Jennifer Opra came to our company to generate them Medicare Advantage Appointments. Basically overflow work from their company. We took on the project and they purchased 200 Hours for $2,000.00 When I tried to process through PayPal it denied the credit card. Due to the fact they can no longer use PayPal with that Credit Card as PayPal has blocked it, So I sent them a payment a link through Google Checkout, Jennifer Oprah the Vice President of Telemarketing 21 purchased using her Credit Card Through Google Checkout. as in the contract we did not guarantee and(xx) amount of leads in 200 hours. They wanted 500 appointments generated, but we did state that could be a goal but it was not promised. During the 200 hours we generated over 250 leads for Telemarketing 21. Which we felt was very good. As we rushed the services for them. Thia was all done in one week. We did not charge a fee for the rush, the rush meaning they paid and we started calling within 48 hours. All appointments were of good quality and we never received any bad complaints as of the quality from Telemarketing 21. If we would have we would of given them the option to replace those leads that were no shows. AS we always want to our appointments to be good strong appointments. Now telemarketing is trying to do a charge back through google checkout on us. Which is very upsetting as we gave them 200 hours of service, they agreed to contract which stated no certain amount of leads were guaranteed. I should of known when PayPal turned the payment down, we should of flagged it and not of tried another payment source. But Jennifer Opra stated they shut their PayPal down and that is why. I have sent all responses and emails and contract to Google Checkout and I am hoping that Telemarketing 21 reads this posting and drops the charge back, as they should KNOW they are IN THE WRONG and this charge back is ridiculous. Please be advised I will fight this completely and you should be receiving letter from our attorney, and a filing will be made to the BBB of Texas if this charge back goes through, and if it results in a charge back as the contract states: Any accounts that result in a credit card charge back will still be held accountable for payment; therefore, any charges with be sent to ___________. You will be turned into to a collection agency. This was very clear in contract.

Thank You,

Angel

We were advised by Heather, a representative from Tandem Prospecting, your company could schedule 500 appointments in one calendar week. In which I have an email confirming this (SEE BELOW). Payment was made (regardless if it was through our merchant account Pay Pal or through another merchant account it's no relevance); you received $2000.00 to provide services in which a representative from your company made us believe. We did not receive anywhere near our order request. Let me explain Angel in case you are not aware we both run a high risk business in which we must provide the services in which we advertise. Appointments are not only supposed to be top quality, but orders need to be completed. I understand your billing practices are different than ours, however I believe agents would benefit more from paying per appointments. We were assured by your representative from your company Heather 500 appointments could be scheduled. We did receive a call from you as well (after payment was made) with the same confirmation. You sent an email after T21 paid for services giving us a different report of how services would be rendered (meaning price). Regardless, we hung in there to see what type of quality service we would receive. T21 even went far as to supplying TANDEM PROSPECTING with paid leads and a script. Regardless our agents were not only complaining of the incomplete schedules (thanks to Tandem Prospecting's organization); but we have received many complaints about the quality of the appointments (were not expecting them or pre-screened, etc) As a fellow Telemarketing firm, I expect you Angel, to verify if the appointments are quality appointments as well as orders completed and you did not do so. Why would anyone pay for services in which were not rendered? We have supporting documentation that will hold up legally. Also after checking around, we found out you do not run a legitimate business, you change your company name constantly and your previous website is no longer running under Tandem Telemarketing. What is your new company now Angel I wonder? That is correct. ______________________ From: [email protected] [mailto:[email protected]] Sent: Thursday, January 10, 2008 12:55 PM To: 'Heather' Subject: RE: Telemarketing Services Order Form That's awesome Heather, one more thing I just want clarification out of the 200 hours we are purchasing you can get me 500 appointments next week from Monday Saturday? Jennifer Opra _________________________ From: Heather Sent: Thursday, January 10, 2008 12:29 PM To: [email protected] Subject: RE: Telemarketing Services Order Form Yes they can listen to the callers. But for the most part that won't be a concern; Yes we can replace the appointment if needed. We do not have a specific policy in place but can replace the lead if needed, though there should not be a need to do so. A replacable appointment would be an appointment where the contact says they never set the appointment and where the agent that set' the appointment did not in fact do so, in which case they would be terminated and you would get one to replace the appointment. Heather _______________ From: [email protected] [mailto:[email protected]] Sent: Thursday, January 10, 2008 12:24 PM To: 'Heather' Subject: RE: Telemarketing Services Order Form I will be sending it shortly. Another question if an agent complains about the appointment not being set I understand you digitally record everything, which is great. Would we be able to listen to them if needed to confirm or have the agent listen and verify? I also need to know if your company has a replacement policy if so what is a replaceable appointment. We need to know so we can change our replacement policy to fit with yours in case an agent runs into a bad appointment. Thanks Heather for your help. Fax the order form back to 330-777-5699. As soon as we get this fax I will make sure that the Account Manager sends you the welcome email so we can get all this information today and get the agents trained on your project. I look forward to working with you! Heather
