Hello there!

I had found The Discount Warehouse, Inc. through a search I did on Yahoo!. I have since filed with the BBB, FTC, consumer action and several other agencies against this company. They provided me used and defective merchandise and have since refused to correct the situation. I have attached the complaint that I sent originally to BBB. I write to you only in the hopes of saving others the trouble I am now facing! Thanks so much!

"I bought 2 pallets of Federated Dept stores' overstock merchandise from TDW. I wired $2,170.58 on 1/12/04. The salesperson, Angie, and I emailed back and forth. I have the emails that were sent. She states the products are overstock, returns and shelf pull merchandise from Federated. On TDW's website they advertise "directly from the Department Stores Reclamation Centers to you!" and "Huge selection of high-end brand names". When we get the shipment on 1/20/04, we were disgusted to find the boxes were filled with nothing but damaged, used goods. We have over 100 photos and videotape of the goods, which wasted a full day of our time. There are tags on 80% of the items that state "DAMAGE". Some tags say "USED" or "Soiled". Everything is garbage. The tags have dates as old as '99. Not "directly..to you", as they state. Mattress pads are green! Sheets have huge holes in them. Pillows are torn. Not only is this stuff ugly, but they sold us an electric blanket that has a short in it! They're going to hurt somebody!

Anyway, I immediately called Angie and told her about the shipment. She said there was nothing she could do and she would have to call me back in 15 minutes. So I wait. No call, so I call her. Instead I get a guy named, Jason, who tells me "it doesn't matter what the tags say". "It doesn't matter if it says used". Also, "you signed a paper stating merchandise is sold 'as is'." So basically that gives them a license to defraud me. There is a difference between store overstock and used merchandise! They grossly misrepresented what I was buying. Then he says he can't do anything and the boss will be in tomorrow.

So 8:00 am Jan. 21 I call Jason, he says the boss will be in at 1:00. So I call back at 1:00. He then says the boss, Mike, will offer me $1000 credit towards my next purchase but nothing more. I ask to talk to Mike. No Mike. "Try again in a couple of hours." So I call at 3:15 and get an answering machine. I left a message to contact me. Then I try the 800 # & someone tells me he's gone."

It appears that I have saved myself a tremendous amount of grief by not following through with a prospective order. I am curious as to what the Ebay user ID is for TDW as I feel most vulernable to bulk merchandising until I am informed. Thank you, Amy! Unfortunately, I found this Rip-off Report on TDW too late. I will soon file an individual report on my own situation with TDW, but I'll share some of it here. I am somewhat new to this kind of business, and I figured it would be best to deal with a distributor close to me. TDW is located within a 3 and a half hour drive of me -- so my wife and I drove down to get a feel for their merchandise. We also dealt with "Angie", both over the phone, in email, and in person when we visited. While we were there, we expressed interest in a truckload shipment located in Atlanta, GA. Angie provided us a printed-out manifest of what it consisted of. A few days later we decided to purchase it, so we contacted Angie again, had her email us the manifest so we could confirm the items and also have an electronic copy of the hardcopy she gave us -- and then we wired them the money. Angie verbally guaranteed us a receiving date for the shipment. It ended up coming a whole week later -- but that's a different grievance I won't go into for now. The real problem was when the shipment arrived... It was the WRONG ORDER!! The delivery driver handed us the truck's manifest (which was placed INSIDE the truck bed -- so we HAD to break the seal to open the truck to get it), and we went into shock as we flipped through the pages. TWENTY-FOUR PALLETS of the *****WRONG STUFF*****!! Granted, about 40% of it was CLOSE (not exact) to what we had paid for. However, the remaining 60% was FAR LESS VALUABLE merchandise. We tried to refuse the order, but that's a long story. However, we do have Jason's voice on two voicemails stating that if we accept the order that he will gladly work with us towards a resolution of this problem. Needless to say, we have not heard from him since -- and he is deliberately blocking and auto-deleting our emails. We are not taking our chances. We are in the process of filing a lawsuit against them -- and we are right here in Florida filing it. I hope that many of you who have been victimized by TDW, and have the proof to show it, can contact me regarding a class-action against them. Email me at [email protected]

All I am going to say is I have been in the same situation with TDW Closeouts. I did not receive any of what I had ordered and never heard back from their customer service department. The fact that this company lied and misled its consumers, people should STOP justifying the wrong things that this company has done wether you are an employee or someone that has too much time in their hands to ridicule or trying to tell the victim what to do when they have NEVER been in the same situation! We have all learned from this mistake and I know we all know better that if it's too good to be true, it must not be! Thank you to the rest for reporting this company's fraudulent actions. They need to be shut down, well if you believe in karma, it will catch up with them.

