I purchased a queen-size Kingsdown mattress and box spring approximately six months ago at Sleepy's in Waterford, CT. Within a week, I noticed considerable sagging in the middle of the mattress. After several "inspections" by an independent contractor hired by Sleepys, I agreed to an exchange for a new box spring and mattress. [The inspection procedure to determine if the mattress is within warranty is, in itself, a sham. It is a static, no-load test, performed with a string and yardstick. To obtain an accurate and true measurement, mattress sag can only be determined with a load (i.e. body) resting on the surface of the bed.]

The exchange process took almost two months, and included lengthy telephone conversations and extensive hold times with so-called professionals. After receiving the new box spring and mattress, the same sagging problem was evident, and in fact, worse than the first bed set. I have asked Sleepys to pick up the defective merchandise and for a full refund.

They continue to stonewall my request by proposing more inspections and offering nothing more than excuses they deem as policy. This is a rip-off, pure and simple. What is presented in the showroom doesnt even closely resemble the product that is delivered. From my elementary investigation into Sleepys and Kingsdown, it is clear that this is normal practice for these companies.

I intend to follow through by contacting the State of Connecticuts Attorney General, Richard Blumenthal. He has an impressive history of consumer advocacy, aggressive law enforcement for consumer protection, and a record of recovering hundreds of millions of dollars for Connecticut taxpayers and consumers each year.

For those in the mattress market, be wary. Sleepys and Kingsdown are companies that operate in the deceitful zone.

As of September 2009, I do not have a resolution from Sleepy's. I understand the Attorney General of CT has an on-going investigation of Sleepy's.

A stress test would prove if double heat tempered steel never looses its memory, if it does, how long does it take and under how much pressure. Sounds like a rebuilt mattress but difficult to prove it would be inferior to a new mattress. The problem I have with this is companies that specialize in rebuilt mattresses (not the ligitimate manufactures who just recycle steel) these skum buckets use foams out of old mattresses that have been discarded. Those foams could hibernate bed bug eggs for a year before hatching. Then you have a very bad problem that is impossible to irridicate, you will have to throw everything out of your house and then that is probably not enough, carpet, sofa, chairs...get the picture! Plus, not to mention the bacteria and germs that is in those foams. These mattresses are purhased for $5.00 on the streets of your hometown, broken down and rebuilt and sold for huge profits as "manufactures overstock" or "floor models", "comfort exchanges", from non-authorized dealers without manufactures warranties. Because no manufacture in their right mind would warranty a bed like this! I would like to see a federal law passed where retailers can not do comfort exchanges or resell mattresses that have been returned for warranty issues. Even for the poor, beds like this is no bargin! Hey I just felt like I should let you consumers know thwat as an employee of Kingsdown we are made to re-use springs. For instance almost all beds that are returned for ANY reason are all stripped down till its just the fiber batting(called flex) and the spring unit. These used units are then recovered and sent out under the assumption that they are New. There have been several attempts by employees to halt this process however the management states that these units are tempered steele and dont wear out. Also if you read the law tag on your "NEW" mattress it states that the matterials are "all new" wich after all MAY be true or it MAY NOT be true. Also we are not the only mattress company to do this.
