Stepmother who is deemed "vulnerable elderly person with disability" under NJ parameters entered into a contractual sales agreement with Weichert Realtors-Forked River for a term (6) month listing contract. Agent for company got her to list her property (a 1980 doublewide mobile home in a 55+ leased park) for (3) times the worth based on comps. Realtor has scheduled (4) different open houses and has never showed or called at last minute to cancel creating unnecessary hardship and anticipation for her to get ready for. In reviewing her contract I found that the date stipulates that the contract would run from August 29, 2017 to February 28, 2017? Additionally, the Realtor took advantage of my stepmother by charging an outrageous fixed commission of $4,000.00 + 199.00, irrespective of the sales price, which is normally a sliding scale of actual sales price at 6%? We have documented numerous attempts to contact the managing agent to discuss but they will not respond. It is our belief that the original listing agent may have used my stepmother desperation to sell her home in order to move into NJ elderly subsidized housing as a ploy to keep her real estate license in active status, by showing she has a listing but yet has no intention to either sell the property at the grossly inflated price or honest effort to sell the property by conventional means of active showing, open houses, relator caravans etc. Family hmembers have left numerous messages for Managing Broker to discuss the issues, with no response. Due to the realtors actions my step mother has constant anxiety, depression and is fear that she either cant get into the subsidized housing due to fixed income constraints and the hardship of maintaining (2) households. Clearly, this borders NJ Elder abuse program. We are asking for intervention and questions as to why this is happening to her.