Amy, I just have to say thank you. I contacted TDW Closeouts today regarding buying electronics by the pallets. I to was questioning their practices. First the lady on the phone was rude, secondly they don't take credit cards ? Who doesn't take credit cards, sure, some may charge 3%, but it's common practice to take credit cards. Unless they are a big account of my company, and I have done business with them in the past, I always pay with credit card, I only do wire transfers after I have established trust with the company. Furthermore, they didn't have a manifest for ANY of their pallets, so I was thinking they've got junk. If they don't manifest their items, how can they tell you how much is returns or overstock. I was ready to purchase $10,500 (9 Pallets) worth of electronics if this company was going to pan out, but I had a bad gut feeling about them. I decided not to purchase from them, especially since the sales repersentative was so rude. Was not helpful at all. So I decided to search the internet and I found your complaint, and I thought what a relief that I hadn't ordered from them. Thank you for posting this to help other people from being scammed by them! Thanks,

THIS EBAY CRAZE IS NOT SOME SILLY MECHANISM TO GET RICH OVERNIGHT...WHAT IT IS FOR THOUSANDS OF PEOPLE IS A WAY TO SPEND MORE TIME WITH THEIR FAMILIES, OR BECOME SELF SUFFICIENT, ETC... HONEST LIQUIDATORS GREET US WITH OPEN ARMS, INCREASING THEIR SALES DRAMATICALLY, WHILE THE DISCOUNT WHAREHOUSE ONLY SEES POTENTIAL SUCKERS!!!! Get this...now these crooks want to take advantage of honest people who wish to try and make an honest living working from home, selling goods on EBAY??? Oh my God, these people are simply, and utterly pathetic!!!!! I left my job working as an engineering manager, so that I can be home with my wife whom has been battling cancer for more than a year and a half, and these pathetic soles want to demean my efforts with this garbage that just keeps spewing from their mouths like toxic waste into a river...just plain sick! Have you noticed that they do not file rebuttals personally, but try to file under fictitious names of people, like they are frustrated bystanders...they do not have an honest bone in their bodies. For the thieves at THE DISCOUNT WHAREHOUSE IN SUNRISE FLORIDA.... "WE DID NOT ORDER STORE RETURNS...WE ORDERED OVERSTOCK AND SHELF PULLS". One of your lil' croanies told us that there may be a small percentage of returns (less than 10%), which we agreed to accept, but what we got was 100% garbage...please do not mistaken the word garbage for anger...we got garbage...somebody's garbage! I am sure the good folks at THE DISCOUNT WHAREHOUSE IN SUNRISE FLORIDA gets a good laugh at all of this, because I am getting more people contacting me all the time, about being victimized by these fools. Also for the thieves at THE DISCOUNT WHAREHOUSE IN FLORIDA, as you already know, we did not purchase electronics, and the items that were sent to us were well beyond repair, resale, and had to be disposed of. We have since found very reputable liquidators, and if anyone wishes to contact us, we will be more than happy to supply this information to you. Please contact me if you have also been ripped off by this company THE DISCOUNT WHAREHOUSE IN FLORIDA. I have lots of resources that can aid you in your attempts to recover your losses with them. You also may notice that there are several mentions of an offer of a partial refund...don't you believe it...we have had nothing offered to us..and for you who keeps mentioning these offers...you know how to contact me, and make me a real offer! Ok take it from me. I have been in the liquidation business for decades. This is what happens when regular average Joe consumer wants to become a millionaire on Ebay. You buy up pallets of cheap merchandise and think your going to be able to resell all of it right away. This has never been the case. At best pallets of liquidation are around 30-50% working, if your lucky. We can sell it cheap because we don't go through every box and plug and check all products. If we did we would need more manpower and therefore have to charge you more. Sure we offer discounts on repurchases to someone who was a decent understanding customer, read everything, and agrees that this is how this business works. YOU SHOULD HAVE TAKEN THE 1500 BACK. That was an excellent offer. I never offer half the money back. Geesh. I do make sure people understand fully that they are buying merchadise that is returned for whatever reason. Just as this company has done. People if you don't know how to "refurbish" this stuff don't buy it. Most of the people I sell to are retired men that have a large garage they sit around and fix this stuff up and re-sell it. What can't be fixed from one pallet goes into their inventory and might be useable on the next pallet. That is what the word refurbished means. A faulty wire here. A short there. A broken pot there, a seam undone there. People fix them and sell them when fixed. It's not new. Shelf pulls can be due to defects that don't put the public at risk. The only time people return things that are fine is after Christmas. Some products like these dvd-rw Sansui units we got in just need one wire connected in every unit and they work perfectly. Bam 250.00 a pop. Just for reconnecting a wire. Of course you are NOT going to buy a pallet of all excellent goods for resale that cheap. If you were you would buy from a distributor and pay 10,000 per truckload like the stores do. This is just how it works. People need to understand that it takes money and effort to make money. You want to make a quick buck try making crafts and selling those. Dealing with the generaly public takes a lot of patience. People don't read everything. It's a shame you have put a black mark on this companys name. I tell you this is how the business works. Don't buy from liquidators if you don't have the knowledge and time to fix them. This really steams me up because I hear this story all the time.

