I Made a $500.00 check deposit to my acct.( a check My daughter received from her insurance company: Old Republic Ins. Co.); since she was in surgery, she endorsed the check to me, hence I deposited this check to my account at Washington Mutual Bank.

The bank made my account negative for not processing this deposit AFTER taking the deposit. No contact was made to me until I noticed negativaty and called them 10 days later, THEN they told me that their system shows this check was not paid and or was not processed, they don't know exactly why. They asked me to fax proof of deposit and they will research it, no response. We contacted insurance to reissue another check and stop pay prior check. Insurance company mailed us proof of cancelled check noting it had been paid. 15 days later from my deposit, I physically bring in proof to the bank and their vice president, Financial Center Manager: Jonathen-Ray Espiny has no authority from bank rules to help me.

He cannot credit my account for the funds they already took from my daughter's check insurance company.. He is going to BEGIN the process of requesting copy of this cancelled check and still say's he can NEVER credit my account.. They plan to keep the money since my daughter was not a signer on the account and the teller entering the deposit didn't note which account this check was going into. RIPOFF, RIPOFF!!! What bank ethics are they teaching their employees???

Although I would never suggest that anyone be treated as you have, in Wasington Mutual's defense (this goes for any bank in this situation.) What you have here is a 3rd party check. Banks in the past were able to accept 3rd party checks. Now since the ratification of the "Patriot Act" it is illegal for a financial institution to deposit a 3rd party check. The financial institution can lose their licence to do business if they do. I work for a small (very small) bank and we see this kind of problem often. What most likely happened to your check is the Federal Reserve bank in Los Angeles seized it. And I wouldn't be surprised if you caused that teller to lose his or her job, with the patriot act in place, it makes teller's personally responsible for illegal actions.
