I wish someone would tell me how trucking can get by with sharing confidential info with each other. DAC is not even recognized by DOT. It's just a way to make driver look bad. I Have spoken with DOT in Washington on several occations and they seem to have completely rules and the trucking companies. Such as drug testing. They test for five opiates but a company can as for information on your different meds. I fall under the ADA with bipolar yet I was refused a job and told mw blatanly that they do not hire people on anti-depressants. DOT doesn't have a problem with then so I'm going through EEOC.

Now about USX: I was only with them for 3.5 yrs and loved my job, loved the company for that matter. But over the 3.5 years I had 5 minor so-called accidents, depending on what company wants to call. eg one of mine was bumping a trailer, because my team ptr backed it in to close to trailer on right, there was about 3" all the way back. Someone, don't know who called and told USX that we had creamed two trailer. I menuvered the trailer until I though I could get it out, but bumped the other trailer with back overhang on top right of other trailer. There was no damage, to either trailer. No demarcation or residue. Nothing written. My safety dept was told by this Cos. safety that there had been no accident and they were letting us take our load and go, Well guess what??? When I got home two weeks later I had a letter in the mail stating that I was on probation for admitting to bumping trailer even though there was no damage. I had 4 other accidents in that 3.5 yra, no DOT reportable clean MVR, no tickets and now I can't get a job because of my driving record. TX Rehab sent me to school and I drove one company and now they seem to be black balling with those accidents. I don't believe that these minor incidents should ruin a persons career. If I had major accidents I might under stand it. I intend to pursue these practice and show that DAC is a crock. DOT doesn't even recognize DAC. How can these cos get by with this. You only get better with practice. I've filed a complaint with Federal Motor carrier and will do my best to keep this from happening to anyone else.

If anyone else is having these problems please notify me as I an on a mission so this doesn't happen to anyone else

Goldie, First of all, DAC is not a government agency and is not in any way under the jurisdiction of the DOT. DAC/USIS is a for profit business just like a credit reporting agency. It is governed under the FCRA as well. The trucking companies subscribe to it just like a creditor would subscribe to a credit bureau. You are entitled to get a copy of your DAC report, and if you were denied employment because of it, you can get it for FREE. You also have the right to dispute any item on your DAC report and may add your 100 word consumer statement explaining your side. Furthermore, any company can establish whatever requirements for hire they desire as long as they apply to everyone evenly regardless of race, religion, national origin, or sexual orientation. Any disability must be accomodated by the employer under the ADA, UNLESS they have evidence that you could not safely do the job. You had a lot of accidents in 3.5 years. 5 accidents? That is more than 1 per year! It does not matter if there was any damage or not. An accident is an accident. You even admitted you hit it. The Justice Department enforces the ADA. The US Dept of Labor handles discrimination cases. You cannot legally operate any commercial vehicle with any type of narcotic in your system. I suggest you take a local driving job for 6 months to a year without any more accidents before applying to any other OTR company. Maybe you need to get your medical condition re-evaluated, as it seems like you have a problem paying attention to detail which can cost you your life behind the wheel of a big truck, and you can take others with you.