They are the flim flam men of the present. They take advantage of good honest people trying to make a living by selling on on-line auction houses like E-bay. They sell them on a new car, then deliver the junker. They say things like "This stuff is not meant to be given to your friends and relatives...it is meant for re-sale" Well, rip-off you need to wake up and smell the roses, because everyone in this world is a friend and family member to somebody, meaning this crap you sent us should have been delivered to the dump by you, and not us!!!! Obviously you make a good living at ripping people off, so why don't you at least call a spade a spade...you are a thief. Well folks, get this...we spent the time and money to file a small claims suit against these crooks. They had some attorneys office send us some documents claiming there was a continuance in the case, because we filed in the incorrect jurisdiction. Well that too was a lie,,,just another con!TESE PEOPLE WILL STOOP TO LOWER LEVELS THAN YOU OR I WILL EVER IMAGINE...THEY KNOW MY WIFE IS BATTLING CANCER, YET THEY CONTINUE TO DENY US OUR MONEY BACK...HEY, GREAT OFFER GUY'S...A CREDIT TOWARDS MORE CRAP...SORRY THE LAST LOAD COST ME ANOTHER $20.00 TO DUMP...WHAT A JOKE! Also we try in every way to help the customers with credits on the next purchases. This merchandise can be Store returns, Overstock and or Self Pulls, and is made quiet clear on the website. You can read the terms @ http://tdwcloseouts.com/qanda.html#p. We have been around for over 13 years and have customers that read and understand the Terms of Conditions and know what they are buying. Just read what one customer wrote about us. I have a question....would you return perfectly working merchandise to a store? Probably not...So, in you buying these RETURNED goods from TDW...goods that were ADVERTISED as RETURNS, one would definitely figure these goods were broken. That is why TDW can offer you PALLETS of merchandise for cheap...It is not stuff to give your relatives for presents or anything...it is RETURNED DEFECTIVE MERCHANDISE ...mainly meant for repair and resale...You are not going to get things in mint or even near mint condition and to expect that is ridiculous. As I investigate further, Federated has stated to me that they don't even sell any overstock by the pallet. So I was lied to! Angie at TDW said there was no way to know the return % and she lied! Because 100% is returns. All damaged merchandise.... that like you said... nobody wants! Not only is the salesperson misleading but so is their website! Please don't take your chances with them!

I have a question....would you return perfectly working merchandise to a store? Probably not...So, in you buying these RETURNED goods from TDW...goods that were ADVERTISED as RETURNS, one would definately figure these goods were broken..That is why TDW can offer you PALLETS of merchandise for cheap...It is not stuff to give your relatives for presents or anything...it is RETURNED DEFECTIVE MERCHANDISE ...mainly meant for repair and resale...You are not going to get things in mint or even near mint condition and to expect that is rediculous..Please don't go expecting something because, in my honest opinion, you got what you paid for and did not get ripped off.
