i am gonna give a copy of letter briefly and i mean very briefly explaing what happened. i also notice a report on here from the same comp. the exact same thing happened to us the exact way. its unbelivable ..i wrote to the bbb at an earlier date last year at this time things have changed and would like to see if more can be done.

i am having a very large problem which i think consits of misreprensation and possiable bait and switch and really need help. i can not afford an attorney or would have already taken to court. i have much documentation paper work and pictures of all statements. can you please help me, i will give you a brief description of problem and if you need more just let me know. i see many complaints have been filed against this company. it is the pool depot of georgia address is 120 interstate parkway east in atlanta georgia. i also have contacted the consumer affairs of georgia which i understand from an investigation report they are building a report against the pool depot.

i was brought into this situation by seeing the advertisement for the 395$ pool package this is what i was out to get. insted when sales man was at the hosue he claimed it was junk and would fall apart in a years time not a stable pool because it was oval etc. he then inticed us with the top of the line elite model which contained no chemicals( it worked by an ionizer system) and very little maintaince only shock one time before each season of swimming was the only chemicals involved and a lifetime warranty. well after disscusing with my husband we decided in the long run that would actually save us money with the no chemicals and warranty, they told us no middle man if any problems we just call them and they take care of everything. this was very inticing although i did not like the final price of 7800$. but again decided it would pay off, and we could make mo. payments of 141$. they did not tell us it would be finaced which in the end would cost 12,000. i thought it was all through the pool depot. however the papers came like 2 weeks before installed and i was blasted by the finace and upset they did not tell us. after waiting 4 weeks for installation(and trust me the story goes much deeper) they were late, broke my h2o pipe to the house and i had to buy the things to fix and by the crew lunch to have them fix it. but after installed he stood upon me stading with a box of chemicacls telling me how and what to do, right then it all began. he told me there was no such thing as a chemical free pool etc.

well with technology today and this ionozer i knew no better it sounded ok to me. he told me i have to put clorox in each week test ph test alkallinity, add this add that and kept going on. if i knew all this i would have stuck with the 395$ pool. this was the whole reason of paying this amt. for this pool. 2 days later called pool comp. to let them know i was extremely upset, and for them to come get thier pool i was not happy and piesces were already falling apart and have pics to show this. he then told me did i read the back of the contract, well i was never aware there was a back to the contract. on the back they have everything covored such as this is not a chemical free pool etc. i really felt i was done wrong and asked why they didnt have an initail or signature line to show i have seen this??? i had a three day cancelation period which was before pool was ever installed. knowing i was very upset the pool was-is junk they installed a ity bitty horriable looking deck with broken pickets etc.(again much more to this) and very dangerous. well contract signed you are stuck with it. this was my answer. i went all directions for help taled to many people whom were aware of this comp. etc.pool was installed 4-5-01 on 4-17-01 they already put a lein on our home, mind you never got a bill or chance to pay nor were repairs even attemted to be fixed. they offered to fix the pool and did but this is all besides the point.

6 mos later when repairs were made they had to replace liner due to beetles came through the liner( this heavy duty indestructiable liner as they told me) i cant even swim in the pool the ionizer turns my hair green. this was a question i asked when purchased, being a hair stylist with bleach blonde hair i asked him(wayne smith) if the copper and metal in that would ruin my hair he assured me it wouldnt. i almost lost all of it due to this and cant even get my hair wet in the pool this also defeats this ionozer.

i am very very upset and now they are threting me to come take the pool and we are resposiable for all disassemble shipping full cost of the pool and intrest and still have the lein on our home. because of this we have since filed bankrupcty because of this harrasment and nightmare. they finally sent us a payment book in oct of 01. i have many certified letters i wrote them addressing problems and much info. in 99 this company had lawsuits on them for bait and switch. can you please help me??

I also called the ad on TV to find out about their pool packages and had a very friendly sales guy come out to let me know the advertised pool was a piece of junk. They came up with the same deal you got..almost $8000.00 later. They had to process my application which also doubles as the sales contract (conveniently)...well they gave me 3 days to cancel, but didn't "process" my application for 5 days..and if you read the fine print..you must cancel after the process of your app within 3 days...they dont make this possible however..so you get stuck so to speak. When you call to complain to higher up..you get the nasty, threatening, rude and un-professional people in charge telling you that they will take your house if you dont pay for the pool. Here is what I did to get them off my back... After the nightmare began I still told them there was no way in hell I was getting that pool...If it is financed through another company they won't get your money unless you agree to the terms of the loan with the finance company...When they called I politely said no thank you... I immediately began getting calls from "management" who said that I was going to pay for that pool because he had a signed contract...well, one of their policies was that you had to be the homeowner....so they can lein your property..from the comments he made about slapping a lein on my house... I told him that the sales guy new I didn't own the house and my landlord didn't want a pool on his property...plus didn't my signature mean nothing and make that contract null and void seeings it went against one of their own policies????...apparently not! He began threatening me with lawsuit, fraud, (go figure..coming from the experts). I hung up on him and started my research through BBB. I found out that they had changed names more then 3 times in the last couple of years...and in Arizona there was a lawsuit against them but it didn't say what it was for... I called the attorney general for Arizona, and they were sued for bait and switch and had to pay back a bunch of customers who had been ripped off. They were VERY familiar with this company and advised me to file a complaint with the attorney general and consumer affairs in Ga. I gathered all the info on this company by making a few phone calls and then I called back my friendly manager one last time to try and cancel my contract again...this time I had my tape recorder hooked up to my phone so that I could replay my conversation at a later time. In between phone calls they tried to set up my appointment for installation several times...they even had the installer call me one morning to get directions because they told him to take the pool over and put it up no matter what!!! Once you let them on your property and they move one piece of dirt they can hold you liable..but they hadn't done anything so I knew (from the attny gen in arizona) that until then they couldn't hold me to crap! I first apologized to the installer for having to break this to him, but I wasn't getting a pool from them, and if he even thought about driving over and setting foot on my property I would have the sheriff and an ambulance waiting. He didn't bring the pool. I asked mr manager about all their lawsuits and terrible consumer reports and he of course avoided the questions and continued to threaten to get my money. Having all his lovely comments on tape now...including the cussing I heard after telling him that I did not want his company to contact me by phone ever again and anything they had to say should be in writing..( he responded with "I'll call you any time I want to ...you got that") I wrote a letter advising them that I was cancelling my contract with them, and included all the info from their previous problems with the attorney general...including their documentation of the lawsuit (24 pages) and their offer to help anyway necessary with my case in GA...the property deed that didn't have my name on it and a copy of their policy...my taped conversation with the un-satisfactory customer service from management no less...and last but not least a tape of their false advertised commercial...I wished them luck in the future...and oh yeah..also told them that if they wanted to continue to hassle me and harrass me over their scam that I also had several of the same sort of packages ready to mail to all major networks, newspapers, reporters, radio stations, and I was waiting for the paint to dry on the huge sign I had made for my vehicle which I was going to drive around with in front of their business and all around atlanta. I got one last letter from them telling me that they no longer wanted to do business with me...AAAWWWW....I guess they decided this after they realized that i meant business. Thanks!!
