fix it he used the F word and said he is done with me. I will be tearing out the walls myself to make sure this tub has the proper support.

Dear Benji and Nathan, I contacted Alicia, an AmerenUE billing customer service rep. again to retrieve the $200 deposit charged to us at closing. According to their policy, when the services were transferred to us on July 15th, 2008, the $200 deposit charged to the account Robert B Construction started for constructing our home would have been credited to your final bill or a refunded to you. The deposit is not transferred with the transfer of service. There is no way we can retrieve the $200 deposit. It was not necessary for you charge the $200 at closing or for us to attempt to retrieve the $200 deposit from AmerenUE. At closing, we did not question the deposit because our experience told us deposits are charged for starting up services. Please refund the $200 deposit you charged us at closing by 10/29/2008. Thank you. We will find out if they respond. Will post results at later date. Dear Benji and Nathan, October 18, 2008 Dan, your plumber visited our home Saturday 10/18/08 as arranged to inspect a leak caused by missing caulk at the back of the kitchen sink. He also inspected the mudroom, laundry room; guest bathroom sinks for caulk and the children's bathroom tub shower. Upon inspecting the kitchen sink, he responded by saying he normally does not apply the finished caulk. That is left up to the person who installs the sinks or the painters. He also said he did not see a leak. He was looking for plumbing leaks not caulk leaks. I mentioned it was a missing caulk leak. Any way, he did not find a leak because we were very careful not to place water on the place where the caulk was missing. I proceeded to place water on the leak to show him, but he stopped me. However, I did show him the damaged sink cabinet base floor. He did apply caulk to the kitchen sink, mudroom, and laundry room sinks. We proceeded to the Children's tub/shower. I began to ask him questions about the installation based on the tub/shower instructions. For example, was adhesive applied to the alcove studs before the sidewalls were installed? He said no to all questions relating to proper installation called out by the manufacturer instructions. See attached instructions. Dan admitted he normally installs one-piece fiberglass tub/showers. I expect a person in his line of work to properly install any tub/shower just as I am expect to design products with any computer aided design software. Because of this the tub/shower base seam caulk seal broke and probably leaks. According to the manufacturer, if the tub/shower installation instructions were properly followed, this would not happen. He did not read the instructions. Dan offered a solution but according to the manufacturer it will not work. Since I could not perform any work without insurance and arranging inspection visits with my agent was tedious at best, I trusted you and your subs with the proper sink caulking and tub/shower installation. It was repeatedly told to us to let us do our job Please inform me what you intend to do to resolve the damaged kitchen sink base cabinet and tub/shower. If you wish to inspect them yourself please arrange a visit. Thank you. Benji and Nathan. We will see if this soln is resolved. Will post results at later date.

We are willing to forgive and forget reconcile. The company should not get away with what they did, though. We would like to work this situation out. If our builder does not have consequences this may happen to another unsuspecting customer. We do realize by posting these reports we may receive more retaliation. Despite what has happened our builder does good work. He came with excellent references even from the most recent customer. I like to note that my husband, only not I, inspected the house on the first inspection because my son needed to get out of the house and not watch our three younger children. I stayed home to take care of them. I could not ask him to watch the children any longer needing a break. During this craziness he was left to pitch more than a child of his age should have to. The second inspection I was unable to face my realtor and broker who allowed this to happen planning and scheming with our builder. I have faced many harassment situations before and this time I could not muster enough courage again to face my realtor and broker for the last inspection of our house. I waited in the car with our newborn baby. The things we are catching could only be caught upon living in the house. With both my husband and I being so frazzeled keeping up with their demands double checking and documenting everything I am not sure I would have caught the cook top cabinet being incorrect. With so many tasks, having a baby my brain was having a difficult time keeping up. I was very overwhelmed. Again, we would like to make things right for us. We would like to be able to recommend this builder to others. We would love to bring this builder more and more business.
